• Kerry defends liberties, says Americans have right to be stupid – Secretary of State John Kerry offered a defense of freedom of speech, religion and thought in the United States on Tuesday telling German students that in America “you have a right to be stupid if you want to be.”
• Rothenberg: Can Obama Put the House In Play in 2014? – It’s far too early to know whether Democrats will have some, or even any, chance to win back the House next year; candidate recruitment has just begun, the number of retirements (and open seats) is uncertain and the president’s popularity more than 20 months from now is an open question. But we do know that history, as The New York Times’ Nate Silver pointed out in a column last November, suggests that Democrats will have a very tough road to 218 seats.Going back to the election of 1862, the only time the president’s party gained as many as 10 seats was, well, never. Even in 1934, the best showing by the president’s party in House elections since the Civil War, the president’s party gained only nine seats.

• Poll: Hispanics heavily Democratic – Hispanics in America are more than twice as likely to lean Democratic than Republican, a new poll says.Fifty-one percent of Hispanics identified as Democrat or leaned Democrat, compared with 24 percent who said they were Republican or leaned GOP, according to a Gallup poll out Monday. Twenty percent identified themselves as independent. The rest are undecided or did not respond.

Dianne Feinstein and other key senators, proposing a retooled federal ban on assault weapons in the wake of the deadly Newtown school shooting.Sen. Richard Blumenthal told The Associated Press on Wednesday that the proposed legislation, to be unveiled Thursday in Washington, D.C., will more narrowly define what’s considered an assault weapon under a resurrected ban. The bill, he said, will also prohibit high-capacity magazines, limiting them to a capacity of up to nine rounds of ammunition.Blumenthal said the legislation is “one of the most significant” bills to be introduced following the Dec. 14 massacre at Sandy Hook Elementary School. • Why Democrats Should Fear Filibuster Reform – The latest word out of the Senate is that if Republican Minority Leader Mitch McConnell doesn’t accede to changes in the filibuster rules over the next few days, Harry Reid will invoke the so-called “nuclear option” and change the rules with 51 votes. The most likely outcome would be outlawing the filibuster on motions to proceed, thereby forcing senators to take to the floor to filibuster bills, “Mr. Smith”-style.This move, and the overwhelming progressive enthusiam for it, are head-scratchers. Over the short-to-medium term (and no one can really see beyond that), the filibuster probably helps the Democrats more than it helps the Republicans.  Before going any further, let me make clear that the following argument is couched purely in terms of political advantage and ability to move the agenda. I think there’s a lot to be said for what we might call the small-”c” conservative arguments for the filibuster: requiring 60 votes creates the need for some sort of consensus before legislation moves through, and the chances of a destabilizing period of time where parties trade majorities and implement wildly divergent agendas willy-nilly are greatly diminished. In that sense, the filibuster helps the entire country, and both parties should be pleased with it.
• Whole Foods’ CEO Mackey Is Right — ObamaCare Is Like Fascism – In 2009, when Whole Foods CEO John Mackey in a Wall Street Journal op-ed compared the health care “public option” then under consideration by Congress to socialism — a nationalized economic system wherein the government owns the means of production — hardly anyone batted an eyelash.Sure, at the time, the left-wing site Daily Kos called for a boycott. And a Facebook group at the time managed to find a couple hundred users angry about the characterization. Whole Foods set up a special forum for customers to express their views on the op-ed.But it was hardly the response Whole Foods got when on Jan. 16 in an NPR interview, Mackey was asked a follow-up question on what he thought about the current law.After all, the “public option” was never adopted. What came afterward, now known in popular vernacular as ObamaCare, was a mishmash of mandates, regulations and price controls — but fell short of an outright nationalization of the insurance industry.

  That was when Mackey used the F-word. No, not that one. The other one.

Writing in The New Republic, Galston writes:The Obama administration will need to recognize the fervent opposition of small businesses to its priorities, while taking advantage of large corporations’ willingness to cooperate.Galston is exactly correct about the alignment of interests. He’s an unabashed liberal determined to shift our politics and our country irrevocably to the left. In other words, Obama’s foes — if you put aside the birthers and sundry other lunatics — always had him pegged correctly.

• The GOP Gets Fiscally Tough – House Republicans appear to have gotten some of their mojo back. GOP leaders say they will insist that automatic spending cuts (the “sequester”) scheduled to begin on March 1 will be made and that the House will adopt a budget resolution that would lead to a balanced budget within ten years without raising any more taxes. Just a few months ago, they were singing a different, less fiscally tough tune.On Wednesday, the House suspended the limit on the nation’s debt ceiling. That gives Republican lawmakers nearly four months to sort out what they will demand in exchange for raising it and puts that potentially market-spooking debate off until after budget battles over the scheduled sequester cuts and the expiration on March 27 of a continuing resolution to fund the government. Republicans view the political terrain on those issues as more favorable than that of any confrontation with President Obama and Harry Reid’s Senate over further spending cuts.

• Germany says renegotiating EU pact ‘not possible’- The German government on Monday ruled out reworking the European Union’s fiscal pact despite calls to do so by French president-elect Francois Hollande.”It is not possible to renegotiate the fiscal pact,” government spokesman Steffen Seibert told a regular news conference.He noted that 25 of the 27 EU member states had already signed the accord imposing strict budgetary discipline in March after major wrangling.

  Hollande has called for a shift in strategy toward more growth-oriented measures including more public spending.

  But Seibert said Merkel would not accept “deficit spending” to feed economic expansion, and believed in “growth through structural reforms” such as reducing the cost of job creation as pursued by Germany over the last decade.

  Yet he dismissed suggestions that the apparently conflicting policies would put Merkel on a collision course with Germany’s closest ally, insisting she was ready for an open dialogue.

  “We will see what proposals and ideas he has and go from there,” Seibert said, referring to Hollande.

  He noted that Merkel was also a firm believer in promoting growth as a path out of the debt crisis.

  “Growth is not a new issue but rather the second pillar of our fiscal policy, and not just since yesterday,” he said.

• Hollande faces battle with Berlin over growth- Fresh from the election campaign, president-elect Francois Hollande faces a new battle with France’s European partners, in particular Germany, to add a growth pact to balance the EU’s new compact on strict budgetary discipline.The handover of power by Nicolas Sarkozy should take place by May 15 at the latest, but the Socialist will immediately begin consultations with EU partners on his emblematic campaign initiative, according to his advisors.The goal is to advance the proposal on a growth compact to the stage of a memorandum that would be transmitted to European capitals for consideration by the end of the month.

  The fiscal compact treaty requiring cutting deficits and debt was signed at the beginning of March by 25 EU states and has already been ratified by several.

• Socialist Hollande triumphs in French presidential poll- François Hollande has won France’s presidential election, giving the country its first Socialist president in almost two decades, exit polls showed Sunday.According to Ipsos polling institute, the left-wing candidate took 51.7% of the vote to incumbent Nicolas Sarkozy’s 48.3%.Celebrations are underway at the iconic Place de la Bastille in central Paris, the same spot where the last Socialist to win a presidential election, François Mitterrand, celebrated his first victory back in 1981.

• Hispanic Growth Ahead of Political Participation – The Texas Tribune's Ross Ramsey makes an important point that often gets overlooked in the discussion about rapid Hispanic growth across the country.

  As the newly-released 2010 Census figures illustrate, the growth among Latinos across the country is impressive and has made battleground Southwestern states more Democratic in recent years. Democrats, like Democratic Senatorial Campaign Committee Chair Patty Murray are openly talking about contesting Texas in next year's Senate election

  But growth isn't the same as voter participation. And Hispanics aren't participating at nearly the same rate as non-Hispanics – and there are few signs that's changing anytime soon.

  Ramsey points to his home state of Texas as an example. The population of the Republican-friendly Dallas suburb of Collin County (782,341) is about the same as the Democratic-friendly, heavily-Hispanic El Paso County (800,647). But voter turnout last year was nearly twice as high in Collin County than in El Paso, 156,668 to 88,505.

  It's a similar situation in Arizona, where Rep. Raul Grijalva (D-Ariz.) found himself in a surprisingly close contest last year, even though his district is majority-Hispanic and solidly Democratic. But voter participation there was just under 160,000 – one of the lowest totals in any House district in the country – meaning a relatively small proportion of Latinos actually showed up at the polls.

  It's something to consider as we look at the presidential battlegrounds, where President Obama is counting on significant Hispanic turnout and support to contest pivotal states like Florida, Nevada, Colorado and even Arizona. Democrats have been more effective at registering Hispanic voters in Nevada, but less so in Arizona and Texas where turnout has been anemic in many of the heavily-Hispanic seats.

  President Obama will have a difficult time turning out Hispanic voters unless he turns up the PANDER machine pretty quickly.

  With a GOP House, any such attempt will go nowhere as will the Hispanic vote for him in 2012.

• Employees Now Asking Companies to Leave California – While Sacramento remains fuzzy-headed about California's hostile business climate, the state is experiencing the fastest rate of company out-of-state and out-of-country relocations since I put a specialized tracking system into place two years ago. Activity from Jan. 1 through April 12 of this year shows that 69 California company disinvestment events have occurred, an average of 4.7 per week – greater than the 3.9 average per week last year.   By the way, the number one location for California companies to relocate to, or to divert capital for facilities that in the past used to be built here, is Texas with 14 such events.

  And, when utility costs go up because of legislation Jerry Brown signed this past week, more will leave or refuse to relocate to California.
