A federal judge in Virginia has declared the Obama administration’s health care reform law unconstitutional.
U.S. District Judge Henry Hudson is the first judge to rule against the law, which has been upheld by two others in Virginia and Michigan.
Virginia Attorney General Ken Cuccinelli filed the lawsuit challenging the law’s requirement that citizens buy health insurance or pay a penalty starting in 2014.
He argues the federal government doesn’t have the constitutional authority to impose the requirement.
Other lawsuits are pending, including one filed by 20 states in a Florida court. Virginia is not part of that lawsuit.
I doubt the issue will be resolved by the U.S. Supreme Court. Why?
The issue will be resolved in the new GOP Congress and the next President before ObamaCare EVER becomes fully implemented. Some reforms may remain but the main thrust towards “Socialized Medicine” is not playing well with American voters.
Update:
Here is the full text of the federal court opinion:
The Washington Post pronounced it “shelved” over the weekend.
Not so fast.
Via the Hill, the open-borders lobby is claiming momentum:
When House Democrats last week passed the DREAM Act before the Senate had staged its vote, the timing was no accident.
Instead, the chronology was part of a carefully designed strategy — orchestrated, with some tension, between the two chambers — to grant the proposal its greatest shot at success. The fast-evolving process required behind-the-scenes scheduling changes; an eleventh-hour hearing; constant lobbying from supporters; and a risky-but-successful show of procedural gymnastics in the Senate — all aimed at lending momentum to the hot-button bill in hopes of enacting it by month’s end.
In short, supporters say, the process has infused life into the policy.
“It actually gives us a chance to win,” said Frank Sharry, executive director of America’s Voice, an advocacy group lobbying for the bill.
So, melt the phones to on the fence Republicans:
Here is the list:
SEN. JOHN MCCAIN 202-224-2235; 480-897-6289
SEN. OLYMPIA SNOWE 202-224-5344; 207-874-0883
SEN. LISA MURKOWSKI 202-224-6665; 907-271-3735
SEN. SUSAN COLLINS 202-224-2523; 207-945-0417
SEN. SAM BROWNBACK 202-224-6521; 785-233-2503
SEN. KAY BAILEY HUTCHISON 202-224-5922; 214-361-3500
SEN. SCOTT BROWN 202-224-4543
At least four GOP Senators will have to cross over and join ALL of the Democrats to vote cloture. However, a number of Democrats have indicated they will not vote for the bill, including Jon Tester of Montana and Ben Nelson of Nebraska – both running for re-election in red states in 2012.
Hence, a good chance this bill will be filibustered to its death in this session of the Congress.
The Associated Press transmitted a photo from Haiti of Palin captioned, “Former Alaska Gov. Sarah Palin, center, has her hair done during a visit to a cholera treatment center set up by the NGO Samaritan’s Purse in Cabaret, Haiti, Saturday Dec. 11, 2010. Palin arrived Saturday in Haiti as part of a brief humanitarian mission. Dieu Nalio Chery / AP”
That photo and caption set off rabid attacks on Palin from the Huffington Post, the U.K.’s Daily Mail and, of course, Palingates.
The photo does indeed show Sarah Palin standing with her husband Todd as a woman whose face is obscured uses two hands to fix the hair on the right side of Palin’s head.
However, one can observe that the woman is white, with her brown hair pulled back in a ponytail, wearing a white shirt with a bulky scarf and dark pants.
In other photos from Saturday, Todd and Sarah Palin’s white, brunette, eldest daughter Bristol, who accompanied her parents on the trip to Haiti, is wearing the exact same clothing and ponytail as the “hair stylist” in the AP photo.
That’s right, what the Palin-hating AP and others fail to report is that the “hair stylist” is Bristol Palin.
The AP photographer who sent the caption would have known that it was Bristol Palin, but by not mentioning her the AP was able to do a media hit on Palin but still be able to claim they told the “truth” with the caption.
Yes, Zed, we understand your deployment in Afghanistan is not for anyone President or politician, but for the American people. Military deployments are difficult for families and lives are “at risk.”
Sometimes, even at Christmas time, Americans forget.
The advent of the internet and informtion technology has the MSM LameStream Media losing its influence over American discourse. Likewise, the Saul Alinsky LEFT with their secretive foundations and donors have been exposed as well.
The fresh air of information has healed America – just like air to a putrid wound. The United States Constitution is the bandage the binds us all.
Is there any wonder why the LEFT is peeved and seething?
Indiana Democratic Sen. Evan Bayh has decided against a run for governor in 2012, robbing Democrats of their top recruit in the Hoosier State.
"After careful consideration, I have concluded that the appropriate decision is not to be a candidate for governor of Indiana in 2012," Bayh said in a statement released to the Fix. ""The principle reason for my decision is the welfare of my twin sons."
Bayh's decision leaves the Democratic field wide open. Reps. Brad Ellsworth and Baron Hill, both of whom lost races this fall, are likely to consider the Bayh-less contest. Others mentioned include Rep. Joe Donnelly, Evansville Mayor Jonathan Weinzapfel and former state House Speaker John Gregg.
The Republican field remains uncertain. Some believe that Rep. Mike Pence will be the GOP candidate although the House member seems to be far more interested in a run for president in 2012. If Pence doesn't run, Lt. Gov. Becky Skillman is a likely candidate.
Over the past 24 hours, we’ve spoken with a number of in-the-know individuals who have all but confirmed that the Reid BillTM is all but dead.
Chances of online poker regulation getting pushed through the lame duck is basically a two-outer on the river now. Even the most optimistic estimate we’ve heard was only “around 20%.”
Not good. Although to paraphrase Lloyd Christmas, “So you’re saying there IS a chance?!”
Some believe next Tuesday is truly the line-in-the-sand day, and that it can still be attached to the tax bill in some form. Others believe that recent public messaging from Senator Reid and the AGA (welcome to the party!) shows there’s movement in the right direction and that it’s still a top agenda item during the last week of the lame duck.

I think the greed of Harrah's and MGM drove the argument and any chance of passage as an attachment.
Mark Levin said tonight on his show that when Sarah Palin was asked by Barbara Walters what she reads, among the others she mentioned was that she reads Liberty and Tyranny, Mark Levin’s book. According to Mark, they edited that out:
The Senate poker legislation was written with help from major gambling and casino interests, who played a significant role in funding Reid's expensive reelection campaign, according to lobbyists and legislative aides. Reid has collected more than $1.6 million in contributions from gaming companies and their employees over the past two decades, according to the Center for Responsive Politics.
Two major Las Vegas casino companies, Caesars Entertainment and MGM Resorts International, also gave a combined $375,000 to an outside Democratic group, Patriot Majority, that ran election ads in favor of Reid this fall, records show.
Reid and his supporters say the bill is a common-sense and limited solution to the problem of unregulated online poker, which is played by an estimated 10 million Americans.

I doubt this legislation will be able to be attached to ANY existing bill without a GOP demand for it to be removed or a filibuster.
