The Univesrity of California, Irvine is starting a new law school. Given its location and the resources available to it, it could have quickly entered the first ranks of American law schools. It had selected my friend and regular radio guest Duke University Law School Professor Erwin Chemerinsky as the school’s new dean. Erwin is a man of the left, of course, but a remarkably distinguished and accomplished scholar who enjoys the esteem of professors, jurists and practioners across the ideological spectrum.

UCI, for reasons not yet fully disclosed, has now dumped Erwin. Brian Leiter has the details, as does The Los Angeles Times.

This is an astonishing and disgraceful episode, which, if perpetrated against a conservative, would rightly lead to a massive outpouring of outrage directed at the university that had allowed such a purge to occur. I will be astonished if any reputable scholar agrees to take the job over Erwin’s broken contract, and many professors who would otherwise have welcomed the chance to join the UC system will be wondering about the Administration of such a place, even if they find someone to agree to be dean.

Instapundit has some great links, including to John Leo’s statement that the treatment of Chemerinsky is “a test case for conservatives who support free speech and argue vehemently against political tests for faculty and administration appointments.”

Noted constitutional law scholar Erwin Chemerinsky and Catherine Fisk, a top labor law professor, will join the Duke Law School faculty, effective July 1, 2004.

Equally disgraceful is the treatment that a presumed appointment of Theodore Olson as United States Attorney General is receiving at the hands of Senate Democrats, indirectly by Eunuch GOP Senators and the Senate Majority Leader, Harry Reid.

Republican Sen. Orrin Hatch of Utah, a former Judiciary Committee chairman, said he talked with about 10 Democrats about Olson and that some made noises, if not outright threats, about blocking his nomination.

“I have been warned by a number of Democrats that they’re not going to let that happen,” Hatch said of an Olson confirmation. If the White House thinks Olson would sail through the Senate, Hatch said, “then they don’t understand the people up here.”

Democrats, including current Judiciary Committee Chairman Patrick Leahy, indicated they would mount strong challenges to Olson if Bush nominates him. “He is certainly not a consensus nominee,” said Sen. Chuck Schumer, D-N.Y. “He has a very political background.”

Conservatives brushed off the Democrats’ warnings, and Hatch and Sessions predicted Olson would survive the confirmation process, however rocky.

Are the left and right both being hypocritical about political litmus tests for outstanding candidates for legal positions?

Or is this the true nature of the partisan adversarial system that is American law and politics?

Disgraceful, no matter which.

Rudy Giuliani goes on the attack:

One day after Sen. Hillary Clinton, D-N.Y., sharply questioned the top U.S. commander in Iraq, Rudy Giuliani blasted his Democratic presidential rival, accusing her of spewing “political venom” in the Iraq war debate.

“I don’t know what she’s trying to say when she’s accusing a general of the ‘willing suspension of disbelief,’” Giuliani said Wednesday on the “Randy and Spiff” show, a radio program which airs in Atlanta. The former New York mayor repeated his criticism of the Democratic frontrunner for president later in the day Wednesday during a media availability in Akron, Ohio.

MAYOR GIULIANI: “[General Petraeus] and our military have had more success than the Democrats ever expected and now what they’re resorting to is really very disturbing. You have this MoveOn.org organization, this Democratic organization that has spent hundreds of millions of dollars trying to malign the President and Republicans. Now they’re maligning General Petraeus with this ad that they’ve put money into, about General Petraeus and taking his name and saying General Betray Us.

“And instead of the Democrats standing up and saying that this is just wrong, it’s wrong to impugn the integrity of an American Commander in a time of war who is putting his life at risk for this country, we have the Democrats, in essence, creating their own questions. I’ll read to you what Hillary Clinton said yesterday. She said, ‘I think the reports that you provide to us,’ speaking to General Petraeus, ‘really require the willing suspension of disbelief.’ Now I don’t know exactly what Hillary Rodham Clinton meant by the willing suspension of disbelief on behalf of an American General. But I tend to think the American people kind of think politicians do that more than generals—the willing suspension of disbelief.

“And I really think we have a right to expect of our presidential candidates, even if they have this great desire to be President, more statesmanship than accusing American generals of the willing suspension of disbelief, just because they come to a conclusion that maybe you thought wasn’t possible. I know there are Democrats in the House that say, you know, the surge being successful would be a problem for the Democratic Party. Well, that’s one thing and I think that’s wrong. And I think what MoveOn.org did was wrong. But I think what Hillary Clinton did here, accusing General Petraeus of a willing suspension of disbelief when–you can disagree with General Petraeus but you can do it without this kind of name calling …”

Well, somebody had to say it. Hillary and the Democrats have called General Petraeus a LIAR and Rudy is calling them OUT.

Germany — a pivotal player among three European nations to rein in Iran’s nuclear program over the last two-and-a-half years through a mixture of diplomacy and sanctions supported by the United States — notified its allies last week that the government of Chancellor Angela Merkel refuses to support the imposition of any further sanctions against Iran that could be imposed by the U.N. Security Council.

The announcement was made at a meeting in Berlin that brought German officials together with Iran desk officers from the five member states of the Security Council. It stunned the room, according to one of several Bush administration and foreign government sources who spoke to FOX News, and left most Bush administration principals concluding that sanctions are dead.

Clue one to Condi Rice and the rest of the Bush administration: U.N. sanctions have always been dead. Simply, Iran does not want to dance.

President Bush has two choices. Either he militarily intervenes and destroys Iran’s military and nuclear program or rolls over and allows Iran to have nuclear weapons.

Time to choose, Mr. President. And, choose wisely.

Norman Hsu, a convicted felon fugitive (now in custody in Colorado) and Democrat Fundraiser for Hillary Clinton and Senator Hillary Clinton

Remember Flap asked the question whether Senator Hillary Clinton will return the “SUSPECT” contributions from Democrat “BUNDLER” Norman Hsu.

Reportedly Hillary and her campaign will return the contributions – all $850,000 of them.

But, wait.

The New York Times reports that the Clinton campaign is returning the $850,000 Norman Hsu raised, “viewing the money as tainted. Yet the campaign is also risking another public relations mess by saying that it would take back the money if it clearly came from the donor’s bank account, not from Mr. Hsu or another source. The risk is that Mrs. Clinton will appear to want more cash no matter whether it was once colored by a disgraced donor.”

“The campaign will try to get most of the donors to give the money back right after the refunds, said a senior Democratic strategist who advises Mrs. Clinton’s campaign. ‘That’s the plan,’ the strategist said.”

NOBODY believes that Hillary and her campaign staff were simply mistaken in receiving Hsu’s “TAINTED” money. Meanwhile, The New York Daily News reveals that “FBI agents are collecting e-mail evidence in the widening [Hsu] scandal.”

Fred Thompson has it RIGHT when he asks the question: Didn’t you learn anything from Charlie Trie?

Thompson adviser Rich Galen said Clinton’s 2008 campaign has become “the sequel” to her husband’s scandal-plagued 1996 campaign.

“You have to look at this with a great deal of skepticism that – having been through this sort of thing in ’96 – that nobody thought to say, ‘Hey, you know, we better take another look at this before we take all this money,’ ” he said.

“And the fact that nobody did – or if they did, they decided to just put their finger in front of their lips and say shhh and try to sneak off into the distance – tells you a great deal about the fact that the Hillary Clinton campaign is the Bill Clinton campaign redux.”

Clinton is returning donations to 260 people who were recruited by Hsu. The FBI is investigating whether these were merely “straw” donors who were funneling money from Hsu to Clinton to skirt campaign finance laws.

In March 1996, Bill and Hillary Clinton’s legal defense fund accepted money from straw donors recruited by Yah Lin “Charlie” Trie. The Taiwan-born Democrat hand-delivered hundreds of thousands of dollars’ worth of checks and money orders in two manila envelopes to the defense fund.

Update:

The Wall Street Journal has tracked down the probable source of Norman Hsu’s money.

That has been one of the big questions hanging over the prominent Democratic fund-raiser, as reports have surfaced about hundreds of thousands of dollars he made in political donations, plus lavish parties, fancy apartments and a $2 million bond he posted to get out of jail earlier this month.

New documents reviewed by The Wall Street Journal may help point to an answer: A company controlled by Mr. Hsu recently received $40 million from a Madison Avenue investment fund run by Joel Rosenman, who was one of the creators of the Woodstock rock festival in 1969. That money, Mr. Rosenman told investors this week, is missing.
