Takes rebel stand to oppose Alito OK for SupremesSen. Hillary Clinton yesterday backed a rebel band of Senate Dems seeking to filibuster a vote on the Supreme Court nomination of Judge Samuel Alito.
Democratic leaders had warned that filibuster efforts were going nowhere and would let President Bush score easy political points, but Clinton said, “I oppose his nomination and support efforts to block his confirmation.”
“I do not think Judge Alito would advance the principles Americans hold most dear,” she said, adding she would vote against a move to cut off a filibuster should one occur.

The Senate Democrats WILL FILIBUSTER on Monday.
Senate Minority Leader Harry Reid (D-Nev.) made it clear earlier in the day that the party didn’t have the votes to defeat a cloture vote, so a filibuster was doomed to failure.
Nevertheless, Sens. John Kerry (D-Mass.) and Ted Kennedy (D-Mass.) have pushed for a filibuster, a move that delights Republicans.
“If the Democratic left does a filibuster led by Kerry, that’s found money for us,” a top GOP official said.
The filibuster tactic could have repercussions for Clinton. Her move is bound to be seen as an appeal to the liberal base that dominates the Democratic presidential primaries, following several Senate votes that could be seen as attempts to move to the center.

An “ALITO FILIBUSTER” = Pandering to the Pro-Abortion/NARAL movement
Hillary is migrating back to her NATURAL LEFT or does she fear Kerry and/or Gore in the Presidential primary?

Senator Dianne Feinstein who previously stated she would vote against a filibuster of Judge Samuel Alito has changed her mind:
Washington, DC – U.S. Senator Dianne Feinstein (D-Calif.) today announced that she will vote no on cloture regarding the nomination of Judge Samuel A. Alito, Jr. to be an Associate Justice of the Supreme Court.
“Based on a very long and thoughtful analysis of the record and transcript, which I tried to indicate in my floor statement yesterday, I’ve decided that I will vote no on cloture.â€

There are only 57 votes Aye.
Will Kerry and Kennedy pursuade other Senators over the weekend to vote No on cloture?
Will the Gang of 14 have to exert discipline? Or will Bill Frist tire of the stalling and call for a change of the rules (Nuclear Option) Monday morning?

AFP: Top Democrats move to block Bush high court nominee
Leading Democrat Senators John Kerry and Ted Kennedy said they would try to block Supreme Court nominee Samuel Alito by preventing a vote on him with a filibuster.
Former presidential candidate Kerry announced from Switzerland that he wanted to block President George W. Bush’s conservative nominee with the stalling tactic to prevent “an ideological coup” on the high court.
“Judge Alito will take America backward, especially when it comes to civil rights and discrimination laws,” Kerry said is a statement.
Kennedy, Kerry’s fellow Massachusetts senator, also called for a filibuster on Alito when the Senate is called to vote, probably early next week.
“We owe it to future generations of Americans to oppose this nomination. If Judge Alito is confirmed … the progress of half a century on the basic rights of all Americans is likely to be rolled back.”
In a statement, Democratic leaders said that Kerry was lobbying fellow senators in hopes of being able to round up the 41 votes needed to successfully prevent the Senate from holding a final up-or-down confirmation vote on Alito.

Supreme Court nominee Samuel Alito enjoys sufficient bipartisan support to surmount any Senate filibuster attempt by minority Democrats, members of both parties indicated Friday.
Democrats and Republicans both said that the 55-year-old conservative jurist will get more than the 60 votes needed to cut off debate on the Senate floor Monday. “Next Tuesday, a bipartisan majority will vote to confirm Judge Alito as Justice Alito,” said Senate Majority Leader Bill Frist, R-Tenn.
Alito’s supporters already have those commitments, with 52 of the Republicans’ 55-member majority and three Democrats — Robert Byrd of West Virginia, Tim Johnson of South Dakota and Ben Nelson of Nebraska — already publicly supporting his confirmation as the replacement for retiring Justice
Sandra Day O’Connor.In addition, Democratic Sens. Kent Conrad of North Dakota, Daniel Akaka of Hawaii, Ken Salazar of Colorado and Byron Dorgan of North Dakota — as well as GOP Sen. Olympia Snowe (news, bio, voting record) of Maine — made it clear after a second day of floor debate on Alito that they would not support a filibuster, even though Akaka and Salazar oppose Alito and the others are undecided.
Looks like the LEFTIES wimped out…….

ASSociated Press: More Democrats Get Behind Alito Nomination
Supreme Court nominee Samuel Alito picked up two new Democratic supporters alongside liberal critics Thursday, and Republicans began calling for the Senate to end its debate and vote to confirm him.
“Senate Democrats should stop their foot-dragging on the vote for Judge Alito to become Justice Alito,” said Majority Leader Bill Frist of Tennessee. Democrats Robert Byrd of West Virginia and Tim Johnson of South Dakota announced their support for the conservative judge.
Byrd and Johnson break party ranks but the vote Yea continues below 60.
Will the other Democrats have the intestinal fortitude to filibuster and withstand the wrath of the Gang of 14 and/or Nuclear Option?

Reuters: Panel sends Alito nomination to full Senate
The Senate Judiciary Committee voted along party lines on Tuesday to approve President George W. Bush’s nomination of
Samuel Alito to the Supreme Court, moving the 55-year-old conservative a step closer toward confirmation by the full Republican-led Senate.With 10 Republicans voting yes and eight Democrats voting no, the committee sent the nomination to the 100-member Senate. The full chamber is to begin debate on Wednesday, with a confirmation vote as early as the end of this week.

Samuel Alito Watch: Senate Judiciary Committee Poised to Approve Judge Alito
Reuters: Senate committee set to vote on Alito
Conservative federal appeals judge Samuel Alito appeared likely on Tuesday to move a step closer toward Senate confirmation to the U.S. Supreme Court, which he could end up pushing to the right.
The Senate Judiciary Committee was expected to split along party lines, 10-8, in urging approval by the Republican-led Senate of President George W. Bush’s 55-year-old candidate.
The full 100-member Senate was to begin debate on Wednesday, with a confirmation vote anticipated before Bush’s state of the union address to Congress next Tuesday.
Senate Judiciary Committe approval today along party line vote.
Watch for the filibuster on Wednesday.
Change of rules on Thursday (Nuclear Option).
Confirmation on Friday or Saturday.

Robert Novak: Filibuster Alito?
Pressure from liberal activists to oppose confirmation of Judge Samuel Alito for the Supreme Court has been so intense that Democratic senators may be trapped into a filibuster that they do not want to wage.
Despite the consensus that Alito performed well in his confirmation hearings, leaders of liberal organizations opposing him — Ralph Neas, Nan Aron and Wade Henderson — demand that Democrats vote against him. Consequently, Sen. Ben Nelson of Nebraska is the only Democrat at this writing who has announced in Alito’s favor.
That means the number of senators voting “no” will be well over the 41 needed to prevent cloture. Pressure groups then could ask why no filibuster had been launched. But Senate Democratic Leader Harry Reid may not want to risk causing Senate Republican Leader Bill Frist to set a precedent by using the “nuclear” option: to end a filibuster by simple majority vote.
The liberal special interests may indeed be pushing Reid to call a filibuster. But, will he call one if he does not have to votes to deny cloture? What would be the point and it would isolate those Senators breaking caucus ranks.
But, stranger strategy has prevailed from the left. A filibuster will be called if Reid has the votes to deny clotureand Flap thinks that he does.

U.S. Sen. Patrick Leahy (news, bio, voting record) of Vermont, the top Democrat on the Senate Judiciary Committee, announced his opposition on Thursday to Supreme Court nominee
Samuel Alito.What a surprise.
Leahy charged that President George W. Bush’s 55-year-old conservative candidate failed to demonstrate at last week’s confirmation hearing that he would bring a needed independence to the nation’s highest court.
“At a time when the president is seizing unprecedented power, the Supreme Court needs to act as a check and to provide balance,” Leahy said in a speech prepared for delivery at Georgetown University Law Center.
“I have no confidence that Judge Alito would provide that check and balance,” Leahy said. “I cannot support this nomination.”
What an EXCUSE.
Leahy couldn’t devise a rationale for denying Judge Alito’s confirmation.
How pathetic……

Reuters: Senate Democrat backs Alito for US Supreme Court
Ben Nelson of Nebraska, a moderate voice in the U.S. Congress, on Tuesday became the first Senate Democrat to announce his support for conservative Supreme Court nominee Samuel Alito, who is expected to be confirmed later this month by the full Republican-led Senate.
“I have decided to vote in favor of Judge Samuel Alito,” Nelson said in a statement issued by his office.
“I came to this decision after careful consideration of his impeccable judicial credentials, the American Bar Association’s strong recommendation and his pledge that he would not bring a political agenda to the court,” Nelson said.
A Democrat in a very red state of Nebraska – such a courageous move – NOT.
Of course, Ben Nelson will vote for Judge Alito. A judge of his qualifictions is what America desires in their supreme court justices.
Senator Ben Nelson is NO Dianne Feinstein and that is a GOOD thing.
Judge Alito is on his way to becoming Justice Alito.
