BLOW TO CAMPAIGN: Gov. Arnold Schwarzenegger returns to his office after his news conference Thursday. His inability to strike a deal on the public works plan underscores the continuing trouble he faces in trying to recover from the political damage left by his failed pursuit last year of an agenda that enraged organized labor.

Gov. Arnold Schwarzenegger’s failure to persuade lawmakers to put a vast public works plan on the June ballot denies him a concrete achievement that he counted on using as a centerpiece of his reelection campaign.
The setback is especially sharp for Schwarzenegger because both of the Democrats vying to replace him argue that he has accomplished little as governor and, more broadly, is unqualified for the job.
NEVER has Flap seen a politician with such promise self-destruct in so short of time. Arnold has been a disaster as California Governor. He, like Jesse Ventura, the former Governor of Minnesota has morphed from a popular entertainment celebrity to an unpopular “empty suit” politician who can and will accomplish nothing.

Flap handicaps Schwarzenegger’s re-election at less than a 50-50 chance. His poll numbers are low, he has NO major accomplishments to his credit since he replaced Demcorat Gray Davis and he has alienated his Republican Party base. This is a recipe for electoral disaster.
Arnold’s only hope for re-election (slim that it is) is that California Controller Steve Westly and California Treasuer Phil Angelides beat each other to a pulp prior to the June primary election. In Flap’s estimation, Westly is winning the media war with Angelides.
A Westly vs. Schwarzenegger contest will NOT be pretty for the California GOP. Westly will slaughter the governor and all of the down ticket Republican candidates. In fact, Flap does not foresee one Republican winning a state constitutional office this year.
Did the California Republican Party err in recalling Gray Davis and installing the Governator?

Los Angeles Times: Bratton, Baca Support Attempts to Reform Three Strikes Law
The law enforcement officials back efforts to restrict harsh sentences to those whose third offense is a serious or violent crime.Los Angeles Police Department Chief William J. Bratton and Los Angeles County Sheriff Lee Baca have joined an effort to rein in California’s three strikes sentencing law.
Los Angeles County Dist. Atty. Steve Cooley, who is pushing a ballot initiative to soften the tough law, said at a news conference Thursday that he had won the chiefs’ backing.
Well, Steve Cooley has the Chief’s backing before this attempt to change the Three Strikes Law becomes eligible for the California ballot.
Why is there a need for the change?
BECAUSE……..
Cooley and the San Francisco County District Attorney are NOT enforcing the current Three Strikes law……
Cooley said while Los Angeles and San Francisco counties only use three strikes against violent offenders, the policy should be uniform.
“It’s great if it happens most of the time,” Cooley said. “But when you write something down and make it a law, you make sure it happens all the time.”Flap thinks D.A. Steve Cooley BETTER enforce the CURRENT law before seeking endorsements to CHANGE it!
Cooley has long criticized the breadth of the state’s law, which sometimes results in sentences of 25 years to life for those whose third strikes were nonviolent or minor crimes. His ballot initiative, coauthored with defense lawyer Brian Dunn, would limit third strikes in most cases to violent or serious offenses.
Cooley’s proposed initiative does not attempt to redefine first and second strikes and will likely make fewer inmates subject to re-sentencing. “This is a much narrower, focused effort,” Cooley said.
Cooley, there needs to be NO effort.
Either ENFORCE the law or RESIGN.

Schwarzenegger ducks ‘gladiator’ controversy
Gov. Arnold Schwarzenegger canceled his plans Friday to lend his star power to a controversial card of “gladiator” style bouts, acting quickly to end a day of controversy that had complicated his negotiations with legislative Democrats over his huge public-works financing proposal.
The governor decided not to attend a card of mixed martial arts matches just hours before the event was to begin Friday night at the Nationwide Arena before a nationwide pay-per-view TV audience.
The promoters for the fights had touted the governor’s appearance for months at the mixed martial arts event, which was the opening highlight of the Arnold Fitness Expo and Arnold Classic, a sports festival that is expected to draw 120,000 people by the time it ends Sunday.
So, Arnold wants to avoid controversy. But, the folks in Ohio wanted to see him at the extreme fight event. And Californians want to know why he is in Ohio and not doing the state’s business?
The governor signed a law in September legalizing mixed martial arts bouts in California after a series of rules changes that organizers say have made the fights less brutal. Such bouts still are illegal in all but a handful of states.
Schwarzenegger flew to Columbus on Friday after attending the funeral in San Bernardino of California Highway Patrol officer Gregory Bailey, who was killed by a suspected drunken driver last Saturday. He attended the finals of three of the Arnold Classic’s women’s body building and fitness competitions — Ms. International, Fitness International and Figure International — but skipped his scheduled appearance at the final mixed martial arts bouts, where he was to present a lifetime-achievement award to former heavyweight boxing champion Joe Frazier. Instead, Columbus Mayor Michael Coleman, booed by the crowd expecting Schwarzenegger, gave Frazier the award.
The governor, in an interview late Friday night at his hotel, said he knew his schedule included an award presentation to Frazier, but learned from The Chronicle story that the appearance was at the mixed martial art event.
“I’m not against it,” Schwarzenegger said of the mixed martial arts competition. “(But) I knew nothing about it (in advance).”
Well, now he says he knew nothing about the event…….

San Francisco Chronicle: Governor to star as gladiator ‘god’
Schwarzenegger to appear at blood-and-guts kickoff to fitness expo in Ohio
It’s touted in ads as “pure might battling pure fear,” a marriage of “raw power and brute force” complete with girls, guts, blood and plenty of grit.
And while so-called gladiator or ultimate fighting has gained legions of new fans and celebrity supporters nationwide, the planned appearance of Gov. Arnold Schwarzenegger at a major pay-per-view fight in Columbus, Ohio, this weekend could fire up not only sports aficionados but the governor’s critics as well.
That’s especially true because Schwarzenegger signed legislation in September paving the way for such fights to be legal in California — where the first such state-sanctioned card is planned at the HP Pavilion next week in San Jose.
The sport, also known as cage fighting or mixed martial arts, has been blasted by Sen. John McCain, R-Ariz., as “barbaric” cockfighting with humans. New York state banned the practice several years ago after Gov. George Pataki called it a “Neanderthal sport.’‘
Well, you can take the politician out of Conan the Barbarian but you cannot take the Barbarian out of the politico……….
Schwarzenegger is scheduled to make a star turn Friday at a “gladiator” match called the Gracie Fighting Championships, touted as the spectacular kickoff to the Arnold Fitness Expo and Arnold Classic, which features amateur and pro fitness competitions, challenges and expos in 30 sports this weekend in Columbus.
Fight night at Columbus’ Nationwide Arena will draw an estimated 8,000 fans and a live pay-per-view audience of at least 300,000 more. Organizers say “some of the toughest fighters on the planet” will engage in five-minute freestyle “mixed martial arts” matchups using a potent blend of karate, boxing, wrestling, Thai kickboxing, judo and ju jitsu.
While the political pundits and pollsters debate whether this hurts or helps Schwarzenegger’s reelection chances, Flap says enjoy the show…………well at least this portion of the Arnold’s Classic:

The California Field Poll March 1, 2006:SCHWARZENEGGER JOB RATINGS IMPROVE A BIT. VOTERS LIKE MOST,BUT NOT ALL, OF HIS INFRASTRUCTURE BONDS PROPOSALS.The latest Field Poll finds 40% of voters approving of Schwarzenegger’s performance in office, while 49% disapprove. While still more negative than positive, this represents a slight improvement in voter assessments of the Governor since October, when 37% approved and 56% disapproved of his performance.
A seven point improvement in the Governor Schwarzenegger’s disapproval ratings. Is the Governor’s swing to the LEFT responsible or was the depressed poll rating this past October the result of the millions spent by California unions in negative television ads leading up to the disaster of the November 2005 California Special Election? Hard to say and certainly not a polling result that would make an incumbent governor pleased – no matter what the spin.
But, there is better news for Arnold on his infrastructure bond proposal.

Voters favor by a two to one margin the Governor’s proposal to place a series of state bonds for infrastructure projects before voters over the next ten years. However, there is significant variation in the degree of voter support for specific bonds depending on the purposes they would be used for. Large majorities are inclined to support bonds that would underwrite road construction and repair, educational facilities, water systems and flood control, the seismic retrofitting of hospitals, public transportation, affordable housing, and parks. By contrast, voters oppose issuing state bonds for prison construction and renovating the courts, and are divided with regard to issuing bonds to expand the state’s port facilities.
Californians understand the immediate need for infrastructure improvements. California needs them and Schwarzenegger is opportune in his proposal. The Governor will run on his proposal in the Fall and MAY win reelection as a result.
The photo opportunity and tour of California levees with Senator Dianne Feinstein last week was a good move and will demonstrate the bipartisan support for California infrastructure improvements. And if the Governor does NOT obtain federal money, then he will obtain the necessary funding himself.
The Governor has a new election team and look for more bipartsian themes coming from the campaign office. Arnold is RIGHT on the infrastructure program – no matter what the cost. Simply put – California NEEDS it and the voters SUPPORT it.
Will it be ENOUGH to overcome his negative voter perceptions?

Hollywood liberals drive productive Californians to leave the state.It takes hard work to drive anyone away from California’s sunshine and scenic vistas, but politicians in Sacramento have been up to the task.
But the worst growth killer may well be California’s tax system. The business tax rate of 8.8% is the highest in the West, and its steeply “progressive” personal income tax has an effective top marginal rate of 10.3%, or second highest in the nation. CalTax, the state’s taxpayer advocacy group, reports that the richest 10% of earners pay almost 75% of the entire income-tax revenue in the state, and most of these are small0business owners, i.e., the people who create jobs.
And things may soon get worse, thanks to Rob Reiner, who played the liberal “Meathead” on the “All in the Family” sitcom in the 1970s and now plays the same part in real life. He and his rich Hollywood friends have put an initiative on the state’s June ballot that would add a 1.7-percentage-point income-tax surcharge on “millionaires” with income over $400,000, with the proceeds earmarked for universal pre-school.
Class warfare politics – don’t you love it. Soak the rich to pay for universal pre-school because President Bush and Governor Arnold Schwarzenegger will NOT enforce the immigration laws with Mexico and Central America. After all, who is the beneficiary of universal pre-school?Meathead Rob Reiner has helped qualify Proposition 82 (Preschool Education. Tax on Incomes Over $400,000 for Individuals; $800,000 for Couples. Initiative Constitutional Amendment and Statute.) for the California June ballot. As Chairman of First 5 California Children and Families Commission Reiner used taxpayer money (from a tobacco tax surcharge) to air televison ads clearly in support of qualifying the initiative, Proposition 82 for the ballot. So, what will Proposition 82 do to California taxpayers?
All of this has contributed to the trend of wealthy taxpayers disappearing from the state. State finance office data indicate that the number of Californians reporting million-dollar incomes fell to 25,000 in 2003 from 44,000 in 2000. That decline has cost the state $9 billion a year in uncollected tax revenues. The dot-com implosion of 2000 and 2001 no doubt wiped out many paper millionaires, but migration out of the state to escape its hefty tax premium has also played a role. Republican Assemblyman Ray Haynes notes that the average high-income individual can buy a newly built house in neighboring Nevada and pay for it just from the money saved in a year of not paying California taxes.
The state has been here before, as a new report from economist Arthur Laffer reminds us. In the early 1990s under Republican Governor Pete Wilson, the state raised its top income-tax rate to 11%, triggering one of the worst fiscal crises in the state’s history. Tax revenue fell as high-income people fled the state, while public debt exploded. That tax surcharge was removed in 1995, but now the state’s politicians want to do it all over again.
Why, of course, high income earners will simply shift residency or their businesses to neighboring Nevada or Arizona. Some will just leave California as many of Flap’s patients and colleagues have done over the past decade. After all, why pay for illegal immigrant’s childrens pre-school? California taxpayers paid for OUR childrens pre-school with AFTER-TAX dollars and what help did we receive from the State of California?
But, you say, it is only the rich that will pay. Does the reader really believe this program will be any different than K-12 public education in California? Will the program expand with the growth of illegal immigration? Will the unions bid up the pay and benefits for the teachers and school workers? Once establsihed as an entitlement will it be hard to resist lowering the tax surcharge threshold or pay for it with California general fund monies?
You betcha on all counts…….

The California Republican Party on Saturday sought to defuse criticism of Gov. Arnold Schwarzenegger and rally support from a divided membership as it struggled for unity at the start of a pivotal election year.
At stake, they were told, are a second term for Schwarzenegger and whether the party can build on the momentum of the 2003 recall election that brought him to power.
“What do you think are greater — the differences among us as Republicans or the differences between us and the Democrats?” state Sen. Tom McClintock, a candidate for lieutenant governor, told hundreds of members attending the GOP’s winter convention. “This is the election that will decide whether the recall was a fleeting curiosity or whether it was an historic turning point.”
Schwarzenegger’s poll numbers are dismal among the GOP and now he NEEDS McClintock to FLACK for him?
How about if the Governor enacted policies that reflected Republican core ideals.
Is this asking too much?
“I don’t agree with the governor on everything, but I still support him,” McClintock said to a packed convention hall, a day after Schwarzenegger addressed the convention and told party members that they share common goals.
McClintock urged the GOP to show a “solid and steadfast commitment” to the party’s principles and the direction set by Schwarzenegger.
Everyone knows that McClintock has always been a poor political fundraiser. In fact, he has had few jobs outside of government that qualify him for higher office (much like his Ventura County chort, California State Superintendent of Public Instruction, Jack O’Connell) and the donors know this. With Schwarzenegger he has found a willing “BANK” for his Lt. Governor race.
This display by Tom really is quite sad and pathetic.
And not everyone is buying the McClintock spin……
Some of those who have led the criticism of Schwarzenegger remained unconvinced.
Republican candidates for statewide office traditionally need at least 80 percent of the party vote to win, and at this point Schwarzenegger “doesn’t have that,” said Michael Spence, who heads the California Republican Assembly, a conservative wing of the party.
Regarding Schwarzenegger’s appeal for unity, he said, “I don’t care what he says at this point. I care about what he does.”
Will the call for UNITY ignite the GOP base to turn-out and vote for Arnold in November?
Doubtful……

Los Angeles Times: Reiner Takes a Leave From Panel on Children
Facing pressure from legislators and others, producer Rob Reiner said Friday he is taking a leave as chairman of a state commission that spent $23 million for ads touting the value of early education while he is promoting a statewide preschool initiative.
Reiner took the action in a letter addressed to Gov. Arnold Schwarzenegger. The leave takes effect immediately and will last until June 7, the day after voters decide the fate of Proposition 82, a Reiner-backed initiative to raise taxes on wealthy Californians to pay for preschool for all 4-year-olds.
