Los Angeles Times: Killer’s Execution Is Postponed Indefinitely
Death row inmate Michael Morales’ execution was postponed this afternoon until at least May, after prison officials said they were unable to put the defendant to death under a new court-ordered lethal injection procedure.
This has been a CIRCUS from the start. And a set-up by the anti-death penalty biased federal judge, Jeremy Fogel. The judge set up a strawman and he was blown down after almost 25 years since the commission of this heinous murder.
Is the judge flaunting the will of California voters who voted to reinstate the California death penalty in 1978.
You bet.
But Fogel has lifetime tenure on the federal bench and is impervious to removal by impeachment.
U.S. District Judge Jeremy Fogel then said prison officials could proceed without the doctors, but would have to execute Morales with an overdose of sedatives, rather than the usual three-chemical lethal injection “cocktail,” which had been challenged as excessively painful.
The judge also ordered that a licensed technician deliver the dose from the execution chamber; the cocktail had usually been administered by an “unseen hand” through an extended intravenous tube leading into another room.
Deputy Atty. Gen. Dane Gillette late today told the U.S. 9th Circuit Court of Appeals, which was considering Morales’ appeal of the new procedures, that his office would be unable to comply with the conditions.
Fogel will hold an evidentiary hearing on the new protocol, now scheduled for May 1.
This case will now drag on for months and maybe years – the death warrant expires at 12:01 AM Wednesday.

ASSociated Press: Frist to Offer Bill Halting U.S. Port Deal
Senate Republican Leader Bill Frist called Tuesday for the Bush administration to stop a deal permitting a United Arab Emirates company to take over six major U.S. seaports, upping the ante on a fight that several congressmen, governors and mayors are waging with the White House.
“The decision to finalize this deal should be put on hold until the administration conducts a more extensive review of this matter,” said Frist. “If the administration cannot delay this process, I plan on introducing legislation to ensure that the deal is placed on hold until this decision gets a more thorough review.”
“I’m not against foreign ownership,” said Frist, “but my main concern is national security.” He was speaking to reporters in Long Beach, Calif., where Frist was doing a fact-finding tour on port security and immigration issues.
Will this be another Harriet Miers?

******UPDATE******AP is reporting that the 9th United States Circuit Court of Appeals says the State of California has postponed the Morales execution INDEFINITELY.
Los Angeles Times: Killer’s Execution Is Postponed Indefinitely
The state has indefinitely postponed Tuesday’s planned execution of convicted killer Michael Morales because of a court battle and medical ethics questions surrounding the method of lethal injection.
The state notified federal court officials that it is unable to comply with a judge’s order to have a lethal overdose of barbiturate administered to Morales by a medical professional in the execution chamber, a spokeswoman for the federal courts told The Associated Press.
Morales, 46, was supposed have died at 12:01 a.m. at San Quentin State Prison for torturing, raping and murdering a 17-year-old girl 25 years ago. But it was delayed until at least Tuesday night because the anesthesiologists objected that they might have to advise the executioner if the inmate woke up or appeared to suffer pain.
Prison officials planned to press forward with the execution on Tuesday night, skipping the usual paralyzing and heart-stopping drugs and killing him with an overdose of a sedative.

The execution of a condemned killer was postponed early Tuesday after two anesthesiologists refused for ethical reasons to take part, and attorneys pursued a new round of court challenges that could delay the execution indefinitely.

So, what is the FLAP with the anesthesiologists walking out?
The apparent sticking point was the physicians’ obligation, under procedures specified by a federal appeals court in a ruling Sunday, to intervene if Morales appeared to regain consciousness or displayed signs of pain. The court said the anesthesiologists would then have to take steps to render the inmate unconscious or “otherwise alleviate the painful effects” of the drugs.
“Any such intervention would clearly be medically unethical,” the doctors said in a written statement today. “As a result, we have withdrawn from participation in this current process.”
So, the 9th Circuit essentially ordered the physicians to kill Morales if they thought he regained consciousness and/or was suffering. The original order by federal judge Jeremy Fogel was inane and was biased towards delay. Fogel ordered:
1. Fogel said state authorities can postpone the execution that’s set for next Tuesday and defend their current procedure in a two-day court hearing, starting May 2.
2. The State of California can substitute a barbiturate or combination of barbiturates for the three-drug series they currently plan on using.
3. The State of California can station an experienced anesthesiologist in the execution chamber to verify that Morales is unconscious when he’s supposed to be.
Now, San Quentin State Prison’s warden rescheduled the execution for tonight at 7:30 PM using option 2 as ordered.
Prison officials planned to press forward with the execution Tuesday night using the second option.
The judge approved that decision later Tuesday, but said the sedative must be administered by a person who is licensed by the state to inject medications intravenously, a group that includes doctors, nurses and other medical technicians.
Morales’ lawyers planned to appeal to the 9th U.S. Circuit Court of Appeals. They also asked the California Supreme Court to block the execution.
The state’s conduct “is offensive to a decent respect for human dignity and repugnant to the conscience of mankind,” attorney David Senior Wrote.
State officials said they were unsure whether they would proceed.
Nathan Barankin, a spokesman for Attorney General Bill Lockyer, said prosecutors and prison officials were meeting to determine whether to go forward with the execution and “to consider other options.”
Flap is waiting to report any rulings from the 9th Circuit or California Supreme Court.

Supreme Court Justice Antonin Scalia grew tired of a persistent heckler Tuesday and asked organizers of a legal seminar to do something about the outbursts _ gently.
“Don’t use force,” Scalia told American Enterprise Institute workers as they grabbed the young man’s arm and nudged him toward the door. The workers then let go and the man walked out.
It was unclear what Aaron Yule, 23, of Boston, was asking when Scalia turned to organizers and said, “Can you, somebody …”
Earlier, a microphone had been snatched from the man’s hand when he tried to engage the justice in debate. Scalia had asked him whether he had a question, “apart from insults.”

The young questioners were by and large ignorant of the subject and rude – much like the comments section at the Huffington Post or the Daily Kos.
Justice Scalia was obviously annoyed with the lack of preparation, intelligence and tone of the questioners. For the most part an opportunity to question the Justice on the role of international law on the American courts was lost.
Will the Justice allow himself to be questioned again?
Probably……but let’s hope C-Span and the American Enterprise Institute screen a better audience.

The questioner (a Google search shows that he’s a member of LaRouche Youth) continued to interrupt proceedings, and was eventually removed. There continued to be a mix of intelligent questions (Tom Goldstein and Michael Greve engaged the justice) and provocateurs wanting to make a splash on C-SPAN. Scalia answered questions about his speech, and passed on other questions, but, as if a glutton for punishment (or at least confrontation), he continued to select scruffy leftists/LaRouche Youth who raised their hands (including a German woman who went on a rant about Leibniz), though it would have been easy to bypass them.

WTOL News: Toledo-Area Men Arrested for Terrorist Activity
A federal grand jury has indicted three Toledo-area men for terrorist activities. Prosecutors say the three conspired to wage a “holy war” against the United States and coalition forces in the middle east. The indictment was unsealed Monday.
The U.S. Attorney General Alberto Gonzalez is expected to release more details at a news conference this afternoon in Washington D.C.
Fox News television is reporting that Attorney General Gonzales will have a news conference at 1:30 PM EST.
According to the indictment from the US Attorney’s office, the suspects are Mohammad Zaki Amawi, Marwan Othman El-Hindi, and Wassim Mazloum. The indictment says all three were living in the Toledo area. Amawi is a citizen of the US and also a citizen of Jordan. El-Hindi is a naturalized American citizen who was born in Jordan. Mazloum is a legal permanent resident of the US, who came here from Lebanon.
The indictment also names an unindicted co-conspiratory called “The Trainer,” who has U.S. military backround in security, and bodyguard training.
The counts of the indictment:
Count 1: The three met together many times, going back as far as November 2005. The three reportedly conspired to recruit and train others for a violent jihad against United States forces and US allies in Iraq. They also reportedly put together the funding needed for the operation, and collected the equipment needed, and even travelled together to a local indoor shooting range for target practice.
Count 2: The grand jury found that the three had similar plans to kill US citizens abroad in addition to service members.Count 3:Mohammad Zaki Amawi – Amawi distributed information on bomb-making, which in itself is a federal crime.
Count 4:Mohammad Zaki Amawi – He verbally threatened President George W. Bush.
Count 3 and 4 crimes are separate from the conspiracy.
The indictment was filed with Judge James Carr in Federal Court in Toledo. The Justice Department says Amawi is being held at a jail in Cleveland, and will be arraigned in Cleveland some time this afternoon. El-Hindi and Mazloum are being held in a jail in Toledo. They are expected in Toledo’s Federal Court this afternoon.

ASSociated Press: Protesters Rally in Pakistan, Iraq
About 2,000 people chanted “Death to America” and “Death to Denmark” as they rallied in a small town near the Afghan border to protest the Prophet Muhammad cartoons that have sparked violent demonstrations in Muslim countries.
The protesters in Barwand also burned flags of Denmark _ where the caricatures were first printed _ and torched effigies of the Danish prime minister and President Bush.
In Iraq:
About 10,000 people also protested against the cartoons in the southern Iraqi city of Karbala, burning Danish flags and demanding Iraq sever ties with Denmark.

Shopkeepers shut their doors in a bustling city near Pakistan’s capital to protest the cartoons that have sparked a string of violent demonstrations across the country in the past week.
Pakistani Prime Minister Shaukat Aziz said Tuesday the cartoons were an attempt to cause a “clash of civilization” by people who are ignorant about Islam and want to demonize the religion.
“We cannot condone such insensitivities toward our beliefs and condemn it in the strongest way,” he said at an Islamic conference. “Islam does not believe in the clash of civilization, rather it advocates harmony, coexistence, peace and compassion.”
Just outside Pakistan’s capital in Rawalpindi, about five major markets were closed Tuesday as shopkeepers protested the cartoons.
Mushtaq Ali Shah, senior vice president of Rawalpindi Chamber of Commerce and Industry, which helped organize the strike, said a rally wasn’t being held because the businesses didn’t want the protest to turn into a riot that damages property.
Probably a smart move about the rally……but why destroy your own people’s property?

Reuters: Iran spurns Russian demand for enrichment freeze
Iran showed few signs on Tuesday that it was ready to strike a deal with Russia that could allay fears it wants nuclear arms and avert possible U.N. sanctions.
A senior U.S. official said Russia’s role was helpful but Iran was ignoring international advice on the nuclear issue.
“We think Iran is clearly continuing to miscalculate the will of the world community,” U.S. Undersecretary of State for Political Affairs, Nicholas Burns, told reporters in Moscow.
After two days of talks in Moscow, Russian and Iranian negotiators said they planned more discussions this week on a Russian proposal to enrich uranium for Iran, seen as a way to ensure Tehran cannot divert nuclear fuel into bomb-making.
But the two sides appeared far apart, with Iran’s foreign minister ruling out any return to a moratorium on uranium enrichment, which Russia has repeatedly demanded.
What a surprise but there will be more bloviating and stall later in the week when Sergei Kiriyenko, head of Russia’s atomic energy agency Rosatom, is due to travel to Iran.

Three men were charged in Ohio with conspiracy to kill people and planning attacks against U.S. forces overseas, a federal law enforcement official said on Tuesday.
WTOL News: Toledo-Area Men Arrested for Terrorist Activity
A federal grand jury has indicted three Toledo-area men for terrorist activities. Prosecutors say the three conspired to wage a “holy war” against the United States and coalition forces in the middle east. The indictment was unsealed Monday.
The U.S. Attorney General Alberto Gonzalez is expected to release more details at a news conference this afternoon in Washington D.C.
Fox News television is reporting that Attorney General Gonzales will have a news conference at 1:30 PM EST.
According to the indictment from the US Attorney’s office, the suspects are Mohammad Zaki Amawi, Marwan Othman El-Hindi, and Wassim Mazloum. The indictment says all three were living in the Toledo area. Amawi is a citizen of the US and also a citizen of Jordan. El-Hindi is a naturalized American citizen who was born in Jordan. Mazloum is a legal permanent resident of the US, who came here from Lebanon.
The indictment also names an unindicted co-conspiratory called “The Trainer,” who has U.S. military backround in security, and bodyguard training.
The counts of the indictment:
Count 1: The three met together many times, going back as far as November 2005. The three reportedly conspired to recruit and train others for a violent jihad against United States forces and US allies in Iraq. They also reportedly put together the funding needed for the operation, and collected the equipment needed, and even travelled together to a local indoor shooting range for target practice.
Count 2: The grand jury found that the three had similar plans to kill US citizens abroad in addition to service members.Count 3:Mohammad Zaki Amawi – Amawi distributed information on bomb-making, which in itself is a federal crime.
Count 4:Mohammad Zaki Amawi – He verbally threatened President George W. Bush.
Count 3 and 4 crimes are separate from the conspiracy.
The indictment was filed with Judge James Carr in Federal Court in Toledo. The Justice Department says Amawi is being held at a jail in Cleveland, and will be arraigned in Cleveland some time this afternoon. El-Hindi and Mazloum are being held in a jail in Toledo. They are expected in Toledo’s Federal Court this afternoon.

Muhammad Caricature Watch: Christian Anti-Muslim Riot in Nigeria Turns Deadly

Christian mobs rampaged through a southern Nigerian city Tuesday, burning mosques and killing several people in an outbreak of anti-Muslim violence that followed deadly protests against caricatures of the Prophet Muhammad over the weekend.
Residents and witnesses in the southern, predominantly Christian city of Onitsha said several Muslims with origins in the north were beaten to death by mobs which also burned two mosques there.
“The mosque at the main market has been burnt and I’ve counted at least six dead bodies on the streets,” Izzy Uzor, an Onitsha resident and businessman, told The Associated Press by telephone. “The whole town is in a frenzy and people are running in all directions.”
The violence appeared to be in reprisal for anti-Christian violence Saturday in the mostly Muslim northern city of Maiduguri in which thousands of Muslims protesting caricatures of the Prophet Muhammad attacked Christians and burned churches, killing at least 18 people.

The violence has to STOP.
But, did the fanatical Muslim organizers of the Muhammad Caricature protests really think that the WEST was ONLY going to take it ?
