The Obamas and Bo, their dog – A Chilling Photo?

We’ll be here all week. But seriously, folks, we have a man-bites-dog story for you today.
First, some background. Last week Byron York of the Washington Examiner reported that “some Obama staffers are reportedly obsessing over a nearly 30-year-old story about [Mitt] Romney’s dog”:
In 1983, Romney took his family on vacation and, faced with a packed station wagon, put his Irish setter Seamus in a travel kennel strapped to the roof of the car. Romney constructed a special windshield in an effort to make the dog more comfortable, but Seamus ended up relieving himself on the roof, which reportedly caused much consternation among the Romney boys. Ever since the story got out–it was reported by the Boston Globe in 2007, during Romney’s first run for president–Romney opponents have used it in semiserious and sometimes fully serious ways to portray him as insensitive.
“I have heard, in focus groups, the dog story totally tanks Mitt Romney’s approval rating,” Chris Hayes said on his MSNBC show. The Washington Post reported last month that the Seamus story “is ballooning into a narrative of epic proportions”:Late-night host David Letterman has been giving the dog near-nightly shout-outs. There are parody Web videos, “Dogs Aren’t Luggage” T-shirts and Facebook groups. (“Dogs Against Romney,” which protested outside last month’s Westminster dog show, has more than 38,000 Facebook fans.) The New Yorker featured a cartoon, with Rick Santorum riding in Romney’s rooftop dog carrier, on its cover last week. In the five years since the story was revealed, New York Times columnist Gail Collins has mentioned Seamus in at least 50 columns.
- The Dog Days of the Presidential Campaign Begin – I would note that in 2008, John McCain’s presidential campaign wouldn’t have touched this anecdote with a ten-foot pole. Between this and the Romney camp’s rapid response to the Rosen comments, we are seeing a Republican presidential campaign that is exponentially faster on its feet and way more nimble than the previous general-election campaign against Obama.
- IN-Sen: Don’t Believe the Anti-Incumbent Narrative – A few weeks after that primary, on May 8, Indiana Sen. Dick Lugar will either lose to state Treasurer Richard Mourdock or squeeze by him in the GOP primary.
Lugar’s problems, however, have nothing to do with the “anti-incumbent” mood or Congress’ poor reputation. Instead, they have everything to do with his record and his horrible campaign.
Lugar’s record and style don’t fit comfortably with where his party now is, yet he made little or no effort to sooth conservatives or to prepare for a battle. If he had, he might, for example, have purchased a house or condo in the state so that he wouldn’t need to stay in a hotel when he returns to the state to campaign.
More than a year ago, I wrote in this space about Lugar’s vulnerability in a possible one-on-one primary. Almost immediately, I received a call from a Lugar staffer telling me how wrong I was and pointing out that the Senator was hugely popular and had a large campaign war chest.
In other words, Lugar’s team didn’t understand what could happen if voters were presented with a credible opponent who either had money or would be supported by outside groups willing to spend heavily to defeat the Senator. And later, the campaign didn’t understand why anyone would care that Lugar didn’t own a residence in the state.
- Weiner a jerk before crotchgate, craved media attention: book – Disgraced former Congressman Anthony Weiner was behaving like a jerk long before the world got a glimpse of his crotch.
A new book offering an inside look at the US House of Representatives depicts Weiner as a desperately ambitious loudmouth who berated his staff and would do or say anything for TV airtime.
Weiner “would enter his office in the Rayburn Building screaming at the top of his lungs, ‘Why the f–k am I not on MSNBC?!’” journalist Robert Draper wrote in “Do Not Ask What Good We Do: Inside the US House of Representatives.”
He finally got his wish, Draper wrote, when Weiner pushed to become the liberal spokesman for ObamaCare.
“He was now on MSNBC every week, sometimes every day — to the point where he was carrying his own makeup kit. (Or rather, his press guy was.)” Draper wrote.
Excerpts of the book, due out Tuesday, surfaced yesterday on the Web site Politico.

- The Top 10 Most Expensive Obamacare Taxes and Fees – Yesterday was tax day, serving as a special reminder of how big the federal government has become. As Heritage has warned before, Obamacare is on track to makes things a lot worse.
The President’s health law will be partially paid for by tax increases and the creation of new taxes. When Obamacare first passed, the Joint Committee on Taxation estimated that its tax hikes would total $502 billion over the next 10 years. But most of the new, higher taxes don’t kick in until later in the decade, which means that once all of the law is fully implemented, the taxpayers’ tab will be much bigger than originally estimated.
A new study by the Joint Economic Committee (JEC) revealed today that Obamacare will impose higher taxes totaling $4 trillion between now and 2035, with substantial hits on working Americans. That works out to more than $1.7 trillion over a decade—more than triple the original 10-year score.

- In-Sen: Mourdock Leads Lugar in Internal Poll – Indiana state treasurer Richard Mourdock leads Senator Dick Lugar by one point according to a poll commissioned by the Mourdock campaign. Conducted between April 16 and 17 by the firm McLaughlin and Associates, the poll surveyed 400 likely Republican primary voters and found Mourdock in the lead, 42–41, against Lugar. The poll had a 4.9 percent margin of error.
Since January, Lugar’s favorability rating has fallen ten points, from 57 to 47 percent, while Mourdock’s has risen by eleven, from 35 to 46 percent. “These results clearly demonstrate that Richard Mourdock has the momentum to win,” a memo from pollsters John McLaughlin and Stuart Polk notes.

- Menthol Cigarettes Double Stroke Risk – Menthol cigarettes more than double the risk for stroke compared with regular cigarettes, a new study shows. In women and nonblack smokers, the risk for stroke was more than tripled.
No significant associations were observed between the tobacco additive and other forms of cardiovascular disease, such as hypertension, myocardial infarction, congestive heart failure, and chronic obstructive pulmonary disease (COPD).
The mechanism by which menthol may increase stroke risk remains unclear.
One potential mechanism is that menthol stimulates upper-airway cold receptors, which can increase breath-holding time, which may in turn facilitate the entrance of cigarette particulate matter into the lungs, notes Nicholas Vozoris, MD, from St. Michael’s Hospital, in Toronto, Ontario, Canada.
Another possibility is that menthol cigarettes exert some selective effects on the cerebrovascular system.
- Potential VP pick Mitch Daniels endorses Mitt Romney – Indiana Gov. Mitch Daniels, frequently mentioned as a potential vice presidential candidate, is the latest Republican leader to formally endorse Mitt Romney.
“It must be a slow news day if this has made the air,” Daniels told Fox News on Wednesday. “But for what it’s worth, I did send a congratulatory note to Gov. Romney the other day offering to anything I could to help him, and here I am.”
It didn’t come across as a particularly strong endorsement, and the Fox News anchor noted that Daniels has a dry, self-deprecating manner.
“He’s already won our nomination,” Daniels continued. “He’s earned it, he’s proven himself the best nominee we could put forward, and I’m just happy to sign on and help him.”

- Gingrich slams Santorum as ‘big labor Republican’ – Republican presidential candidate Newt Gingrich on Monday slammed rival Rick Santorum as a “big labor Republican,” accusing him of siding with unions over Memphis-based FedEx when the Senate grappled with a labor dispute in the 1990s.
Gingrich, the former Georgia congressman and House Speaker, is hoping to revive his struggling campaign in the South, and he tailored his message Monday to Republican voters in Tennessee. Although polls show a close race between Santorum and Mitt Romney, Gingrich challenged the former Pennsylvania senator and his conservative credentials.
- Michigan Forecast Update: Romney’s Lead Looks More Tenuous – Since we ran the Michigan numbers early Monday morning, three new polls are out that make the state look more like a true toss-up and less like one that favors Mr. Romney.
Two of the surveys, from Mitchell Research and American Research Group, in fact give Rick Santorum a nominal lead in Michigan, by 2 and 1 percentage points respectively. The third, from Rasmussen Reports, gives Mr. Romney a 2-point advantage.
We also added a hard-to-track down survey from Baydoun Consulting, which gave Mr. Romney an 8-point advantage. However, it is less recent than the others, having been conducted on Thursday night rather than over the weekend.
Among the five polls that were conducted over the weekend — including those that had been included with the previous update — three give Mr. Romney a small lead while two show an edge for Mr. Santorum.
Mr. Romney still has the advantage in the FiveThirtyEight forecast, but it is more tenuous than the one we released overnight. The model gives him a 64 percent chance of winning the state, down from 77 percent in the previous forecast.

- The Recall Elections Blog: The Walker Recall: What to Expect When You’re Expecting a Recall – With the news that Scott Walker is not going to challenge the signatures, the gubernatorial recall is going forward. The Wisconsin GAB is set to rule today on all six recalls — against the Governor, Lieutenant Governor, and four Republican state Senators — have qualified for the ballot. From numerous press reports, and from the past history with signature verification, the recalls are very likely to be approved. The only recall that is in any doubt is against the Majority Leader of the Wisconsin state Senate, Scott Fitzgerald.
This would represent the second year in a row that we are staring at an unprecedented use of the recall. This recall could have an effect well beyond Wisconsin. There are potential dangers for both sides.
Let’s look at some of the history and background on the use of the recall:
- Governor Scott Walker will not challenge recall signatures – Gov. Scott Walker will not challenge any signatures by Monday’s deadline in an attempt to stop a recall election against him.
That leaves only a review by state elections officials standing between the Republican governor and only the third recall election for a governor is U.S. history. An independent conservative group released its own analysis of the recall petitions Monday, but state elections officials said the law does not allow it to count those outside challenges.
“We are not filing any specific challenges to any specific signatures today,” Walker campaign spokeswoman Ciara Matthews said. “We simply ran out of time.”
Organizers gathered more than 1 million signatures in 60 days seeking to force the recall – well over the 540,000 valid signatures needed. Over the last month, Walker and Republicans have been examining the signatures seeking to find ones to challenge as invalid.
In a filing Monday, Walker’s campaign called on the elections agency to continue its official review of the signatures.
Government Accountability Board spokesman Reid Magney confirmed that the elections agency would continue that review, including the search for incomplete, duplicate or fraudulent signatures. Currently, the agency has until March 19 to complete that review but Magney said he wasn’t sure how much time it would take.
“That’s something we’re obviously still working on,” Magney said.

- The State of the Twitterverse 2012 – Brian Solis – The first time I wrote about Twitter was March 2007. My, how time and Tweets fly. With 500 million registered users and 33 billion Tweets flying across the Twitterverse every day, Twitter has become a fabric of our digital culture. Twitter is now ingrained in our digital DNA and is reflected in our lifestyle and how we connect and communicate with one another.
While many struggle to understand its utility or its significance in the greater world of media, it is the most efficient global information network in existence today. News no longer breaks, it Tweets. People have demonstrated the speed and efficacy of social networking by connecting to one another based on interests (interest graph) rather then limiting connections to relationships (social graph). Twitter represents a promising intersection of new media, relationships, traditional media and information to form one highly human network.

The latest Rasmussen Reports national telephone survey finds that just 24% of Likely U.S. Voters favor applying affirmative action policies to college admissions. Fifty-five percent (55%) oppose the use of such policies to determine who is admitted to colleges and universities. Twenty-one percent (21%) are undecided.

- EPA Needs More Time to Reconsider Boiler MACT Rules – American workers and the industries that employ them face an ill-thought out and incomplete set of Boiler MACT regulations costing $14 billion to implement. Given current economic realities, these regulations place at risk the jobs of your constituents and 200,000 working Americans across the country. With the economic climate as it is now, we cannot afford to lose too many more American manufacturing jobs.
The EPA asked for proper time to reconsider the Boiler MACT rules, and even attempted to stay the rules to have more time to clarify them. The forest products industry, for example, is compiling additional data at the EPA’s request, but may not have time to complete needed testing. The courts have made it clear that only Congress can give the EPA the time they have asked for and need to provide clarity. As a result, this legal uncertainty is a cloud over American businesses, which must be able to plan for the future in these uncertain economic times. Our communities deserve environmental rules that have been fully considered, and will hold up scientifically in the long term

- “Cutting the Bureaucratic Gridlock” by Senator Tony Strickland – While I was visiting Teixeira Farms to discuss agricultural issues, the owners told me that one state agency said they needed to recycle all their water, while another state agency said they couldn’t recycle any of their water. The owners of the farm told me they were happy to do whatever was needed, but they couldn’t recycle all their water and none of their water at the same time.
Sadly, this isn’t the first time something like this has happened. Constituents and small business owners in my district often call my office, telling me that one state agency has given them the run-around about an issue and referred them to yet another state agency. Round and round they go, from agency to agency, until they finally give up.
Cleary, California’s vast bureaucracy is not working. There has to be a way to make government more efficient and maximize your precious tax dollars that come to Sacramento.This is why I’ve authored Senate Bill 953. SB 953 would create the Bureaucracy Realignment and Closure Commission (BRAC). SB 953 is modeled and named after the successful Base Realignment and Closure (BRAC) program, which was established by the federal government after the end of the Cold War. The Federal BRAC program successfully identified and closed obsolete military bases, saving an estimated $20 billion annually.
- State party chief wants GOP candidates to rally around statewide theme – Tacitly acknowledging that the California Republican Party will likely be strapped for funds to support candidates in the tough new districts in which many of them will be running this fall, Chairman Tom Del Beccaro said Friday he hopes GOP candidates will rally around “statewide themes” to maximize the party’s efforts.
“We need to make this a statewide election around an issue that coalesces voters,” he said at a news conference at the opening of the state GOP convention. “We can’t be the party of no. Parties become more attractive when they have positive ideas.”

- Co-founder Mark Meckler resigns from Tea Party Patriots – Mark Meckler, the co-founder of the Tea Party Patriots, has resigned from his role with the grassroots group over internal disputes about the leadership of the organization, The Daily Caller has learned.
In an email obtained by TheDC, Meckler told the state coordinators of Tea Party Patriots on Thursday night that he “fought long and hard” to maintain the group “as an organization that is run from the bottom up, with the intent of serving the grassroots.”
“Unfortunately, it is my belief that I have lost this fight,” Meckler said. “I probably fought the internal fight longer than I should have, but I wanted to give absolutely every possible effort to preserving what I believe was the unique nature of the TPP organization.”
Since the organization’s founding, Meckler has shared the role of national coordinator with co-founder Jenny Beth Martin. But Meckler wrote in the email that he had lost “influence in the leadership of the organization, and it has been that way for quite some time.”
Meckler said the board granted Martin “almost complete power over the day-to-day operations” in November 2011 after a “protracted fight in which I was complaining about the direction, operation (top-down) and finances of the organization.”

- A talk with Scott Walker – For many conservatives frustrated with the Republican Party, Wisconsin Gov. Scott Walker has been a bright spot. After taking office last year in a bluish state, Walker set out to close a $3.6 billion budget hole, in part, by reforming public sector unions. His reforms, which gave workers choices as to whether they wanted to join a union and curbed union collective bargaining powers that were crippling local budgets, sparked a wave a protests. - Los Angeles Times launches new membership program – The Los Angeles Times will begin charging readers for access to its online news, joining a growing roster of major news organizations looking for a way to offset declines in revenue.
Starting March 5, online readers will be asked to buy a digital subscription at an initial rate of 99 cents for four weeks. Readers who do not subscribe will be able to read 15 stories in a 30-day period for free.
Separately, The Times announced plans to launch a new weekly lifestyle section called Saturday for its print subscribers.
Other news outlets that have begun charging for online journalism include the New York Times, the Wall Street Journal and the Dallas Morning News. Gannett, the nation’s largest newspaper company, this week announced plans to launch a similar program at 80 publications, saying it could boost earnings by $100 million in 2013.

- U.S. does not believe Iran is trying to build nuclear bomb – As U.S. and Israeli officials talk publicly about the prospect of a military strike against Iran’s nuclear program, one fact is often overlooked: U.S. intelligence agencies don’t believe Iran is actively trying to build an atomic bomb.
A highly classified U.S. intelligence assessment circulated to policymakers early last year largely affirms that view, originally made in 2007. Both reports, known as national intelligence estimates, conclude that Tehran halted efforts to develop and build a nuclear warhead in 2003.
The most recent report, which represents the consensus of 16 U.S. intelligence agencies, indicates that Iran is pursuing research that could put it in a position to build a weapon, but that it has not sought to do so.
Although Iran continues to enrich uranium at low levels, U.S. officials say they have not seen evidence that has caused them to significantly revise that judgment. Senior U.S. officials say Israel does not dispute the basic intelligence or analysis.
- Could California swing the Republican nomination? – If no clear front-runner in the delegate count emerges by the end of April, Texas and California will move to the center of the political universe. These two gigantic, expensive states could then hold the keys to the nomination and determine whether we are headed for a brokered convention.
What would a hotly contested California Republican primary campaign, unseen in decades, look like? Certainly it would be very expensive, and waged almost entirely on television. The state is too big to quickly organize on a district level (ask anyone who has run for statewide office in California), making broadcast media critical. A quick bus tour, some fly-arounds and earned media stops would make up the rest. An insurgent candidate could also conceivably attempt to organize the small number of Republicans who live in heavily Democratic congressional districts in Los Angeles to score a few delegates.
California’s primary is “closed,” meaning only registered Republicans may participate. This results in a more conservative electorate than in “open” primary states where voters of other affiliations may vote in the Republican primary.
Although California votes late enough to be winner-take-all, it isn’t. Under rules adopted in 2000 and first put into effect in 2004, the California Republican Party will allocate delegates proportionally by congressional district. In 2008, John McCain won in 48 of 53 districts, with Mitt Romney winning in the remaining five.

- “Dogs Against Romney”? Democrats Say Unleash the Hound! – Tomorrow outside the Westminster dog show at Madison Square Garden at noon the group “Dogs Against Romney” will protest “to ensure pet lovers are aware that Mitt Romney is mean to dogs,” according to the group’s press release.
While it may seem silly to some, Democrats are have every intention of making sure – if Romney wins the GOP nomination – that every voting American knows about the story of Romney putting his family dog Seamus in a kennel on top of his roof and driving from Boston to Canada, with said canine Seamus making his displeasure known in a rather scatological way. “I have a yellow Lab named Winston,” Fox News’ Chris Wallace said to Romney. “I would no sooner put him in a kennel on the roof of my car than I would one of my children. Question: What were you thinking?” “This is a completely airtight kennel, mounted on the roof of our car,” Romney replied. “He climbed up there regularly, enjoyed himself. He was in a kennel at home a great deal of the time as well. We loved the dog. It was where he was comfortable.” “When Seamus crapped all over the car I’m fairly certain he wasn’t expressing pleasure,” one top Democrat told ABC News.
“31 million dog-owners vote,” said another.
- Media Matters memo called for hiring private investigators ‘to look into the personal lives’ of Fox employees – A little after 1 p.m. on Sept. 29, 2009, Karl Frisch emailed a memo to his bosses, Media Matters for America founder David Brock and president Eric Burns. In the first few lines, Frisch explained why Media Matters should launch a “Fox Fund” whose mission would be to attack the Fox News Channel.
“Simply put,” Frisch wrote, “the progressive movement is in need of an enemy. George W. Bush is gone. We really don’t have John McCain to kick around any more. Filling the lack of leadership on the right, Fox News has emerged as the central enemy and antagonist of the Obama administration, our Congressional majorities and the progressive movement as a whole.”
“We must take Fox News head-on in a well funded, presidential-style campaign to discredit and embarrass the network, making it illegitimate in the eyes of news consumers.”
What Frisch proceeded to suggest, however, went well beyond what legitimate presidential campaigns attempt. “We should hire private investigators to look into the personal lives of Fox News anchors, hosts, reporters, prominent contributors, senior network and corporate staff,” he wrote.
After that, Frisch argued, should come the legal assault: “We should look into contracting with a major law firm to study any available legal actions that can be taken against Fox News, from a class action law suit to defamation claims for those wronged by the network. I imagine this would be difficult but the right law firm is bound to find some legal ground for us to take action against the network.”

- Laura Richardson’s ethics woes mount – Democratic Rep. Laura Richardson instructed taxpayer-funded House aides to work on political redistricting last year, sources familiar with the situation told POLITICO.
Such activities could amount to a violation of prohibitions against lawmakers pressuring aides to do political work, as well as rules against using official resources, including staff, for campaign purposes.
The redistricting work, which has not previously been disclosed, allegedly occurred after it became clear Richardson was under investigation over another set of allegations that she forced House aides to perform political and personal tasks in violation of House rules. Richardson did not respond to repeated requests for comment.
Sources told POLITICO that Richardson’s congressional aides collected information about communities outside her district, organized a workshop to train constituents in advance of a public meeting of California’s independent redistricting commission, and wrote talking points for those constituents to deliver during the public-comments portion of the meeting at Long Beach City Hall in April 2011.
The redistricting work was done at Richardson’s direction — rather than on a voluntary basis — these sources said.
A spokesman for the Ethics Committee declined to comment on the Richardson case, but several sources indicated that investigators have expanded the probe and are now looking into the redistricting angle.

- Iranians’ Internet access blocked temporarily: experts – Most computer users in Iran were blocked from accessing email, social networking and other services in recent days, U.S.-based Internet experts said on Monday, raising fears the government is extending the reach of its surveillance on ordinary citizens.
Internet service providers presumed to be acting at the Iranian government’s behest began blocking the most common form of secure connections on Friday, according to the outside experts and Iranian bloggers. Traffic rebounded to normal levels on Monday.
The cutoff apparently affected all encrypted international websites outside of Iran that depend on the Secure Sockets Layer protocol, which display addresses beginning with https, according to Earl Zmijewski of Renesys, a U.S. company that tracks Internet traffic worldwide.

SEIU Local 1000 and the Union of American Physicians and Dentists support AB 1655, the “Public Employees Bill of Rights Act.” Here’s what it would do:
• Gives unionized state employees priority over outside contractors and excluded state workers to fill permanent, overtime and on-call positions.
• Sets a one-year statute of limitations for employers to take an adverse action against a state employee. (The current law allows disciplinary actions up to three years after the discovery of fraud, embezzlement or records falsification.)
• Establishes a peer review committee to provide workplace operations input.

- Steinberg seeks state review of Sacramento Co. dental program – Senate President Pro Tem Darrell Steinberg is calling for a state review of a Sacramento County pilot program that provides state-funded dental coverage for low-income children.
A Center for Health Reporting article published in The Bee over the weekend detailed the shortcomings of the managed care program, including long wait times and comparatively low rates of dental care among the more than 110,000 Sacramento County children covered by the program.
In a letter to California Department of Health Care Services Director Toby Douglas, Steinberg called for immediate action to address what he called a “crisis in prevention and treatment services.”
“Despite that state funding, disturbing specific patient cases as well as the department’s own data cited in the article make it abundantly clear that prevention and treatment services are woefully inadequate for those children most in need,” the Sacramento Democrat wrote in the letter.
In addition to the investigation, Steinberg asked the administration to step up its monitoring of dental plans under contract with the program and withhold payments or cancel contracts with plans that fail to provide proper access to care or meet other performance standards.

- Rick Santorum, Mitt Romney Tied Nationally As Romney Struggles with Base, New Polls Show – Despite a victory in the Maine caucuses on Saturday, Mitt Romney has more to worry about after two new polls released Monday show him fighting to keep his lead among Republicans nationally and struggling to win favor from the conservative base.
A new Pew Research Center poll found Santorum and Romney neck-and-neck, with Santorum winning 30 percent of the support among Republican registered voters to Romney’s 28 percent — a difference that falls well within the poll’s five percentage point margin of error. Separately, Gallup’s latest tracking survey of the Republican race found Romney with 32 percent support and Santorum right on his heels with 30 percent.
Of concern for Romney, the Pew poll shows him struggling among the conservative groups that make up the Republican base. Among self-identified conservatives, Santorum leads Romney by an 11 percent margin, 36 percent to 25 percent. Among Tea Party supporters, Santorum leads 42 percent to 23 percent.
Romney’s support among Tea Party supporters is essentially unchanged from last month, when he received 26 percent support from Tea Party supporters to 24 percent each for Santorum and Newt Gingrich. But Santorum’s lead among the group may be a sign that they have begun to see him as the alternative to Romney.

- The American Spectator : Can Mitt Close the Deal? – Cold, bleak February has turned into a happy time for us. It’s given us a short break from the constant barrage of debates, speeches and “crucial” primaries in the Republican presidential nomination contest. February has given us, and the candidates, a bit of time to think. Let’s make the most of it.
The nomination is still up for grabs. Mitt Romney has the clearest path to it but Newt Gingrich, Rick Santorum, and Ron Paul are all promising to take it all the way to the convention. To those who natter about how cool a “brokered” convention would be, I say don’t wish for something because you might get it. (Among other frightful questions, who can be the brokers? It’ll be a food fight that benefits only the media.) The Republican Party is too weak and fractured to come out of such an event united and strong enough to win in November.
So let’s assume that Romney is the nominee. The arithmetic is pretty simple. Mitt Romney plus an energized Republican base can beat Obama in November. Romney without an energized base will lose. But the Republican base is conservative, and Romney hasn’t closed the deal with conservatives. Can he?
Let’s face it: Romney isn’t one of us. At CPAC last Friday he said he governed Massachusetts as a “severely conservative” Republican in the tone of voice my late maternal grandmother used to say she was severely constipated. We know his record as state candidate and governor, and national candidate since 2007. We need not rehearse it here. Suffice it to say that it defines him as a transactional conservative. He will apply conservative principles as a business owner might apply production scenarios and estimated profit margins to negotiating a deal. They aren’t part of his core, but will be useful tools for him in campaigning and, if he wins, governing. - National Review calls on Gingrich to bow out of presidential race – The National Review is calling on Newt Gingrich to drop out of the Republican presidential race, arguing the former House Speaker should clear the way for Rick Santorum to seize the mantle as the Anti-Romney choice for conservatives.
“It is not clear whether Gingrich remains in the race because he still believes he could become president next year or because he wants to avenge his wounded pride: an ambiguity that suggests the problem with him as a leader. When he led Santorum in the polls, he urged the Pennsylvanian to leave the race. On his own arguments the proper course for him now is to endorse Santorum and exit,” the editors of the influential conservative online magazine wrote in an op-ed posted Monday.
- Santorum moves ahead in Michigan – Rick Santorum’s taken a large lead in Michigan’s upcoming Republican primary. He’s at 39% to 24% for Mitt Romney, 12% for Ron Paul, and 11% for Newt Gingrich.
Santorum’s rise is attributable to two major factors: his own personal popularity (a stellar 67/23 favorability) and GOP voters increasingly souring on Gingrich. Santorum’s becoming something closer and closer to a consensus conservative candidate as Gingrich bleeds support.
Santorum’s winning an outright majority of the Tea Party vote with 53% to 22% for Romney and 10% for Gingrich. He comes close to one with Evangelicals as well at 48% to 20% for Romney and 12% for Gingrich. And he cracks the 50% line with voters identifying as ‘very conservative’ at 51% to 20% for Romney and 10% for Gingrich.

- Congressman wants Afghanistan study group – Citing an Army lieutenant colonel’s claims that there is no progress being made in Afghanistan, Rep. Frank Wolf, R-Va., is urging Defense Secretary Leon Panetta to create an independent study group to review U.S. strategy in the sandbox.
In a letter dated Friday, Wolf wrote he is deeply troubled by the conclusions reached by Lt. Col. Daniel Davis and asks Panetta to immediately create an Afghanistan/Pakistan Study Group.
In 2010 and 2011, Davis traveled to Afghanistan on assignment with the Army’s Rapid Equipping Force, an organization tasked with getting urgently needed equipment to soldiers in the field.
“What I saw bore no resemblance to rosy official statements by U.S. military leaders about conditions on the ground,” Davis wrote in an opinion piece titled “Truth, lies and Afghanistan,” published online Feb. 5 by Armed Forces Journal.
Rather than the gradual progress described by top U.S. officials, Davis wrote he saw, “the absence of success on virtually every level.”
During a yearlong deployment that began in late 2010, Davis wrote, his job sent him around the country to talk, travel and patrol with troops in Kandahar, Kunar, Ghazni, Khost, Paktika, Kunduz, Balkh, Nangarhar and other provinces. It was his fourth combat deployment, and his second in Afghanistan.
Davis wrote a classified and unclassified report. He has not released either report publicly. On his website, he says he will publish the full unclassified version as soon as Army public affairs completes its review and grants permission for release.
On Feb. 10, Rolling Stone magazine published a copy of the unclassified version on its website.
Davis has provided the reports to members of Congress — both Democrats and Republicans, senators and House members. He has also sent his reports to the Defense Department’s inspector general.
He declined to comment for this story.
The Pentagon maintains that the security environment in Afghanistan continues to improve.
During a briefing this week, Army Lt. Gen. Curtis Scaparrotti, deputy commander of U.S. Forces-Afghanistan, described steady progress in the country, from local and national government to the development of Afghan security forces. Responding to a question about Davis’ report, Scaparrotti said, “it’s one person’s view of this,” adding that he thought the Defense Department’s outlook is accurate.
Wolf has written similar letters to Panetta over the past several months.
The congressman is the author of the legislation that created the Iraq Study Group and has been pushing for the Obama administration to conduct a similar review of the situation in Afghanistan and Pakistan.
- Santorum surges into the lead – Public Policy Polling – Riding a wave of momentum from his trio of victories on Tuesday Rick Santorum has opened up a wide lead in PPP’s newest national poll. He’s at 38% to 23% for Mitt Romney, 17% for Newt Gingrich, and 13% for Ron Paul.
Part of the reason for Santorum’s surge is his own high level of popularity. 64% of voters see him favorably to only 22% with a negative one. But the other, and maybe more important, reason is that Republicans are significantly souring on both Romney and Gingrich. Romney’s favorability is barely above water at 44/43, representing a 23 point net decline from our December national poll when he was +24 (55/31). Gingrich has fallen even further. A 44% plurality of GOP voters now hold a negative opinion of him to only 42% with a positive one. That’s a 34 point drop from 2 months ago when he was at +32 (60/28).
Santorum is now completely dominating with several key segments of the electorate, especially the most right leaning parts of the party. With those describing themselves as ‘very conservative,’ he’s now winning a majority of voters at 53% to 20% for Gingrich and 15% for Romney. Santorum gets a majority with Tea Party voters as well at 51% to 24% for Gingrich and 12% for Romney. And with Evangelicals he falls just short of a majority with 45% to 21% for Gingrich and 18% for Romney.
It used to be that Gingrich was leading with all these groups and Romney was staying competitive enough with them to hold the overall lead. No more- a consensus conservative candidate finally seems to be emerging and it’s Santorum. - Labor unions left sour with President Obama set to sign FAA funding bill – Labor’s division over the bill funding the Federal Aviation Administration (FAA) has helped clear the way for President Obama to sign it.
Unions are split in their opposition to the measure, with some fearing its provision on union election rules endangers organizing.
Union officials say they were kept in the dark about the negotiations between Senate Majority Leader Harry Reid (D-Nev.) and House Speaker John Boehner (R-Ohio) that helped pass the bill.

- Shrinking Senate Hopes – for 2012 – Three other Democratic seats are vulnerable. No state has trended Republican in recent years more than Missouri. John McCain narrowly beat Obama in Missouri in 2008. Roy Blunt won the open Senate seat there in 2010 by 14 percentage points. So it’s no surprise that Democratic senator Claire McCaskill is in deep trouble this year. The Republican Senate primary is August 7.
Wisconsin is more Democratic, but it offers Republicans a great opportunity. Congresswoman Tammy Baldwin, the Democratic candidate, is gay, liberal, and a zealous campaigner. Either of the GOP candidates, former governor Tommy Thompson or ex-House member Mark Neumann, could beat her. When Neumann gave up his House seat in 1998 to run (unsuccessfully) for the Senate, by the way, he was replaced by Paul Ryan.
In Hawaii, Democrat Dan Akaka is stepping down after three terms, and there’s only one Republican with a realistic chance of winning his seat, former governor Linda Lingle. Fortunately for Republicans, Lingle is running. She didn’t have to buck a Democratic tide in a presidential year when she won the governorship in 2002 and 2006. With Obama, a native of Hawaii, leading the ticket, she’ll have to overcome a strong partisan headwind.
Where does this leave us? Duffy projects a Republican gain of three to six seats. The Rothenberg Report says two to five. A year ago, I’d have said four to seven. Today, three to six seems about right, with emphasis on the three. But my rule of politics is that the future is never a straight line projection of the present. In November, Republican prospects may look better—or worse.

- The Afghanistan Report the Pentagon Doesn’t Want You to Read – Earlier this week, the New York Times’ Scott Shane published a bombshell piece about Lt. Colonel Daniel Davis, a 17-year Army veteran recently returned from a second tour in Afghanistan. According to the Times, the 48-year-old Davis had written an 84-page unclassified report, as well as a classified report, offering his assessment of the decade-long war. That assessment is essentially that the war has been a disaster and the military’s top brass has not leveled with the American public about just how badly it’s been going. “How many more men must die in support of a mission that is not succeeding?” Davis boldly asks in an article summarizing his views in The Armed Forces Journal.
Davis last month submitted the unclassified report –titled “Dereliction of Duty II: Senior Military Leader’s Loss of Integrity Wounds Afghan War Effort” – for an internal Army review. Such a report could then be released to the public. However, according to U.S. military officials familiar with the situation, the Pentagon is refusing to do so. Rolling Stone has now obtained a full copy of the 84-page unclassified version, which has been making the rounds within the U.S. government, including the White House. We’ve decided to publish it in full; it’s well worth reading for yourself. It is, in my estimation, one of the most significant documents published by an active-duty officer in the past ten years.

- Teachers union defends endorsement of Falk – The state’s largest public teachers union is standing behind its endorsement of Kathleen Falk for governor despite controversy among Democrats and some union members.
Some complained the endorsement came too early: A recall election hasn’t been ordered, and many expect other prominent candidates to join the race. Others felt the unions shouldn’t play kingmaker before a primary or give the impression that the election is about only collective bargaining rights.
Mary Bell, Wisconsin Education Association Council president, said she understood the passionate feelings but said the recommendation was made with input from union leaders throughout the state.
“It’s not surprising,” she said. “Our members have a lot invested in what’s happening.”
Though acknowledging other candidates may enter the race, Bell said she is confident the former Dane County executive is the best choice to beat Republican Gov. Scott Walker.
Bell said the short and uncertain time frame of a recall made it necessary to put out a recommendation early.
Mike Tate, chairman of the state Democratic Party, said the party is proud to work closely with organized labor – which he called “the backbone” of the party – though he said the election is about much more.
“A million Wisconsinites signed a recall petition; each one has their own reason,” he said. “There’s a number of reasons to recall Scott Walker.”
He shrugged off the significance of the WEAC decision.
“Unions make endorsements,” Tate said Thursday. “That’s what they do.”

Kathleen Falk, the candidate from WEAC, says she wants to “undo the harm” that Governor Walker has done and is apparently willing to devastate Wisconsin in order to advance her agenda.

A year ago Pat Quinn, the ultra-liberal Governor of Illinois, faced many of the same challenges that Scott Walker faced. Instead of standing up to public employee unions and reining in spending, Quinn pushed for massive tax increases and business as usual.
So how did that work out?
In contrast to Governor Walker (who has an approval rating over 50%), Quinn has an approval rating of 30%! That’s right! 30%.
Let’s be real clear. Kathleen Falk is a slightly more opportunistic version of Pat Quinn with a Madison mailing address. The policies of Quinn have decimated Illinois. There’s absolutely no reason to think that they’d work any better in Wisconsin under Kathleen Falk.

The Morning Flap: February 9, 2012
These are my links for February 8th through February 9th:
- Where’s the Rest of Them? – The biggest problem with the GOP Presidential field is that each of the candidates seems to be running to represent only part of the Republican coalition. Mr. Romney sounds like he thinks conservatives can be won over with a few poll-tested lines like “I’ll repeal ObamaCare,” while Mr. Santorum sounds like he only needs conservative votes to become President. To adapt Ronald Reagan’s famous line, Where’s the rest of them?
- Path to a Brokered GOP Convention Emerges – For many conservative Republicans, the dream outcome of the primary season is a brokered convention. Disappointed in the four remaining choices, they hope to change horses in August, and draft their preferred candidate, be it Jeb Bush, Mitch Daniels, Chris Christie, or Paul Ryan.
I’ve been adamant that such an outcome is extremely unlikely. For a brokered convention to occur, there has to be an almost perfect storm of events; the GOP elites can’t just declare shenanigans on the primary season and select a new nominee. Instead, something has to prevent any of the current candidates from clinching a majority of the delegates; if one of them amasses that majority, he will be the nominee on the first ballot at the convention in Tampa.
My assumption — and the assumption of many — was that the GOP fight would eventually degenerate into an ideological battle between the very conservative and somewhat conservative/moderate wings of the party, with Romney on one side and a single alternative on the other. Unless there was a late entrant or Ron Paul caught fire in the caucus states, someone was virtually assured of claiming the requisite number of delegates in that scenario. But for the first time, the two way faceoff doesn’t seem inevitable, and a viable path to a brokered convention is beginning to emerge. Let’s start with something else I overlooked. The GOP does have super-delegates of a sort, in the form of the 63 RNC members. They aren’t as numerous as they are in the Democratic Party, but they are still there. While many of them have already declared allegiance to one candidate or another, those commitments can evaporate quickly, as Hillary Clinton learned to her sorrow in 2008.
- 20% of Republicans leaning to Obama! – For critics of Barack Obama, 2012 has been portrayed as a do-or-die year for the country – an election that will determine whether America stays on the road to European-style socialism or veers right to reclaim its positions as the most vibrant economy in the world and the home of individual liberty.
But the 2012 election is looking more like a replay of 2008 than a do-over.
The latest WND/Wenzel Poll shows none of the current crop of Republican presidential candidates has solidified the base of the party, with one in five GOP voters leaning toward support of Obama in November.
The results are from the public-opinion research and media consulting company Wenzel Strategies. The poll was conducted by telephone Feb. 1-3, 2012, and has a margin of error of plus or minus 3.44 percentage points.

- Keep an Eye on Ryan – Tomorrow night, Paul Ryan will speak at CPAC. National Review Online has obtained an embargoed copy of the speech. It’s powerful stuff. He’ll talk about how Republicans share responsibility for the fiscal crisis. And he’ll detail President Obama’s dismal record. But the big theme is that Republicans need to make 2012 more than a “referendum.” He wants it to be a “choice.”
“The easy way is always tempting,” he’ll tell conservatives, urging them to avoid a victory “by default.” Bold ideas, he’ll say, are the only way to win a mandate:

- Thoughts on the Ninth Circuit’s Same-Sex Marriage Decision – 1. This is going up to the Supreme Court. I suspect that the backers of Prop. 8 won’t even ask for en banc review by the Ninth Circuit, since they’re unlikely to win there. Depending on how quickly they file their petition for certiorari, the Court will either decide in late September to hear the case, or will decide this late this Spring. Either way, the Court will hear the case next Term, though probably not before the election. Though, for reasons I describe below, the decision only applies to states, like California, that recognized civil unions but not same-sex marriages, it’s still a conclusion of national importance, one on which the Supreme Court is likely want to speak. And even if, as described below, the decision is limited just to California, I think the Court will still think it’s important for it to resolve the question.
2. The Ninth Circuit did not decide that all opposite-sex-only marriage recognition rules are unconstitutional. Rather, it concluded that when a state has already recognized same-sex civil unions that are functionally equivalent or nearly equivalent to marriage, denying the symbolic recognition provided by the label “marriage” is no longer rationally related to a legitimate government interest. The court did not decide whether the general constitutional right to marry that applies to same-sex couples, or whether opposite-sex-only recognition rules are generally unconstitutional on the grounds that discrimination based on sexual orientation requires “strict scrutiny” or “intermediate scrutiny” and fails that scrutiny. It only applied the rational basis test, and held that the regime of civil unions but not same-sex marriage lacks a rational basis.
- Government Employer Free to Fire Human Resources Officials Who Publicly Criticize the Propriety of Gay Rights Laws – So holds Dixon v. University of Toledo (N.D. Ohio Feb, 6, 2012). (I blogged about this case when it was filed.) A few thoughts:
(1) Some of the analysis seems limited to high-level “policymaking” employees, such as a university Associate Vice President.
(2) But some of the argument suggests that any time any government manager with hiring and firing authority — or even with substantial input into hiring and firing decisions — speaks out in opposition to civil rights laws protecting gays, the government may fire the manager on the grounds that the speech (a) “could disrupt the … [d]epartment by making homosexual employees uncomfortable or disgruntled,” (b) might lead “homosexual prospective employees [to] reconsider applications,” and (c) might “lead to challenges to her personnel decisions.”
(3) This in turn highlights the danger to government managerial employees who want to participate in, for instance, campaigns opposing same-sex marriage or proposed laws banning sexual orientation discrimination. If you’re such an employee, you’d be wise to keep your mouth shut on such matters, whether it comes to letters to the editor, to blog posts, to yard signs, to campaign donations, or to signatures on initiative or referendum petitions (in states that disclose such signatures). After all, any of these might be noticed by people who will publicize what you said or did, and who will directly or indirectly inform your supervisors about it.

- Archbishop of San Francisco says Obama ruling strikes at religious freedom – Catholic Archbishop George Niederauer of the Archdiocese of San Francisco has written a letter that will be distributed at all Masses this weekend about the Obama administration’s decision to require Catholic institutions to administration would require Catholic institutions such as hospitals and universities to provide contraceptives under the Affordable Care Act. See Health and Human Services Secretary Kathleen Sebelius’ statement here.
The ruling has raised a huge row with many Catholics, who make up 27 percent of the electorate and constitute a large share of independents. They are also concentrated in the battleground states that will decide the presidential election. Catholic hospitals serve an estimated one sixth of the population. The Archdiocese of San Francisco includes San Francisco, San Mateo and Marin counties and includes, according to the Archdiocese, more than 550,000 Catholics.
- Babs Boxer Comes up with the Dumbest Defense (So Far) of the ObamaCare Abortifacient Mandate – This policy is among the most illiberal ever foisted on the American public by its elected officials. They literally lied, even to members of their own party, to get this policy passed along purely partisan lines. Their own leadership told us that we have to pass the bill even to find out what’s in it. One must be a fellow traveling liar, or simply intolerant to the core, to defend this affront.
Liberals claim the mantle of tolerance, but this policy is deeply intolerant. It forces aactions on a sizable number of Americans who disagree with undertaking those actions for reasons explicitly protected in the Constitution. The numerous ObamaCare waivers, granted mainly to unions that have supported Democrats with campaign cash, open up equal protection issues and expose the politics at the core of what was sold as a “health care” bill. It was a government power bill, from the start. And this mandate has placed the administration in a very awkward political spot. Continue the abortifacient policy to appease Boxer et al, but risk losing millions of votes that went Obama’s way in 2008. Or, scuttle it, and dispirit the illiberal, intolerant progressive mob.

The Archdiocese of San Francisco has called the rule an assault on religious freedom and the Obama administration is in damage-control mode with a critical voting bloc. Obama reportedly weighed the politics before approving the decision.
One analysis of these politics calculates that Obama’s decision will help him with young, secular women, Catholic or not, and that’s why the White House is standing firm while making noises about a compromise. Obama is touting the decision on his campaign website.
Writing in the Wall Street Journal, where the lead editorial lambasts the rule, Boxer and Democratic colleagues Patty Murray of Washington and Jeanne Shaheen, defend the decision and accuse its critics (led by the Catholic bishops and joined by GOP presidential candidates Mitt Romney and Newt Gingrich) of mounting “an aggressive and misleading campaign to deny this benefit to women,” that is “being waged in the name of religious liberty.”

A state Health Care Authority rule putting a three-visit limit on unnecessary ER use by poor patients was blocked in court on procedural grounds. The agency has replaced it with a new policy planned to take effect April 1 that would reduce the number of conditions deemed non-emergencies but would forbid even a single unnecessary visit.
The doctors and hospitals who sued over the old rule blasted the new plan Tuesday, saying it would leave it up to a “faceless bureaucrat” to decide what’s an emergency. They weren’t ready to say they’ll go to court again over it.
Medical providers would foot the bill if they treat patients and the state doesn’t pay. They couldn’t bill the patients, as was possible under the old rule, the Health Care Authority says.
“The client is not at risk anymore for the ER bills,” said Dr. Jeffery Thompson, chief of the state’s Medicaid program. “This is invisible to the client. The client’s going to get treatment regardless.”
The move is part of an ongoing attempt by state government to crack down on excessive ER use. Other kinds of treatment have such limits, Thompson says.
He points to patients seeking ER treatment for diaper rash and other ailments better treated by a primary-care doctor, and to hospital frequent fliers who show up twice a day, as he said one patient with obsessive-compulsive disorder did recently. The hope is to divert such patients to other providers.

The rise was driven mainly by increases in housing subsidies, an expansion in Medicaid and changes to the welfare system, along with a sharp rise in food stamps, the study found.

- Ninth Circuit to 7 Million California Voters: You Are Irrational Bigots – In a breathtaking exercise in ill-natured illogic, a divided Ninth Circuit ruled 2–1 that because Prop 8 does not take away civil-union benefits for same-sex couples, it’s an unconstitutional exercise in irrational animus towards gay people.Dishonestly, the court claimed it did not require any heightened scrutiny to reach this result.
The very timid dissent (“please don’t go after me!”) points out that Baker v. Nelson is ruling precedent and that the differences between same-sex and opposite sex couples in terms of the state’s interest in responsible procreation could be rationally related to a legitimate state interest.
Back in 2004, when we fought about a Federal Marriage Amendment, gay rights advocates said we were alarmists for claiming that they would go to federal court seeking a right to impose gay marriage on all 50 states.
That was so last decade.

- Obama super PAC decision: President blesses fundraising for Priorities USA Action – President Barack Obama — in an act of hypocrisy or necessity, depending on the beholder — has reversed course and is now blessing the efforts of a sputtering super PAC, Priorities USA Action, organized to fight GOP dark-money attacks.
On Monday morning, Obama reviled the “negative” tone of the super PACs, a dominant fundraising source in the wake of the Supreme Court’s Citizens United decision. But by the evening, word leaked to POLITICO that Obama had offered his support for Priorities USA Action, which thus far has raised a fraction of what GOP-backed groups have raked in.
Obama’s top campaign staff and even some Cabinet members will appear at super PAC events. The president himself will not address super PAC donors, although there’s nothing to legally prohibit the president, first lady Michelle Obama and Vice President Joe Biden from expressing their support for the group — as GOP presidential front-runner Mitt Romney has done for the super PAC that backs him.
“We decided to do this because we can’t afford for the work you’re doing in your communities, and the grass-roots donations you give to support it, to be destroyed by hundreds of millions of dollars in negative ads,” campaign manager Jim Messina told supporters in an email Monday night.
The timing of the announcement seemed rushed, several Democrats told POLITICO. It was made in a 10 p.m. call to Obama’s top bundlers, known as the National Finance Committee. Several party fundraisers raised the possibility that the campaign wanted to offset bad publicity generated by a Monday New York Times story, which reported that the campaign had returned $200,000 to the family of a wealthy Mexican fugitive seeking a pardon for drug and other criminal convictions.
- Obama campaign to support super PAC fundraising – In a change of position, Barack Obama’s reelection campaign will begin using administration and campaign aides to fundraise for Priorities USA Action, a super PAC backing the president.
Obama has been an outspoken critic of current campaign financing laws, in particular a Supreme Court ruling that allowed the creation of super PACs. Until now he has kept his distance from Priorities USA Action.
But in the wake of the group’s anemic fundraising, made public last week, the campaign decided to change its position, and announced the new stance to members of its national finance committee Monday evening.
Two Obama campaign aides confirmed that senior campaign and administration officials who participate at fundraising events for the president’s campaign will also appear at events for Priorities USA Action, the PAC supporting Obama.
“This decision was not made overnight,” one campaign official said. “ The money raised and spent by Republican super PACs is very telling. We will not unilaterally disarm.”
The president, first lady Michelle Obama, Vice President Joe Biden and Dr. Jill Biden will not appear at super PAC events, the aides said.
In an e-mail to supporters, Obama campaign manager Jim Messina said the decision was a reaction to massive fundraising posted by super PACs supporting GOP presidential candidates.
- Judge Michael Hawkins Is No “Moderate” – Lyle Denniston’s SCOTUSblog preview of tomorrow’s Ninth Circuit ruling in the Prop 8 case includes the assertion that one of the panel members, Clinton appointee Michael D. Hawkins, “is considered to be a moderate.” Hawkins has described himself that way—“I think of myself as being entirely moderate in all things”—but even he has hastened to add the disclaimer, “but others might say otherwise.” Indeed, they might.
As I reported when the panel members were initially made public, a source I trust told me that of the nearly 50 active and senior judges then on the Ninth Circuit, there were only five or six other judges who were as aggressively and reflexively leftist as Hawkins and his fellow panel member, the ultraliberal Stephen Reinhardt.
- Prop. 8: Final ruling due – The Ninth Circuit Court will issue a ruling tomorrow — apparently, in a single opinion — to decide the challenge to California’s ban on same-sex marriage, approved by the state’s voters more than three years ago. In a brief announcement Monday, the Circuit Court said it would issue an opinion at 1 p.m. Tuesday Washington time (10 a.m. in San Francisco) dealing both with the constitutionality of the measure (“Proposition 8″) and with the issue of whether the trial judge should have disqualified himself from the case.
The three-judge panel actually has three issues before it: whether the backers of Proposition 8 had a legal right to appeal the District Court ruling striking down Proposition 8 (the “standing” issue), whether — if “standing” to appeal did exist — the ballot measure is unconstitutional, and whether now-retired District Judge Vaughn R. Walker should have recused and thus whether his ruling should now be vacated by the Circuit Court.
Although the wording of the announcement Monday was not entirely clear and made no promises about the scope of the ruling, it could be interpreted as indicating that the panel will find that the measure’s proponents did have the right to appeal, and thus the panel would be free to move on to rule on the merits and on the disqualification issue. Given the makeup of the panel and the past records of the three judges, the chances would appear to be quite strong that Proposition 8 would be struck down.

The company says 26 Fisker employees have been let go from the Delaware factory where renowned automotive engineer Henrik Fisker promised to one day begin producing affordable electric sedans. A Delaware newspaper also reported that subcontractors working on the car venture have been let go.
“It’s temporary,” said Roger Ormisher, a company spokesman. “We’re being prudent and sensible as a company.”
Because the initial phase sounds like it’s been such an unqualified success, the company is asking for terms of the federal loan to be altered so the company can have faster access to their line of time-released taxpayer-backed credit:

The battleground is this: The Secular Left is on the offensive, while the oft-demonized Religious Right is mostly playing defense, trying to preserve the liberty of religious adherents to conduct their lives according to their own consciences.
“The right’s recent jihad against Planned Parenthood is about as loathsome as anything I’ve ever seen come out of them,” seethed Mother Jones writer Kevin Drum after Susan G. Komen for the Cure, a leading breast-cancer charity, briefly decided to not give new grants to Planned Parenthood for the coming year.
Drum was writing about conservatives’ opposition to taxpayer subsidies for Planned Parenthood, and, in this case, a charity under pressure from pro-lifers temporarily suspending funding for the abortion provider. It’s a peculiar “jihad” whose main weapon is refusing to give away your money to the enemy.

- High-speed rail tapped state funds for unusual lobbying contract – In an extremely unusual use of taxpayer money, the leaders behind California’s $99 billion high-speed train quietly hired a lobbyist to sway the Legislature — the same politicians who appointed them to build the project in the first place.
Documents filed this week show the California High-Speed Rail Authority last year paid $161,103 to one of the country’s biggest public relations firms to lobby the state’s politicians as they consider spending $2.7 billion to launch the polarizing bullet train project.
Rail officials paid the lobbyists by issuing debt that will total about $300,000 with interest. It must be paid back through California’s impoverished general fund budget.
High-speed rail officials defended the spending as a “vital need” when their staff was too small. But both Democratic and Republican lawmakers and even die-hard bullet train backers decried the lobbying as a wasteful and unethical use of taxpayer funds, saying it essentially amounts to the state spending money to lobby itself.
“That is appalling to me. I’ve never heard of such a thing,” said Quentin Kopp, who helped launch the rail authority and was its longtime chairman before retiring in March. He said he never approved the expenses and that the state should go to court to keep the money. “That’s nonsense, absolutely nonsense. It’s embarrassing.” - Obama administration rejects California’s Medi-Cal copays – Federal health officials rejected California’s bid to charge Medi-Cal copayments for everything from drugs to hospital visits, dealing a new blow to the state budget but relief to low-income patients and their providers.
Gov. Jerry Brown and lawmakers relied on mandatory Medi-Cal copayments to save $511 million in last year’s state budget and presumed that the state would continue saving in future years.
The governor’s latest budget, which estimates a $9.2 billion deficit, acknowledges the lost savings in 2011-12. But it is relying on $296 million to help balance next year’s budget, according to Department of Finance spokesman H.D. Palmer.

- In Arizona, Obama Approval at 41% – Many Democrats have high hopes for the Southwest in Election 2012 and some even think that President Obama even has a decent shot to move Arizona from Republican to Democrat in the Electoral College column this November. However, the president may have an uphill fight to achieve that goal as most voters in the Grand Canyon State disapprove of the way he’s done his job.
A new Rasmussen Reports telephone poll found that just 41% of Likely Voters in Arizona approve of the way President Obama has performed his role. Fifty-six percent (56%) disapprove. Those figures are significantly lower than the president’s national ratings. They include 28% who Strongly Approve and 48% who Strongly Disapprove.

In an attempt to tarnish Mitt Romney’s conservative credentials, Newt Gingrich on Tuesday connected Romney to Florida’s former governor, the once-ambitious moderate who fell so far out of favor with the GOP that in 2010 he left the GOP.
“We discovered last night that Mitt Romney has picked up Charlie Crist’s campaign manager,” Gingrich said Tuesday at the Tick Tock Restaurant in St. Petersburg. “I thought that told you everything you need to know about this primary.”
“As governor of Massachusetts [Romney] was pro-abortion, pro-gay rights, pro-tax increase and pro- gun control,” he said. “Now that makes you a moderate in Massachusetts but it makes you pretty liberal in a Republican primary. That’s probably why he hired Charlie Crist’s staff.” - Gov. Daniels: Obama is ‘pro-poverty’ – Indiana Gov. Mitch Daniels (R) castigated President Obama’s policies as “pro-poverty” and extreme in his response to the State of the Union address.
The Indiana governor, who considered a run for the White House before deciding last year against a campaign, knocked Obama for imposing regulations on business and for rejecting the proposed Keystone oil pipeline.
He labeled Obama’s policies as “pro-poverty and extremism that stifles the development of homegrown energy, or cancels a perfectly safe pipeline that would employ tens of thousands, or jacks up consumer utility bills for no improvement in either human health or world temperature.”
Daniels said Obama’s “trickle-down government” policies has restrained the country’s economic growth.Daniels also criticized Obama for trying to divide people with class warfare. “No feature of the Obama presidency has been sadder than its constant efforts to divide us, to curry favor with some Americans by castigating others,” he said

- Ron Paul’s Secret Plan To Actually Win – Ron Paul — poised to finish strong in the Iowa caucuses – has begun to implement a quiet, complex plan to force a long battle with Mitt Romney for delegates to the Republican National Convention in August. His advantages: Experience, organization, and the legacy of the 2010 Tea Party revival, which convinced Republicans that anti-government figures like Paul just aren’t as weird as they’d thought.
Paul is following the roadmap set by Barack Obama’s 2008 strategy: Start early, learn the rules, and use superior organization and devoted young supporters to dominate the arcane but crucial party procedures in states your rivals are ignoring — states where caucuses and conventions that elect the delegates who will ultimately choose the Republican candidate. The plan begins in places like Minnetonka, Minnesota, a Minneapolis suburb where Paul has based his state headquarters, and where staffers have already begun running “mock-auses” — practice runs for Minnesota’s February 7 caucuses.
Paul’s rivals dismiss his chances. “Ron Paul’s not going to be our nominee,” Mitt Romney said flatly in December. But Paul’s organization is girding for the long haul, and while the 76-year old Texan is vanishingly unlikely to be the nominee — primaries in big states like New York and California could shut him out — observers in the caucus states say they expect Paul to win, and perhaps sweep, dozens of delegates from unexpected corners of the map. Those delegates, in turn, will give him at least a prominent position at the Republican National Convention, and a plausible shot at emerging as a kingmaker if a strong mainstream challenger to Romney emerges.

- Occupy protest follows 123rd annual Rose Parade – The 2012 Tournament of Roses brought its flowery floats and strutting bands to a worldwide audience Monday under clear blue skies, and in its wake came a scruffier parade – thousands of anti-Wall Street protesters.
The 123rd annual New Year’s Day event, with the theme “Just Imagine,” flowed along downtown Pasadena to the cheers of hundreds of thousands of sidewalk spectators.
An estimated 40 million people viewed this year’s procession of 44 floats, 16 marching bands and 22 equestrian troupes on U.S. television.
There were 10 arrests overnight, including four felonies, as thousands of spectators staked out viewing places along the route but that figure was down from the previous year, police said.
“Everything went very, very well. We’re very pleased,” police Lt. Phlunte Riddle said.
- Sinaloa Cartel Shifting Meth Production to Guatemala – The Sinaloa Cartel, already thought to be the largest supplier of methamphetamine to the US, may be shifting production southwards to Guatemala. This forms part of a larger trend, in which Mexican groups appear to be shifting many of their operations into Central America.
The Associated Press reports that the seizure of precursor chemicals to produce methamphetamine is spiking dramatically in Guatemala. In 2011, authorities seized about 1,600 tons of precursor chemicals, four times the amount seized in 2010. Much of the trade is thought to be controlled by the Sinaloa Cartel.
InSight Analysis
Such reports point to a key trend previously identified by InSight Crime: the shifting of drug production into Central American nations that are not prepared to confront the Mexican cartels. There have already been some signs that drug trafficking organizes have moved their cocaine-processing infrastructure into the region, with laboratories discovered in Honduras and Guatemala. Nicaragua saw its first ever meth lab dismantled in 2009. If Mexico’s meth production is moving southwards into the Northern Triangle, it is one more indication that the region is increasingly seen as a safer environment for the drug trade.
The shift into Guatemala could also be a sign sign that law enforcement efforts in Mexico are working. Both US and Mexican authorities seized a record amount of meth along the US-Mexico border last year. Another deterrent was Mexico’s decision to ban imports of pseudophedrine and ephedine, key ingredients in meth production, in 2008.
The AP report also supports the hypothesis that the Sinaloa Cartel is expanding its hold on the methamphetamine trade. This includes taking over the network once controlled by the Familia Michoacana. The Sinaloans are now thought to be the largest distributors of meth inside the US.
