    Recalling the California Supreme Court Over Proposition 8

    Power Line makes the obvious observation as to the consequences of the California Supreme Court overruling a vote of the people on California Propsition 8 that restored the traditional definition of marriage (one man and one woman).

    The votes by which the people of California passed Proposition 8, restricting the definition of marriage to a union between a man and a woman, had barely been counted when the ACLU filed a lawsuit. That suit, filed directly with the California Supreme Court, claimed that Prop. 8 would change the California Constitution in so fundamental a way — i.e., taking important rights away from a minority group — that it amounts to a constitutional revision. As such, the theory goes, the legislature was required to pass it before submitting the matter to the voters.

    This kind of argument seems like meat and drink for California’s liberal Supreme Court. But my friend Craig Harrison tells me that if that court once again tells the voters “to go to hell,” he expects recall petitions to be circulated for the judges in question. This is permitted under the California Constitution if signatures can be obtained from 20% of the number of people who voted in the last election. Given the 2008 turnout, it might make sense to submit the petition following the primaries that will occur next year.

    The petition would not just pertain to the merits of Prop 8, but also to the fact that the state’s judges will have thumbed their noses at the popular will. Perhaps those judges will consider this risk when they take up the matter.

    Paul and John don’t quite have the timing correct as ANY election would be in June 2010 and there are no primary elections scheduled next year in California.

    However, Flap does not think the California Supreme Court will throw out the California voters’ wishes. We received an indication of this the other day by Justice Kennard’s actions.

    There is no sense in talking about a recall election of the court unless they go off the deep end again.

    But, recalled all they would be in 2010.

    Bush Derangement Syndrome – Time for Him to Go

    Damn, this lefty New York Times MORON cannot wait for President Bush to leave the Presidency.

    Thanksgiving is next week, and President Bush could make it a really special holiday by resigning.

    Seriously. We have an economy that’s crashing and a vacuum at the top. Bush — who is currently on a trip to Peru to meet with Asian leaders who no longer care what he thinks — hasn’t got the clout, or possibly even the energy, to do anything useful. His most recent contribution to resolving the fiscal crisis was lecturing representatives of the world’s most important economies on the glories of free-market capitalism.

    Putting Barack Obama in charge immediately isn’t impossible. Dick Cheney, obviously, would have to quit as well as Bush. In fact, just to be on the safe side, the vice president ought to turn in his resignation first. (We’re desperate, but not crazy.) Then House Speaker Nancy Pelosi would become president until Jan. 20. Obviously, she’d defer to her party’s incoming chief executive, and Barack Obama could begin governing.

    Talk about Bush Derangement Syndrome.

    Exit question: How long will the plunkers at the New York Times continue to bash Bush when he is out of office?

    Tony Strickland Continues to Lead in California State Senate Race

    Former California Assembly Members Tony Strickland and Hannah-Beth Jackson candidates for California State Senate District 19

    Santa Barbara County and Los Angeles County Elections updated their vote totals yesterday whereas Ventura County did not for the California State Senate District 19 race.

    According to Flap’s math Republican Tony Strickland lead has shrunken to 1,328 votes versus 2,211 votes this past Tuesday.

    The raw figures:

    Santa Barbara County:

    • Hannah-Beth Jackson: 72,693
    • Tony Strickland: 58,166

    Los Angeles County:

    • Hannah-Beth Jackson: 12,083
    • Tony Strickland: 16,493

    Ventura County:

    • Hannah-Beth Jackson: 115,477
    • Tony Strickland: 126,922

    Timm Herdt of the Ventura County Star:

    Although Jackson has closed the gap, nearly all the ballots in her home county, Democratic-leaning Santa Barbara County, have now been tallied. Strickland will hold on to win unless the approximately 14,000 provisional ballots yet to be counted in Ventura County have a strong Democratic tilt.

    Elections officials in Ventura County began processing provisional ballots this week but are not expected to release the first results from those ballots until Monday.

    In votes tallied thus far, Strickland has about a 5 percentage lead in the Ventura County portion of the district. Jackson would have to at least reverse that advantage among provisional ballots — perhaps unlikely, but something political observers say is possible given that many such ballots are cast by newly registered voters, who this year were predominantly Democrats.

    Hannah-Beth Jackson may have reached her high point in this race, much like Charlie Brown did against Tom McClintock in CA-4 before GOP leaning counties put him over the top. Her campaign continues to exude hope but it is an uphill climb for her.

    The nation awaits “The One” and whether after January 20th he has the RIGHT stuff to deliver more than a good teleprompter speech.

      Members of the 2008 Republican field each sought to establish himself as the "true conservative" candidate in an attempt to appeal to the vast majority of the party's voters. For the 2012 campaign, Palin would seem to have a slight edge over the rest of the possible candidates in establishing an early foothold among the party's base.

      Seventy-three percent of Republicans who describe their political views as "conservative" would like to see Palin run in 2012, significantly more than any other candidate. Liberal and moderate Republicans, in turn, are somewhat cool to a 2012 Palin bid. This group tends to favor Romney over any of the other potential candidates.

    • eHarmony founder Neil Clark Warren says the company has declined to serve the gay market because the compatibility research on which it relies to match people was done with heterosexuals and may not be applicable to same-sex couples. But even if he decided to focus on heterosexuals because he disapproves of homosexuality, that should be his right in a free society. Potential customers excluded or offended by that choice then would have a right to go elsewhere, instead of forcibly imposing their preferences. Likewise, competitors would be free to take advantage of eHarmony's perceived shortcomings, as they've been trying to do. Speaking of competitors, wouldn't the principle that justifies forcing eHarmony to match gay singles also require gay dating services to match heterosexuals and Jewish dating services to match Christians?

    • In March 2005, a man named Eric McKinley filed a complaint against eHarmony and Dr. Neil Clark Warren with the State of New Jersey. The complaint alleged Discrimination against gays and lesbians.

      In November 2008, the case was settled and as a result, the complaint against eHarmony and Dr. Neil Clark Warren was dismissed.

      Here are the terms of the settlement (Company refers to eHarmony.com. Complainant refers to Eric McKinley who filed the complaint):

    • A California Superior Court judge has certified a class action lawsuit against eHarmony.com for discrimination against gays and lesbians in California. The news comes one day after eHarmony settled a case in the State of New Jersey where a gay man accused the company of discrimination. In that settlement, eHarmony agreed to open up a service that matches gays and lesbians.

      That announcement had no affect in the California case, which is moving forward.

      “We are encouraged that after years of discrimination, eHarmony finally appears to be recognizing that it must open its services to everyone in the general public, regardless of sexual orientation," says Joshua Konecky of Schneider Wallace Cottrell Brayton Konecky, LLP, who is representing the plaintiffs. " However, words are not enough; the next step is to ensure that eHarmony’s commitment is effectively implemented and enforceable by the Court.”

    • Officials with President-elect Barack Obama’s transition team this week named at least seven openly gay people to transition panels assigned to review federal departments and agencies.

      Three of the seven gays named to the transition panels — businessman Fred P. Hochberg, former San Francisco Supervisor Roberta Achtenberg, and labor attorney Elaine Kaplan — held high-level positions in the Clinton administration.

    • Barack Obama borrowed more from the immigrant labor movement than just a slogan.

      Just as Latinos historically had marched for worker rights to the chants of "Yes, we can," ("Si, se puede"), they organized and stumped by the thousands this year to help elect Obama.

      Although they initially leaned more toward Hillary Rodham Clinton, Latinos gave Obama 67 percent of their votes nationwide, increasing their turnout, delivering several key states and gaining clout in the Democratic Party.

      They say they earned a seat at Obama's table and plan to remind him that he promised to revive and enact a proposal many favor: a comprehensive immigration overhaul, including a legalization program.

    • Reporting from Sacramento — State lawmakers began moving toward a deal this week to close California's deficit with the help of steeper car fees that would cost many drivers hundreds of dollars annually, according to people involved in budget talks.

      Under the plan, GOP lawmakers — most of whom have signed anti-tax pledges — would vote to triple the vehicle license fee that owners pay when they register their cars every year in exchange for a ballot measure that would impose rigid limits on future state spending. Motorists' annual license fees would rise from 0.65% of the value of their vehicles to 2%. For a car or truck valued at $25,000, the increase would be $336.

    • President-Elect Barack Obama‘s transition team is exploring a swift, prepackaged bankruptcy for automakers as a possible solution to the industry’s financial crisis, according to a person familiar with the matter.

      Obama’s team has already contacted at least one bankruptcy- law firm to say that Daniel Tarullo, a professor at Georgetown University’s law school who heads Obama’s economic policy working group, would call to discuss the workings of a so-called prepack, according to this person.

    • President-elect Barack Obama will not move for months, and perhaps not until 2010, to ask Congress to end the military's decades-old ban on open homosexuals in the ranks, two people who have advised the Obama transition team on this issue say.

      Repealing the ban was an Obama campaign promise. However, Mr. Obama first wants to confer with the Joint Chiefs of Staff and his new political appointees at the Pentagon to reach a consensus and then present legislation to Congress, the advisers said.
