    WASH POST, July 15, 1994: Extend not only to searches of the homes of U.S. citizens but also — in the delicate words of a Justice Department official — to “places where you wouldn’t find or would be unlikely to find information involving a U.S. citizen… would allow the government to use classified electronic surveillance techniques, such as infrared sensors to observe people inside their homes, without a court order.”

    Deputy Attorney General Jamie S. Gorelick, the Clinton administration believes the president “has inherent authority to conduct warrantless searches for foreign intelligence purposes.”

    Secret searches and wiretaps of Aldrich Ames’s office and home in June and October 1993, both without a federal warrant.

          By the authority vested in me as President by the Constitution
    and the laws of the United States, including sections 302 and 303 of the
    Foreign Intelligence Surveillance Act of 1978 ("Act") (50 U.S.C.  1801,
    et seq.), as amended by Public Law 103- 359, and in order to provide for
    the authorization of physical searches for foreign intelligence purposes
    as set forth in the Act, it is hereby ordered as follows:
    
          Section 1.  Pursuant to section 302(a)(1) of the Act, the
    Attorney General is authorized to approve physical searches, without a
    court order, to acquire foreign intelligence information for periods of
    up to one year, if the Attorney General makes the certifications
    required by that section.
    
          Sec. 2.  Pursuant to section 302(b) of the Act, the Attorney
    General is authorized to approve applications to the Foreign
    Intelligence Surveillance Court under section 303 of the Act to obtain
    orders for physical searches for the purpose of collecting foreign
    intelligence information.
    
          Sec. 3.  Pursuant to section 303(a)(7) of the Act, the following
    officials, each of whom is employed in the area of national security or
    defense, is designated to make the certifications required by section
    303(a)(7) of the Act in support of applications to conduct physical
    searches:
    
          (a) Secretary of State;
    
          (b) Secretary of Defense;
    
          (c) Director of Central Intelligence;
    
          (d) Director of the Federal Bureau of
     Investigation;
    
          (e) Deputy Secretary of State;
    
          (f) Deputy Secretary of Defense; and
    
          (g) Deputy Director of Central Intelligence.
    
          None of the above officials, nor anyone officially acting in that
    capacity, may exercise the authority to make the above certifications,
    unless that official has been appointed by the President, by and with

      104 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
      1802 and 1804), in order to provide as set forth in that Act (this
      chapter) for the authorization of electronic surveillance for
      foreign intelligence purposes, it is hereby ordered as follows:
    
        1-101. Pursuant to Section 102(a)(1) of the Foreign Intelligence
      Surveillance Act of 1978 (50 U.S.C. 1802(a)), the Attorney General
      is authorized to approve electronic surveillance to acquire foreign
      intelligence information without a court order, but only if the
      Attorney General makes the certifications required by that Section.
    
        1-102. Pursuant to Section 102(b) of the Foreign Intelligence Act
      of 1978 (50 U.S.C. 1802(b)), the Attorney General is authorized to
      approve applications to the court having jurisdiction under Section
      103 of that Act (50 U.S.C. 1803) to obtain orders for electronic
      surveillance for the purpose of obtaining foreign intelligence

        1-103. Pursuant to Section 104(a)(7) of the Foreign Intelligence
      Surveillance Act of 1978 (50 U.S.C. 1804(a)(7)), the following
      officials, each of whom is employed in the area of national

      required by Section 104(a)(7) of the Act in support of applications
      to conduct electronic surveillance:

        1-104. Section 2-202 of Executive Order No. 12036 (set out under

      in the Foreign Intelligence Surveillance Act of 1978, shall be
      conducted in accordance with that Act as well as this Order.''.
    
        1-105. Section 2-203 of Executive Order No. 12036 (set out under
      section 401 of this title) is amended by inserting the following at
      the end of that section: ''Any monitoring which constitutes
      electronic surveillance as defined in the Foreign Intelligence
      Surveillance Act of 1978 shall be conducted in accordance with that
      Act as well as this Order.''.

    Reuters has Senators seek spying probe

    Democratic and Republican calls mounted on Tuesday for U.S. congressional hearings into President George W. Bush’s assertion that he can order warrantless spying on Americans with suspected terrorist ties.

    Vice President Dick Cheney predicted a backlash against critics of the administration’s anti-terrorism policies. He also dismissed charges that Bush overstepped his constitutional bounds when he implemented the recently disclosed eavesdropping shortly after the September 11 attacks.

    Republican Sens. Chuck Hagel of Nebraska and Olympia Snowe of Maine joined Democratic Sens. Carl Levin of Michigan, Dianne Feinstein of California and Ron Wyden of Oregon in calling for a joint investigation by the Senate Intelligence and Judiciary Committees into whether the government eavesdropped “without appropriate legal authority.”

    Senate Minority Leader Harry Reid, a Nevada Democrat, said he would prefer separate hearings by the Judiciary Committee, which has already promised one, and Intelligence Committee.

    Senate Majority Leader Bill Frist, a Tennessee Republican, was noncommittal, saying he first wanted to further explore the matter.

    Flap still does not believe there will be public Senate hearings so this announcement is nothing but BLUSTER. This is a classified project and the leaders of the Senate Intelligence Committee who have the “need to know” have already been briefed and have access to the SECRET details in secure facilities.

    If these Senators, particularly the Republican ones have a question of “appropriate legal authority” why do they not have their staffs draft and file a lawsuit enjoining the President.

    Flap would be very interested in how, ultimately, the United States Supreme Court fails to challenge the President’s Constitutional authority to protect America from foreign attacks and subversion.

    So, how about it, Senators?

    RICHMOND, CA – The memorial service for peacemaker Stanley Tookie Williams will take place Tuesday, December 20, 2005 at 12 noon. The service will take place at Bethel A.M.E. located at 7900 South Western Avenue in Los Angeles. The service will be open to the public, but seating is limited. Overflow viewing will take place outside of the church on jumbotron screens.

    Among the participants will be Reverend Jesse Jackson Sr., Bruce Gordon of the NAACP, the Honorable Minister Louis Farrakhan of the Nation of Islam, recording artist Snoop Dogg, human rights advocate Bianca Jagger, and Williams’ long time advocate and friend Barbara Becnel.

    Illegal Immigration Watch: Mexico Retaliates for Border Wall Plan

    The ASSociated Press has Mexico Retaliates for Border Wall Plan

    The Mexican government, angered by a U.S. proposal to extend a wall along the border to keep out migrants, has struck back with radio ads urging Mexican workers to denounce rights violations in the United States. Facing a growing tide of anti-immigrant sentiment north of the border, the Mexican government is also hiring an American public relations firm to improve its image.

    Mexican President Vicente Fox denounced the U.S. measures, passed by the House of Representatives on Friday, as “shameful” and his foreign secretary, Luis Ernesto Derbez, said Monday the wall was “stupid.”

    What is stupid is if the United States does nothing to enforce its own border security and immigration laws.

    Build the wall!

    Reuters has Schwarzenegger severs ties with Austrian hometown

    California Gov. Arnold Schwarzenegger cut his honorary ties to his hometown in Austria on Monday after officials in Graz criticized him for denying clemency to a death row inmate.

    Schwarzenegger demanded that Graz stop using his name on a sports stadium and in promotions and returned a “ring of honor” he had been awarded by city officials in 1999, saying politicians in his hometown appeared to have rejected him.

    A petition drive had been launched in Graz to have the town rename a stadium that has been named after Schwarzenegger because the Austrian-born governor allowed the execution of death-row inmate Stanley Tookie Williams this month.

    Williams, an ex-leader of the Crips gang who supporters said had redeemed himself by campaigning against gang violence, was executed by lethal injection on December 13 after Schwarzenegger and the courts rejected all of his appeals.

    The city council of Graz had been due to rename the local stadium on January 19, according to Schwarzenegger’s letter to Graz Mayor Siegfried Nagl.

    Flap thought the California Governor was more MATURE than this childish stunt. If they wanted to remove his name then so be it.

    Following is the text of Gov. Arnold Schwarzenegger’s letter to the mayor of his hometown. The governor wrote it in German; it was translated by a press aide.

    Dear Mister Mayor,

    As you know, I was always proud to hail from Graz and my pride in my hometown continues. To me, Graz will forever be the place that nurtured me in my youth.

    When I was asked in 1997 to give the former Stadium Liebenau my name, I agreed for several reasons. Firstly, I trained there as a young man. Secondly, I had hoped that my international name recognition as an athlete and actor would in turn possibly make Graz more famous and increase its tourism business. Thirdly, requests by close friends in Graz moved me to accept the honor. And fourth, I was naturally proud to be immortalized in this way by my hometown.

    I have now heard that the Graz City Council appears poised to decide to rename the stadium on January 19th, 2006. The reason for this action is apparently a decision I reached as Governor of California. I rejected the clemency plea of a rightfully condemned four-time murderer after thorough review and as a result, he was executed according to the laws of this state.

    In all likelihood, during my term as Governor I will have to make similar and equally difficult decisions. In order to spare the responsible politicians of the City of Graz further concern, I withdraw from them as of this day the right to use my name in association with the Liebenauer Stadium. You will receive related correspondence from my legal counsel shortly. I expect the lettering to be removed by the end of 2005, and in the future, the use of my name to advertise or promote the city of Graz in any way is no longer allowed.

    I have also learned that a proposal has been proffered to rescind from me the city’s ring of honor. It was a beautiful day in 1999 when I received the ring at City Hall and I assumed at the time that it would be a token of sincere friendship between my hometown and me. Since, however, the official Graz appears to no longer accept me as one of their own, this ring has lost its meaning and value to me. It is already in the mail.

    In conclusion, I would like to once more expressly emphasize that I will remain with all my heart a Grazer, a Steierer and an Austrian. I look forward to visiting Graz again as soon as time allows.
