    ASSociated Press: Sen. Biden Suggests Scrapping Hearings

    Supreme Court nominees are so mum about the major legal issues at their Senate confirmation hearings that the hearings serve little purpose and should probably be abandoned, Democratic Sen. Joe Biden said Thursday.

    “The system’s kind of broken,” said Biden, a member of the Judiciary Committee considering the nomination of Judge Samuel Alito.

    “Nominees now, Democrat and Republican nominees, come before the United States Congress and resolve not to let the people know what they think about the important issues,” such as a president’s authority to go to war, said Biden.

    As the committee headed into its fourth day of hearings on the Alito nomination, Biden told NBC’s “Today” show that a better solution might be to skip hearings and send nominations straight to the Senate floor for a vote.

    “Just go to the Senate floor and debate the nominee’s statements,” the Delaware senator said, “instead of this game.”

    Senator Slow Joe is tired of being portrayed as a FOOL.

    Bet his polling numbers for the would-be Presidential candidate are NOT favorable.

    AP: Alito Turns Aside Democrats’ Criticism

    Supreme Court nominee Samuel Alito turned aside Democratic attacks on his judicial record and credibility at contentious confirmation hearings Wednesday that left his wife in tears.

    If I’m confirmed I’ll be myself,” said Alito, a 15-year veteran of a federal appeals court, named to succeed Justice Sandra Day O’Connor for a swing seat on the high court.

    Challenged by Democrats, Alito repeatedly said he had no memory of involvement with the conservative Concerned Alumni of Princeton, though he highlighted his membership in a 1985 job application for the Reagan administration.

    He repudiated the opinions expressed in articles in the organization’s magazine. “They’re not my views … I deplore them,” he said of writing that contained material that was racist, sexist and homophobic.

    The snarky Senate Democrats attempted to paint Judge Alito with the BIGOT BRUSH but ended up looking like FOOLS.

    There is NO THERE – THERE with the Concerend Alumni of Princeton.

    Judge Alito is NOT a BIGOT but a respected highly qualified jurist.

    AP: Alito Pleases GOP Senators, Not Democrats

    Supreme Court nominee Samuel Alito picked his way carefully Tuesday through the issues of abortion and warrantless wiretapping, satisfying Senate Republicans at his confirmation hearings but provoking Democratic expressions of displeasure.

    The Bill of Rights applies “in times of war and in times of national crisis,” the 55-year-old appeals court judge said, although he declined to specify whether President Bush acted properly in ordering wiretaps without warrants in selected cases as part of the war on terror.

    Asked repeatedly about abortion, he assured the Senate Judiciary Committee he would first take previous rulings into account. At the same time, he stressed that precedent, including the landmark 1973 decision establishing a woman’s right to end her pregnancy, is not binding on the high court.

    “I would approach the question with an open mind and I would listen to the arguments that were made,” said Alito, who wrote two decades ago that he did not believe the Constitution includes the right to an abortion.

    No major gaffs and the Senate Democrats look like a group of mental midgets compared to Judge Alito.

    Samuel Alito is NO Harriet Miers.

    Dujack ’76 regrets controversial op-ed, will not testify before Senate committee

    An alumnus tapped by Democrats to testify in next week’s Senate hearings on Samuel Alito ’72 will no longer appear, removing the only witness slated to speak specifically about a controversial conservative alumni group of which Alito was a member.

    Stephen Dujack ’76, an environmental writer, had been outspoken in his condemnation of the group, Concerned Alumni of Princeton, which during the 1970s criticized the University’s move to coeducation and adoption of affirmative action. Opponents of Alito’s nomination to the Supreme Court had seized on his membership in the group to show that he is out-of-step with mainstream America on core issues.

    Though it wasn’t immediately clear why Dujack was removed from the Democrats’ witness list, some observers believe he was vulnerable to attacks over an April 2003 Los Angeles Times column he wrote that compared animals killed in slaughterhouses with victims of the Holocaust.

    Almost 20 years ago, the Concerned Alumni of Princeton (CAP) collapsed like a modern House of Usher, so rotten from within from its own deceptions and peculiar madness that it could no longer sustain its own weight. For Supreme Court nominee Judge Samuel Alito ’72, the reappearance of CAP in the national press last week because he included it on that now infamous 1985 job application must have been as shocking as the reappearance of Roderick Usher’s dead twin sister in Poe’s famous story.

    Or, it should have been. At the very least, Judge Alito will have to explain to the Senate Judiciary Committee why he paid dues to an outfit whose modus operandi was deceit and dirty tricks. He will have to explain how he permitted himself to belong to an organization that was overtly racist and sexist for its entire 14-year existence ­— at times passionately so, too.

    Dujack is a LEFTIE NUT CASE and after outing the Democrats pulled him to avoid embarassment.

    This entire issue of CAP is ludicrous.

    But….. the Democrats are DESPERATE to defeat Alito.

    According to the Democrats’ press release, Dujack will testify about Judge Alito’s long-ago “membership in the Concerned Alumni of Princeton (CAP). Formed in 1972, CAP has been publicly criticized for its policies opposing Princeton’s decision to admit women and minorities.” The Democrats have gotten so used to making wild charges that I wonder whether they even bother to read their own propaganda. The decision to admit women at formerly all-male schools like Princeton was indeed controversial, but the Democrats’ suggestion that CAP “oppos[ed] Princeton’s decision to admit minorities” is ridiculous.

    Judge Samuel Alito Gains the American Bar Association’s Highest Rating for a Supreme Court Nominee

    USA Today: Alito gets ‘well-qualified’ rating from American Bar Association

    Judge Samuel Alito on Wednesday gained the American Bar Association’s highest rating for a Supreme Court nominee, giving him a boost before next week’s Senate confirmation hearings.

    The “well qualified” rating — the highest — is the same one that Alito earned in 1990 when President Bush’s father, George H.W. Bush, nominated him to the 3rd U.S. Circuit Court of Appeals.

    Embracing the latest rating, White House spokesman Scott McClellan said, “Leading Senate Democrats have said in the past that the ABA is the — quote — gold standard for evaluating judicial nominees.”

    Samuel Alito Watch: 1985 Memo – Roe v. Wade Should Be Overturned

    The ASSociated Press has Alito Argued to Overturn Roe in 1985 Memo

    Supreme Court nominee Samuel Alito wrote in a June 1985 memo that the landmark Roe v. Wade ruling legalizing abortion should be overturned, a finding certain to enliven January’s confirmation hearings. In a recommendation to the solicitor general on filing a friend-of- court brief, Alito said that the government “should make clear that we disagree with Roe v. Wade and would welcome the opportunity to brief the issue of whether, and if so to what extent, that decision should be overruled.”

    The June 3, 1985 document was one of 45 released by the National Archives on Friday. A total of 744 pages were made public.

    And this is a surprise?

    The documents released Friday are the latest involving Alito and abortion.

    In paperwork released earlier from Alito’s time in the Justice Department’s solicitor general’s office, he recommended a legal strategy of dismantling abortion rights piece by piece. And as part of an application for a job as deputy assistant attorney general, Alito said the Constitution does not guarantee abortion rights.

    The latest memo is certain to stir controversy as the Senate prepares for confirmation hearings for Alito, slated to begin Jan. 9.

    There will be NO controversy but just SABOTAGE of the nomination by the LEFT.

    The “Borking” of Judge Alito is beginning in earnest.

    Nuclear Option Watch: Filibuster Rule Change for Alito?

    The ASSociated Press has Frist Says He’s Ready to Block Filibuster

    Senate Majority Leader Bill Frist said Sunday he is prepared to strip Democrats of their ability to filibuster if they try to stall Samuel Alito’s nomination to the Supreme Court.

    “The answer is yes,” Frist said when asked if he would act to change Senate procedures to restrict a Democratic filibuster. “Supreme Court justice nominees deserve an up-or-down vote, and it would be absolutely wrong to deny him that.”

    Democrats immediately called Frist’s words unhelpful and potentially incendiary. They said Senate Democrats are waiting for the Judiciary Committee to act on Alito’s nomination before they decide what they may do.

    “Sen. Frist has thrown down the gauntlet at a time when the country least needs it,” said New York Sen. Chuck Schumer, a Democratic member of the Judiciary Committee. “The American people know that checks and balances are an integral part of our government.”

    Judge Alito deserves an up or down vote. He is NOT Harriet Miers.

    If the Lefties filibuster – change the Senate rules and confirm him.

    Samuel Alito Watch: Fox News Refuses to Air Factually Incorrect Television Ad

    The ASSociated Press has Fox News Won’t Show Ad Opposing Alito

    Fox News is refusing to air an ad critical of Supreme Court nominee Samuel Alito, citing its lawyers’ contention that the spot is factually incorrect.

    A spokesman for the groups sponsoring the ad said the network’s decision reflects the political right’s effort to shield President Bush’s choice for the high court.

    The ad says that as an appellate court judge, Alito has “ruled to make it easier for corporations to discriminate … even voted to approve strip search of a 10-year-old girl.” Referring to a document Alito wrote in 1985 while seeking a job in the Reagan administration, it quotes him as saying that “the Constitution does not protect a right to an abortion.”

    The groups backing the ad include the Alliance for Justice, the Leadership Conference on Civil rights, People for The American Way and abortion rights organizations.

    The ad is factually incorrect and disingenuous.

    But, what do you expect from the Lefties.

    In a 2004 decision, the 3rd Circuit U.S. Court of Appeals ruled in the case of four police officers who faced a lawsuit after the search of a mother and her 10-year-old daughter in the course of executing a search warrant for narcotics.

    The court said “searching Jane and Mary Doe for evidence beyond the scope of the warrant and without probable cause violated their clearly established Fourth Amendment rights.” The court pointed out that “a search warrant for a premises does not constitute a license to search everyone inside.”

    Alito dissented in the case, saying the best reading of the warrant is that it authorized the search of anyone found on the premises. He added that even if the warrant didn’t explicitly give that authorization, “a reasonable police officer could certainly have read the warrant as doing so.”

    Fox has taken a responsible approach and asked them to correct the ad – as should other media outlets.

    If they do not edit and make corrections then the media folks can determine if they wish to decline to broadcast it or give Judge Alito some fair response avenues.

    Paul Shur, a spokesman for Fox, said that according to the network’s lawyers, the ad is “factually incorrect and we’ve given them an opportunity to fix it.”

    Said Jim Jordan, a spokesman for the groups: “The entire right wing establishment, from Pat Robertson to Jerry Falwell to Fox News, has circled the wagons around Sam Alito.”

    Asked about changing the ad in response to Fox’s request, Jordan said, “Roger Ailes doesn’t get to edit our ads.” Ailes is chairman of Fox News.

    Officials said the ad would run on cable television news programs nationally as well as in Maine and Rhode Island, two states that have three moderate Republican senators.

    They declined to say how much would be spent, but officials at rival organizations placed the expenditure at less than $65,000, an amount unlikely to make a significant impact.

    Kudos to Fox News……..

    The War for Alito has just begun…….
