Clarence Ray Allen Watch: California Supreme Court Refuses to Block January 17 Execution

In a two-sentence order signed by Chief Justice Ronald George, Allen’s request for a reprieve was ‘denied on the merits.’ An attorney for Allen said the 75-year-old condemned man, whose request for clemency to Gov. Arnold Schwarzenegger is pending, would ask the federal courts to stop the execution.

The state Supreme Court turned down an appeal today by condemned inmate Clarence Ray Allen, who argued that his scheduled execution next week would be cruel and unusual because of his advanced age and health problems.
The court’s unanimous decision, issued without comment, means that Allen, the state’s oldest Death Row inmate at 75, is running out of legal options to block his execution. Allen, who is legally blind and uses a wheelchair, ordered three murders from his prison cell in 1980.
Defense attorney Michael Satris said today that he would explore other issues related to Allen’s death sentence in the federal court system.
“I’m not being surprised or unsurprised by anything,” Satris said. “You never know.”
Allen’s request for clemency by Gov. Arnold Schwarzenegger is pending. The governor will not hold a clemency hearing for Allen, but will instead review written arguments before deciding whether to spare Allen’s life, his office says.
Schwarzenegger will NOT grant clemency.

AP: Alito Pleases GOP Senators, Not Democrats
Supreme Court nominee Samuel Alito picked his way carefully Tuesday through the issues of abortion and warrantless wiretapping, satisfying Senate Republicans at his confirmation hearings but provoking Democratic expressions of displeasure.
The Bill of Rights applies “in times of war and in times of national crisis,” the 55-year-old appeals court judge said, although he declined to specify whether President Bush acted properly in ordering wiretaps without warrants in selected cases as part of the war on terror.
Asked repeatedly about abortion, he assured the Senate Judiciary Committee he would first take previous rulings into account. At the same time, he stressed that precedent, including the landmark 1973 decision establishing a woman’s right to end her pregnancy, is not binding on the high court.
“I would approach the question with an open mind and I would listen to the arguments that were made,” said Alito, who wrote two decades ago that he did not believe the Constitution includes the right to an abortion.
No major gaffs and the Senate Democrats look like a group of mental midgets compared to Judge Alito.

Los Angeles Times: Schwarzenegger’s Budget Would Trigger Billions in New Spending
He wants to increase funding for education, transportation and healthcare. Analysts ask if the state will be able to afford the future costs.Gov. Arnold Schwarzenegger, a crusader for fiscal restraint since he was elected two years ago, will unveil a budget today that would trigger billions of dollars in new spending well into the future.
The governor plans to increase funding for education, healthcare and transportation programs. Much of it is spending that the state would continue to be responsible for in future years.
Schwarzenegger’s spending plan comes at the same time he is proposing — independent of his budget — to bring before voters $68 billion in new borrowing to improve the state’s roads, bridges, ports and levees over the next 10 years. Californians would need to begin paying for that by the end of next year.
It all comes as California’s $115.7-billion budget remains chronically imbalanced and as the state is expected to lose billions of dollars in federal aid over the next several years. Even without the governor’s new programs, the state was projected to spend more than it takes in through 2010.
The Governor’s plan is FLAWED and will NOT receive voter approval.
This is NO MORE than another TAX and SPEND political scheme designed to help his re-election candidacy.
Watch for a Republican Primary Challenge or Third Party candidacy to derail Schwarzenegger’s re-election hopes.

Iran Nuclear Watch: Iran Removes United Nations Seals on Nuclear Facilities

ASSociated Press: U.S., Other Nations Rebuke Iran Over Seals
Iran removed seals on its nuclear facilities Tuesday, ending a two-year freeze on work there despite warnings from the United States and other countries concerned about Tehran’s nuclear ambitions.
The United States rebuked Iran for the move, calling it a step toward creating the material for nuclear bombs. British Prime Minister
Tony Blair’s official spokesman said the international community was “running out of patience” with Tehran.Both countries, along with France and Germany, have called on Tehran to cease nuclear activities until an agreement has been reached on the scope of its nuclear program.
Foreign Secretary Jack Straw said Tehran was again in breach of resolutions passed by the U.N.’s nuclear watchdog and said steps to restart uranium enrichment could not be justified.
“We are profoundly concerned that Iran has decided to restart research and development activities related to uranium enrichment,” Straw said in a statement.
“There was no good reason why Iran should have taken this step if its intentions are truly peaceful and it wanted to resolve long standing international concerns,” he added.
Diplomacy has FAILED.
