    An Election Split: Obama Wins North Carolina – Hillary Wins Indiana?

    It looks like a split decision this evening with Barack Obama handily winning North Carolina and Hillary Clinton squeaking out a victory in Indiana (although Fox News is waiting for results from Lake County before calling the election for her).

    So, what does this mean?

    Obama has won the “expectation game” tonight.

    Barack Obama moves on to close out the race with Hillary Clinton who will require a miracle for a come from behind win.

    On to the next primary elections:

    • Countdown to West Virginia: 7 days
    • Countdown to Kentucky and Oregon: 14 days

    In the meantime, there will be increasing calls for Hillary to withdraw from the race and anoint Obama as the Democrat nominee.

    Watch to see if there are many Superdelegates who endorse Obama in the next few days.

    Update:

    Race is tightening in Indiana: Hillary by 4 points only with 72 % reporting. A plurality of a little over 40,000 votes with some pro-Obama counties still to report.

    Is this an upset in the making?

    Update #2:

    Barack Obama has made a startling come back in Indiana:

    He trails by 4 points with 79% reporting – less than 35K votes.

    Update #3

    Hillary is giving her victory speech with a 4 point lead but Gary, Indiana with a high population of African American voters has not reported one vote yet.

    This race will tighten more as the night progresses.

    AllahPundit already thinks it is over for Hillary and so does Flap – put a fork in her – She’s done.

    Hillary claims victory: “Tonight we’ve come from behind, we’ve broken the tie, and thanks to you it’s full speed on to the White House”

    But, the outcome is still uncertain. Gary, Indiana and Lake County have not reported any votes. Hillary leads by the 40 K range and the outcome could flip. Results from CNN are here.

    Results of tonights elections will be released within two hours when the polls close in North Carolina and Indiana.

    • Urban Indiana voting is up (favorable for Obama)
    • There is evidence of Republican cross-over voting for Democrats in GOP dominated areas of Indiana

    1. Repeal the gas tax for the summer, and pay for the repeal by cutting domestic discretionary spending

    Flap agrees with Newt on most issues but change has to come from the GOP leadership in a post-Bush world. GOP activists are demoralized and are losing voters because of theirlack of policy initiatives.

    Certainly, Newt’s program for change is a start but the GOP must kick-start their asses into action or they will suffer catastrophic electoral losses in November.

    Indiana Voting More Like a General Election

    Voting is brisk in Indiana and the Marion County Clerk Beth White said voters should GO NOW to vote and this was three hours ago.

    “I’d recommend they get there right now, bring their ID and prepare to be patient,” White said during a news conference in the clerk’s office.

    Polls close at 6 p.m., and White said turnout already is looking less like a primary than a general election. Based on reports from precincts, she said turnout may surpass the November 2006 election, when one-third of Marion County voters showed up, but might not be as large as the 2004 election, when nearly 54 percent of registered voters took part in the contest pitting President George W. Bush against John Kerry.

    Four years ago, less than one in five Marion County registered voters showed up for the primary.

    Early news reports from Indiana have large numbers of Republicans crossing over and voting in the Democrat Presidential primary election.

    10:51 AM — ‘Hardcore’ Republicans voting Democrat

    The two precincts at Broad Ripple Family Center selected Republican Jon Elrod over Democrat Andre Carson in March’s special election for U.S. Congress. But by 9 a.m., just 21 voters in one of those precincts had requested Republican ballots — out of 168 cast.

    Amid heavy turnout, Republicans appeared to be crossing over in droves today in Marion County and suburban counties, where fewer Republican voters might impact down-ticket primary races.

    Rush is having voters from Indiana calling into his show and the cross-over Republican voters VOTING for Hillary is progressing. Voters are not being challenged as promised by the Indiana Democrat Party.

    There are cross-over voters also reporting in from North Carolina.

    United States Attorney John L. Brownlee and Virginia Attorney General Bob McDonnell announced today that Roy Silas Shelburne, age 51, of Pennington Gap, Virginia, was indicted by a federal Grand Jury sitting in Abingdon, Virginia.

    Shelburne was charged in an eight count indictment with racketeering, healthcare fraud, mail fraud, wire fraud, money laundering, and interstate transportation of monies taken by fraud after a joint investigation by the Virginia Attorney General’s Medicaid Fraud Control Unit, the Internal Revenue Service, and the United States Attorney’s Office.

    “The Grand Jury has charged that Roy Shelburne was lining his own pockets by over billing Medicaid. Time after time, Medicaid was billed for services not performed, or services that were not needed,” said United States Attorney John Brownlee. “Shelburne gave no thought to the needs or the quality of care provided to his patients. In some cases, the work that was done was performed in such a manner that it was the equivalent of having no dental services performed at all.”

    “Roy Shelburne acted in a cruel and inhumane manner by performing unnecessary and extremely painful dental procedures on children. Shelburne’s criminal conduct towards these poor families and young foster children is one of the worst cases of abuse and fraud I have seen in my many years in law enforcement,” U.S. Attorney John L. Brownlee said today. “I am grateful that this jury held Mr. Shelburne responsible for his crimes. My thanks and gratitude go out to all the state and federal agents and prosecutors who worked tirelessly to bring the defendant to justice.”

    • Beginning in 1998, Shelburne, who was a licensed dentist with a practice in Pennington Gap, executed a scheme to maximize his practice’s income by over billing insurance carriers and Medicaid for services that were never performed and for services that were performed, but not medically necessary.
    • In addition, Shelburne directed his employees to bill patients for services that were never performed or that were unnecessary. All of the patients Shelburne falsely billed were low income, underage patients who were recipients of Medicaid. A portion of the underage patients were residents of the Harvest Child Care Ministries group home.
    • According to the evidence presented at trial, Shelburne would “upcode” the bills for some of his patients. “Upcoding” is the process of performing one procedure but billing for a different procedure, one which requires a higher payment from Medicaid and private health insurance providers. In some cases, Shelburne would submit bills for services that were incomplete or medically unnecessary. At times, he performed services that endangered the health of his patients.
    • On several occasions Shelburne billed both Medicaid and private health insurance companies for services he performed in connection with a single procedure, collected money from both agencies and failed to reimburse either for the fraudulent fees he collected. Many times this created credit balances on the patients account that, according to his employees, Shelburne would simply “zero out” without reimbursing Medicaid.
    • According to the evidence presented at trial, Shelburne submitted at least 115 false billing statements by mail. The defendant took part of the fraudulently obtained funds and transferred them into a retirement account in Illinois. The evidence showed that Shelburne used some of the funds to build a new home known to his employees as the “Cavity Castle,” purchase luxury vehicles for himself and his family, and took his family on cruises that were deducted on his books as board expenses. In addition, he put his three children on the company payroll when, according to his employees, they provided no services. The salaries paid to the children were deducted as business expenses. Shelburne used part of the fraudulently obtained funds to pay his salary, purchase dental supplies and pay rent for his business and equipment.
    • In addition, Shelburne was convicted of structuring cash deposits at both BB&T Bank and Rick Hill Imports, a luxury car dealership, in an attempt to evade the currency transaction reporting requirements. With the structured funds, he contemporaneously purchased a used 2006 Mercedes SUV and a new 2006 Mercedes SLK coupe in the names of family members.
    • On cross-examination, Shelburne testified that the structured funds were part of a cash horde that he had accumulated to hide assets from investigators.

    But, now various “CLOSED – MEMBERSHIP ONLY” Dentist forums are ablaze with righteous indignation over Dr. Shelburne’s conviction. He is currently on bail awaiting sentencing on June 16th.

    A Florida dentist, Dr. Mike Barr has created a website to plead Dr.Shelburne’s case: Errant Medicaid Investigation Ruins Good Dentist.

    So, what is the story?

    Has there been a breakdown in the criminal justice system? Or is this merely a plea by a convicted felon that he did not commit the crimes? Or a convicted criminal attempting to drum up sympathy for a lighter sentence, new trial or a verdict set aside?

    Dr. Shelburne WAS indicted by a Federal Grand Jury and convicted by a jury. Yet, he and other dentists claim in numerous posts on the “closed sites” that he was treated unfairly?

    Last Shopping Day of the Primary Season – The Predictions

    Jim Geraghty over at National Review has the round-up of election predictions:

    Captain Ed @ Hot Air:

    • Hillary by 8 in Indiana
    • Obama by 4 in North Carolina

    Mickey Kaus @ Slate:

    • Hillary by 8 in Indiana
    • Obama by 3 or less in North Carolina

    Flap’s Prediction:

    • Hillary by 7 in Indiana
    • Obama by 6 in North Carolina but wins less than 33% of the white vote

    And, what does it all mean?

    Hillary will claim that Obama cannot win the demographics that the Democrats need to win in the fall – namely white working class voters in Ohio, Pennsylvania, California and Texas.

    Obama will escape with a win, his first since, when? February? But, he will be clearly on the defensive.

    The controversy regarding Michigan and Florida delegates will intensify as the race carries onto to West Virginia and Kentucky where Hillary should do well and Oregon where Obama is the favorite.

    If the election breaks this way, it is on to Denver and a nasty summer for the Democrats.

    The last shopping day? The begnining of the end?

    Possibly

    But, Flap forecasts an Indiana win for Hillary Clinton and a North Carolina win for Barack Obama. This is the conventional wisdom.

    The Democrat race will then proceed within the beltway for Democrat Superdelegates where the “smoke filled” rooms of Democrat Pols will decide the race.

    And, somebody will be disappointed.
