- Feinstein, Conn. Senators Set To Propose Assault Weapons Ban – Connecticut’s two U.S. senators are joining forces with California Sen. Dianne Feinstein and other key senators, proposing a retooled federal ban on assault weapons in the wake of the deadly Newtown school shooting.Sen. Richard Blumenthal told The Associated Press on Wednesday that the proposed legislation, to be unveiled Thursday in Washington, D.C., will more narrowly define what’s considered an assault weapon under a resurrected ban. The bill, he said, will also prohibit high-capacity magazines, limiting them to a capacity of up to nine rounds of ammunition.Blumenthal said the legislation is “one of the most significant” bills to be introduced following the Dec. 14 massacre at Sandy Hook Elementary School. It also marks the first bill that Blumenthal and Sen. Chris Murphy have worked on together as senators.

- Why Democrats Should Fear Filibuster Reform – The latest word out of the Senate is that if Republican Minority Leader Mitch McConnell doesn’t accede to changes in the filibuster rules over the next few days, Harry Reid will invoke the so-called “nuclear option” and change the rules with 51 votes. The most likely outcome would be outlawing the filibuster on motions to proceed, thereby forcing senators to take to the floor to filibuster bills, “Mr. Smith”-style.This move, and the overwhelming progressive enthusiam for it, are head-scratchers. Over the short-to-medium term (and no one can really see beyond that), the filibuster probably helps the Democrats more than it helps the Republicans. Before going any further, let me make clear that the following argument is couched purely in terms of political advantage and ability to move the agenda. I think there’s a lot to be said for what we might call the small-“c” conservative arguments for the filibuster: requiring 60 votes creates the need for some sort of consensus before legislation moves through, and the chances of a destabilizing period of time where parties trade majorities and implement wildly divergent agendas willy-nilly are greatly diminished. In that sense, the filibuster helps the entire country, and both parties should be pleased with it.
- Whole Foods’ CEO Mackey Is Right — ObamaCare Is Like Fascism – In 2009, when Whole Foods CEO John Mackey in a Wall Street Journal op-ed compared the health care “public option” then under consideration by Congress to socialism — a nationalized economic system wherein the government owns the means of production — hardly anyone batted an eyelash.Sure, at the time, the left-wing site Daily Kos called for a boycott. And a Facebook group at the time managed to find a couple hundred users angry about the characterization. Whole Foods set up a special forum for customers to express their views on the op-ed.But it was hardly the response Whole Foods got when on Jan. 16 in an NPR interview, Mackey was asked a follow-up question on what he thought about the current law.After all, the “public option” was never adopted. What came afterward, now known in popular vernacular as ObamaCare, was a mishmash of mandates, regulations and price controls — but fell short of an outright nationalization of the insurance industry.
That was when Mackey used the F-word. No, not that one. The other one.

Writing in The New Republic, Galston writes:The Obama administration will need to recognize the fervent opposition of small businesses to its priorities, while taking advantage of large corporations’ willingness to cooperate.Galston is exactly correct about the alignment of interests. Big Business tends to do well when government intervenes. Small business dies.

GOP leaders say they will insist that automatic spending cuts (the “sequester”) scheduled to begin on March 1 will be made and that the House will adopt a budget resolution that would lead to a balanced budget within ten years without raising any more taxes. Just a few months ago, they were singing a different, less fiscally tough tune.On Wednesday, the House suspended the limit on the nation’s debt ceiling. That gives Republican lawmakers nearly four months to sort out what they will demand in exchange for raising it and puts that potentially market-spooking debate off until after budget battles over the scheduled sequester cuts and the expiration on March 27 of a continuing resolution to fund the government. Republicans view the political terrain on those issues as more favorable than that of any confrontation with President Obama and Harry Reid’s Senate over further spending cuts.

- Will the Democratic Party survive Obama? – Republicans currently control the governors mansion and legislatures of 25 states representing 53 percent of the American population. The Democratic Party enjoys similar control of just 13 states representing just 27 percent of the population. With Obama out of the picture, it is hard to see how Democrats can add to those numbers.

- Sarah Palin Hacker Moves to Halfway House – The man convicted of hacking Sarah Palin's e-mail account was released from federal prison and is now spending time in a halfway house.
David Kernell left a fenceless minimum-security federal prison in Ashland, Kentucky, where inmates are put to work on landscaping and building maintenance for between $0.12 and $0.40 per hour for the halfway house, according to a Tennessee television station.
Kernell was convicted last year of breaking into to Palin's Yahoo e-mail account during the 2008 presidential election. He outsmarted Yahoo's password reset system by correctly answering questions using information about Palin that was easily available on the Internet — a technique that criminals continue to use to break into those accounts. Apparently it took Kernell minutes to look up her birth date, Zip code and where she met her husband Todd (Wasilla High School).
When they don't make any money from the crime, it's unusual for first-time hackers with no criminal records to get a prison sentence, but Kernell's case wasn't exactly typical. Palin and her eldest daughter Bristol testified during the trial, and prosecutors argued that a stiff sentence would deter further hacking during presidential elections.
Kernell is now in the custody of the Nashville Community Corrections Office, and is set to finish his sentence on Nov. 23, according to the U.S. Bureau of Prisons.
- Don’t Hollow Out the Military – The fiscal profligacy of President Obama and his allies on Capitol Hill may tempt Republicans in Congress to agree to deep — and, in General Dempsey’s words, “high risk” — defense cuts today in exchange for long-term reductions in entitlements down the road. This would be a mirage.
America’s defense is too important to become a political football in the budget battles. Rather, any cuts in defense spending should be the result of a careful, dispassionate assessment of the risks we and our allies face. A global risk assessment should inform a defense strategy that adequately manages those risks, and such a strategy should lead to a budget that can keep America safe.
Making portentous decisions on any other basis risks gravely weakening our defenses and demonstrating to foes and friends alike a lack of resolve that ensures we will face more of the former with fewer of the latter. As history has repeatedly shown, such weakness only serves to invite aggression. The mortal threats that result would certainly prove far costlier than the defenses that would have prevented them.

- Lemonade Crackdown – By Iain Murray – In the past couple of months, police have put children’s lemonade stands out of business in Texas, Georgia, Wisconsin, Iowa, Pennsylvania, and Maryland. (There’s a great map, with links to the news stories, here.)
The kids have been taught a lesson, but it’s one we should learn, too: You can’t be an entrepreneur in modern-day America without bureaucrats giving you permission in the first place.
The costs of regulation today amount to $10,000 per employee per year for small businesses in the U.S. That’s why the advert where a little girl borrows her father’s phone to help run her lemonade stand and ends up running a multinational just can’t happen. The bureaucrats just wouldn’t let her do it without jumping through the costly bureaucratic hoops first.
That’s why businesses aren’t hiring. That’s why unemployment is still at 10 percent (except around the bureaucrats’ nirvana of Washington, D.C., where it’s 4 percent). That’s why the president’s revenues have dried up.
If we want to get America back to work, we need to lighten up on the lemonade stands, lighten up on small businesses, and stop the bureaucrats destroying free enterprise.
- The Government War On Kid-Run Concession Stands – August 1, 2011 – Police officers in Coralville, Iowa, ordered at least three different sets of children to quit selling lemonade during the Register’s Annual Great Bike Ride Across Iowa unless they first got a vendor’s permit and a health inspection. This is the first known example of a coordinated set of shutdowns at a single time.
July 19, 2011 – McAllen, Texas shuts down girls’ lemonade stand for failure to obtain food permit, may assess grandmother $50 fine.
July 17, 2011 – Police in Appleton, Wisconsin inform children that despite legally selling lemonade and cookies in their front yard during an annual city festival for the past six or seven years, a new city ordinance bans these sales in order to protect licensed vendors from competition.
July 15, 2011 – Cops in Midway, Georgia shut down a lemonade stand some kids were running in their own front yard, saying the kids had to obtain a peddler’s license, a food license, and pay $50 per day for a temporary business permit.
June 16, 2011 – County Inspector in Maryland closes kids’ lemonade stand, fines parents $500.======

- Northern California mother faces murder charge over Meth breast milk – Prosecutors in Northern California have upgraded charges against a woman accused of feeding her son methamphetamine-laced breast milk to murder, rather than manslaughter.
Six-week-old Michael Acosta III was taken to the hospital after he stopped breathing last November and was pronounced dead. Investigators determined his mother, Maggie Jean Wortman, had breastfed the child while she had drugs in her system.
After a preliminary hearing last month, a judge ordered Wortman to stand trial for involuntary manslaughter and child endangerment.
Humboldt County prosecutors say evidence introduced during that hearing led to the upgraded charges this week. Deputy District Attorney Ben McLaughlin told the Times-Standard of Eureka (http://bit.ly/r746ea ) that Wortman's recklessness warranted the murder charge.
Defense attorney M.C. Bruce says the facts don't support that. - Six GOP senators want deficit committee to meet in public – Six Republican senators on Wednesday called on Senate leaders to ensure that a new congressional deficit-reduction committee meets in public and before television cameras.
The 12-member super committee, comprised of an equal number of Democratic and Republican lawmakers, was created by the debt-limit legislation signed into law Tuesday, and is responsible for identifying $1.2 trillion in spending cuts by Thanksgiving. But the law doesn’t require the committee’s meetings to be open to the public.
In their letter, Sens. Kelly Ayotte (N.H.), John Boozman (Ark.), Dean Heller (Nev.), Ron Johnson (Wisc.), Mike Lee (Utah), and David Vitter (La.) urged Majority Leader Harry Reid and Minority Leader Mitch McConnell to make sure members of the public receive advanced notice of meetings, are able to attend them and can watch live broadcasts.
Reid, McConnell, House Speaker John Boehner and Minority Leader Nancy Pelosi will each appoint three members to the Joint Committee on Deficit Reduction.

- Obama: Still the Alinskyite – Obama is a bad negotiator because Alinskyite’s don’t negotiate, they intentionally polarize. As for their own groups, here they try to placate all factions and hide their own goals. That about describes Obama’s performance on the debt deal, which included a dollop of both of these stances.
I’ve laid it all out in Radical-in-Chief, from standard Alinskyite operating procedure, to Obama’s own use of it in Chicago, to the contradictions inherent in the attempt to apply these lessons to the presidency. As far as I can tell, Obama is still moving according to this Alinskyite template. In his own words, it was his true political education. It’s still the key to what he’s up to.

- Mitch Daniels Supportive Of Sen. Lugar GOP Challenger – Richard Mourdock – Indiana state Treasurer Richard Mourdock was never expecting Gov. Mitch Daniels (R-Ind.) to endorse him as he mounts a primary challenge against Sen. Richard Lugar (R-Ind.). But he said that Daniels offered encouragement for him to run–an important factor in his decision to challenge the longtime senator.
"Before I decided to do this, he and I had three different conversations about it," Mourdock said in an interview with Hotline On Call. "And every time, he said, 'Richard Mourdock, don't you ever, ever, ever let anyone tell you don't have every right to do this. You've earned the right. You worked 31 years in the business world. We don't have that kind of experience very often in Washington."
Earlier this month in an appearance on Meet the Press, Daniels said he planned to vote for Lugar, but the governor stopped short of endorsing the longtime senator and called Mourdock a friend. Mourdock said Daniels told him the same thing, and never discouraged him from challenging Lugar. Daniels has a long history with Lugar, having served as his top aide as a young political operative.
"I'm very comfortable with what the governor did given his position," Mourdock said. "Why shouldn't they be friends? Why shouldn't he vote for him? I get that." Mourdock called himself a Daniels ally and said he would support him if he ran for president.
"Our country needs him," Mourdock said.
Daniels' spokesman Jane Jankowski said the governor neither encouraged nor discouraged Mourdock from launching a Senate run.

- Howard Dean: Democrats Should Be ‘Quietly Rooting’ for Government Shutdown – Howard Dean, the former chairman of the Democratic National Committee, sees an upside to a looming government shutdown – at least politically.
“If I was head of DNC, I would be quietly rooting for it,” said Dean, speaking on a National Journal Insider’s Conference panel Tuesday morning. “I know who’s going to get blamed – we’ve been down this road before.”
The former Vermont governor and presidential candidate was alluding to 1995 and 1996, when two government shutdowns under a Republican Congress helped improve President Clinton’s reelection chances. The scenario could repeat this year as budget negotiations continue to falter, and Dean said he thinks the public will blame Republicans again.
“From a partisan point of view, I think it would be the best thing in the world to have a shutdown,” said Dean. He added that as a statesman, he is not rooting for a shutdown because of its harmful effect on the country.
Predicting who would get the blame for a government shutdown has been a favorite parlor game of Washington pundits since the new wave of House GOP freshmen demanded deep spending cuts to this year’s budget. Dean’s prediction that the fallout would be toxic to Republicans drew a rebuke from former Rep. Vin Weber, who joined Dean on the panel. The Minnesota Republican argued that 2011 is a different time, and that voters are more focused on government spending than they were 16 years ago.======

Poll Watch: 45 Per Cent Say They Get Involved In Politics to PROTECT Themselves FROM Government
And, only 44 per cent say they are involved to make the country a better place.
Forty-five percent (45%) of Americans adults say most people get involved in politics to protect themselves from what the government might do, according to a new Rasmussen Reports national telephone survey.
Forty-four percent (44%) believe most get involved in politics to help make the country better.
While most men (51%) say people get involved in politics primarily to protect themselves, a plurality of women (46%) believe most get involved to better the country.
There’s a sizable partisan divide on the question, too. Most Democrats (59%) say people generally get involved to make the country better. The opposite view is held by most Republicans (54%) and the majority of those not affiliated with either major party (56%).
Quite a divide here. This is one of the reasons that corporate American ponies up the campiagn cash to the party in power regardless of ideology.
It is called PROTECTION.
What a racket.
