- Sandra Fluke Argued for Mandatory Coverage for Sex-Change Surgery – Rather belatedly, we are becoming aware that this supposedly typical Georgetown coed is not very typical at all:
[B]irth control is not all that Ms. Fluke believes private health insurance must cover. She also, apparently, believes that it is discrimination deserving of legal action if “gender reassignment” surgeries are not covered by employer provided health insurance. She makes these views clear in an article she co-edited with Karen Hu in the Georgetown Journal of Gender and the Law.
The title of the article . . . is “Employment Discrimination Against LGBTQ Persons” and was published in the Journal’s 2011 Annual Review.Remember, as Byron York previously reported, Fluke was rejected as a last-minute substitute witness at a Feb. 16 committee hearing because staffers for Chairman Issa were unable to discover Fluke’s claim to expertise relevant to the subject of the hearing. This law school journal article is the sort of thing that might have been discovered about Fluke’s background, had the Democrats who put Fluke forward as a witness done so with the usual 72-hour advance notice.
- Call Them Out By Name: Sandra Fluke, David Gregory and David Friend – After going to an Andrew Breitbart memorial event on Saturday, I am more inspired than ever to fight back against the Left. Three things that were said stood out to me in that regard. Number one, Dana Loesch said we need to follow Breitbart and hit Leftists by “calling them out by name.” Then Brandon Darby mentioned that the Left was taking advantage of our grief and we were losing on Limbaugh. Finally, I’m struck with the image of Breitbart himself in this tribute video looking straight at the camera and simply saying, “War.”
This is war. I am going to defend Limbaugh from the radical Leftists who want to take him off the air. And I am going to call out our opponents by name. Starting with Sandra Fluke, David Gregory and David Friend.
- Sandra Fluke, Gender Reassignment, and Health Insurance – Sandra Fluke is being sold by the left as something she’s not. Namely a random co-ed from Georgetown law who found herself mixed up in the latest front of the culture war who was simply looking to make sure needy women had access to birth control. That, of course, is not the case.
As many have already uncovered Sandra Fluke she is, in reality, a 30 year old long time liberal activist who enrolled at Georgetown with the express purpose of fighting for the school to pay for students’ birth control. She has been pushing for mandated coverage of contraceptives at Georgetown for at least three years according to the Washington Post.
- 2011 total: 254 companies leave California – In 2011, 254 California companies moved some or all of their work and jobs out of state, 26% more than in 2010, according to Irvine business consultant Joe Vranich who has been tracking these departures since 2009.
Twenty-eight of these companies were in Orange County. Seven of them moved or expanded to Texas, three to Mexico, two to Washington and one each to 16 other states, said Vranich, who has changed the name of his business from The Relocation Coach to Spectrum Location Solutions, which helps companies define their goals, find new locations and coordinate the move.The pace is accelerating, Vranich said. An average of 4.9 businesses left California each week of 2011, compared to 3.9 per week (202 total) in 2010 and one a week (51 total) in 2009. In what he calls “disinvestment events,” Vranich counts companies that move jobs, facilities or headquarters out of California and “in carefully selected instances, companies making major capital investments in plants elsewhere that in the past would have been built in California,” Vranich said.

Now, I believe in general principles, and I want to know what the general principle is about accepting apologies. I’d like to nail down people like Debbie Wasserman Schultz and Eric Boehlert, because their candidate, Barack Obama, is one of the greatest purveyors of apologies in the history of the world!
There is a difference between heartfelt apology, and a political confession. An apology would not be enough to obtain release from prison, while a confession, which is a political statement that has nothing to do with the heart, held out the possibility of getting one out of prison:

Rush Limbaugh has discussed at length — at length — what Sandra Fluke and her statist cronies are up to. Yes, he used the words “slut” and “prostitute” — using the ludicrous to make his point. Ms. Fluke, in one of the most pathetic, shamelessly whining stories in recent memory, demands to be paid for her sex life because it costs $3,000 for three years of birth control while she’s at law school. She demands that a Catholic university violate its fundamental right to religious liberty so she can have others pay for her sex life. So Rush asked the farcical obvious about somebody who demands that someone else pay her for her apparent, self-admitted prolific sex life. He spent two solid days relating her greed for other people’s money and a lack of personal responsibility to the oldest of principles.
Right on cue, the blacklisting crowd came out of their Stalinist caves. Having driven Lou Dobbs from CNN, cut off Beck’s windpipe at Fox, severed Pat Buchanan from MSNBC, thus emboldened they have now set their sights on Rush.

When the late, great Andrew Breitbart was asked in a Twitter conversation whether he’d apologize for his website’s posting of a video of a speech by Agriculture Department official Shirley Sherrod that led to her forced resignation, Breitbart replied, “Apologize for what?”
Breitbart knew the sensitivities and the hypocrisy of the left when their sacred cows and double standards were under attack.
Hell hath no fury, he knew, like a liberal whose dogma stands exposed. He wondered why those on the right always had to apologize for saying liberal emperors had no clothes, when the left never had to apologize for anything no matter how outrageous or offensive.

- L.A. Times Attempting Suicide – Today the Los Angeles Times is charging for visiting its site online. This is a suicide attempt that will severely damage the paper. Its parent company, Tribune Co., long has been in bankruptcy, running up $233 million in legal fees.
- California Students Protest Education Entitlement Cuts – Middle-aged, greying 1960s radicals, pimply faced kids, teachers, throngs of SEIU members, angry Occupy protestors, and union members of all kinds descended upon the state Capitol Monday. They demanded, “Wall Street and the wealthy 1 percent, pay to refund education, jobs, essential services, and a better future.”
The protest was sponsored by the California Teachers Association and the Occupy movement.
The protest even included roving bands of gang-attired youth probably not connected to education, dreadlock-wearing Rastafarians, earth children and the unmistakable sweet smell of marijuana wafting about. Vapid stares, body odor, anger and an abundant use of the “F” word, some attended the rally with an express purpose in mind, while others appeared less committed and just were there for the chanting and day off of school. “Enough is enough,” came the rally cry from college student body presidents. “We stand in solidarity,” said one speaker as Che Guevara signs waived wildly.
- Conejo Valley development icon Joe Brown dies at 86 – Funeral services will be held Saturday March 10 for a fifth-generation Californian who had a hand in shaping the Conejo Valley.
Services will begin at 12:30 p.m. at St. Paschal Baylon Catholic Church in Thousand Oaks for retired Realtor Joseph “Joe” Brown.
Brown died Thursday in his Thousand Oaks home at age 86 with his wife, Dolly, by his side. He had been suffering from heart problems for some time, but Dolly Brown, 65, said his death was somewhat sudden.
“He was lying in his hospital bed about a week ago and he said, ‘I’m not being very productive,’ ” she said with a smile.
By all accounts, “productive” was an understatement when it came to Joe Brown. Among his many accomplishments was helping to establish Mary Health of the Sick Convalescent Home in Newbury Park, the Conejo Valley Association of Realtors and the Ventura County Community Foundation in Camarillo, to name a few of his efforts.
- Lenny Dykstra gets 3 years in California prison – Disgraced ex-New York Mets outfielder Lenny Dykstra on Monday was sentenced to three years in a California state prison after pleading no contest to grand theft auto and providing a false financial statement.
Los Angeles County Superior Court Judge Cynthia Ulfig sentenced Dykstra after refusing to allow him to withdraw his plea and said the scam to lease high-end automobiles from dealerships by providing fraudulent information and claiming credit through a phony business showed sophistication and extensive planning.
“He obviously didn’t have the money to get the vehicles,” Ulfig said. “His conduct was indeed criminal.”

The national poll of likely Latino voters indicated that 73 percent of them approved of Obama’s performance in office, with over half those questioned looking favorably upon his handling of the healthcare debate and the economy, at 66 percent and 58 percent respectively.
Released on the eve of the Super Tuesday primaries in the race for the GOP nomination, the Fox News Latino poll shows former Massachusetts Gov. Mitt Romney with 35 percent of Latino voter support, to Texas Rep. Ron Paul’s 13 percent, former Speaker of the House Newt Gingrich’s 12 percent, and former Pennsylvania Sen. Rick Santorum’s 9 percent.

I’m talking about the second-tier of the warfare, the attempt to intimidate those removed by one or more degrees of separation from the dispute, and to use them as tools against the target.

I would not be surprised to see a similar reaction from the right to the left’s attacks on advertisers, but that would be a mistake. What is happening goes beyond Obama’s call for people to argue with their neighbors and get in their faces. It goes far beyond Bill Clinton’s politics of personal destruction directed at accusers, and beyond name-calling by right wing pundits. This total war, in which no one is allowed to be non-political and neighbors and clients become mere pressure points, is a dangerous development.

- Rush: “I sincerely apologize to Ms. Fluke”; Update: Ironic tweet of the day – I think Rush did the right thing in apologizing to Fluke. However, let’s keep in mind that it was Fluke who made her sexual activity a matter of national political debate by insisting that the government pass laws and regulations forcing employers and insurers to provide her free contraception, and apparently as much as she and others demand. It’s Republicans who believe that contraception should remain a private affair, and that employers and insurers should be free to decide whether to cover contraception for their employees and customers or not. Democrats used Fluke to demand that those choices be stripped from private enterprises and instead be forced by the executive branch to entirely subsidize contraception.
That is the argument we should be making, as Republicans and conservatives. If you want your sexual choices to remain private, don’t use the government to force other people to subsidize them. Then we won’t have to turn the sex lives of Georgetown law school students into topics for political speculation.

GOP presidential candidate Rick Santorum hopes Michigan Democrats can help him earn a victory in Tuesday’s primary. That’s right. The former Pennsylvania senator’s campaign paid for a robocall asking Democrats to vote for him in Tuesday’s primary. Recent polls show chief rival and Michigan native Mitt Romney and Santorum virtually even heading into the primary. “We know that if we can get a Reagan Democrat in the primary, we can get them in the fall,” said Hogan Gidley, communications director for Santorum. He confirmed the campaign paid for the call. Political observers say the move is just another sign of how close the GOP race is — and a “logical ploy.” As Santorum has done during numerous Michigan visits the past two weeks, the call attacked Romney’s stance on the auto bailouts, saying the former Massachusetts governor’s opposition “was a slap in the face” to Michigan workers, according to audio obtained by online political news outlet Talking Points Memo. Santorum also opposed the auto bailout, but said his consistent stance against all bailouts, including the Wall Street bailout, sets him above Romney.

Rep. Devin Nunes of Visalia, Calif., has come forward with a legislative remedy for the policies that have turned fertile fields into hollowed-out dust bowls in the name of “being green.”
Nunes’ Sacramento-San Joaquin Water Reliability Act goes to a vote in the House Wednesday and if it passes, it will guarantee that water the farmers paid for finally gets to the parched Central Valley. It will put an end to the sorry stream of shriveled vineyards, blackened almond groves and unemployed farm workers standing in alms lines for bagged carrots from China.
The insanity of the current policies against some of America’s most productive farmers in one of the world’s richest farm belts is largely the work leftist politicians from the wealthy enclaves of the San Francisco Bay Area. This group has exerted its political muscle on the less politically powerful region that produces more than half the fruits and vegetables consumed in the U.S. — with $26 billion in annual sales.
- TransCanada Corp. to begin construction of Keystone pipeline – TransCanada Corp. said Monday it plans to begin building a major portion of the Keystone XL oil sands pipeline despite the Obama administration’s decision to reject a key permit for the project.
The company told the State Department in a letter Monday that it will begin construction of a section of the pipeline that runs from Cushing, Okla., to refineries on the Gulf Coast. The stand-alone portion of the project, which TransCanada dubbed the Gulf Coast Project, will cost $2.3 billion and will be completed in mid-to-late 2013, according to the company. The project must still receive other regulatory approvals.
Separately, TransCanada said it would reapply “in the near future” for a permit that would allow the Keystone XL pipeline to cross from Alberta, Canada, into the United States.

- Feds seize additional computers in Kinde Durkee case – latimes.com – Federal prosecutors have seized several additional computers as part of their investigation into allegations that campaign treasurer Kinde Durkee misused the political funds of clients, according to documents released Monday.
The seizures were cited as a reason for seeking another month’s delay in a preliminary hearing in the case. A hearing that had been scheduled for Tuesday in federal court has now been set for March 16.
“The investigation has continued, and since the last continuance in this case, the government has seized a significant number of computers which need to be processed,” said a court filing by Assistant U.S. Atty. John K. Vincent. The filing does not identify whose computers were confiscated. “The government needs additional time to review, analyze, and synthesize materials that it has obtained during the course of this investigation,” the filing said.
- Maloofs pledge to contribute $75 million upfront for new downtown arena – The city of Sacramento and the Kings announced a tentative deal today to build a new arena in the downtown railyard. More than half the money would come from leasing the city’s parking to a private operator, but the team’s owners say they’ve also agreed to pay $75 million upfront.
George Maloof, the family member who pushed the hardest to move to Anaheim last year, said he believes the deal with Sacramento will allow the team to sustain itself financially for years in Sacramento, a small-market city. “We’re going to have a new building, we’ll be able to attract players. It will be much easier.”
- In high desert district, a mirror image of Ventura County situation? – If Democrats in Ventura County think Supervisor Linda Parks might create headaches for them by running as a “no party preference” candidate in the 26th Congressional District, perhaps they can get together with Republicans in the San Bernardino County-based 8th Congressional District to commisserate.
Former Assemblyman Anthony Adams, a moderate Republican who was assailed by conservatives because of his vote for a 2009 compromise that produced a state budget balanced with both spending cuts and temporary tax increases that have since expired, announced today he will be running as a “no party preference” candidate in the heavily Republican 8th District. The potential problem for the GOP is that there are five announced Republican candidates already, and only one Democrat. Like Ventura County’s 26th District, the 8th is an open seat with no incumbent.
- Jerry Brown presses Obama on Medi-Cal, meets with labor – Gov. Jerry Brown continued to press President Barack Obama today for authorization to enact further cuts to Medi-Cal to help balance California’s budget, even as the administration showed no sign of relenting and complained about the severity of state budget cuts in other areas.
Obama told governors in a meeting this morning that too many states are cutting education programs too deeply, citing teacher layoffs and rising college tuition.
“We’ve all faced some stark choices over the past several years,” Obama said. “But that is no excuse to lose sight of what matters most. And the fact is that too many states are making cuts to education that I believe are simply too big.”

- Hill Poll: Likely voters prefer lower individual, business tax rates – Three-quarters of likely voters believe the nation’s top earners should pay lower, not higher, tax rates, according to a new poll for The Hill.
The big majority opted for a lower tax bill when asked to choose specific rates; precisely 75 percent said the right level for top earners was 30 percent or below.
The current rate for top earners is 35 percent. Only 4 percent thought it was appropriate to take 40 percent, which is approximately the level that President Obama is seeking from January 2013 onward.
- Buffett: Banks Victimized by Evicted Homeowners – Warren Buffett, who controls the biggest shareholding of the No. 1 U.S. mortgage lender, said banks were victimized by some homeowners who refinanced their loans before getting evicted.
“Large numbers of people who have ‘lost’ their house through foreclosure have actually realized a profit because they carried out refinancings earlier that gave them cash in excess of their cost,” Buffett, chairman and chief executive officer of Berkshire Hathaway Inc. (BRK/A), said Feb. 25 in his annual letter. “In these cases, the evicted homeowner was the winner, and the victim was the lender.”
- Diane Sawyer, Anderson Cooper and Brian Williams are America’s Favorite News Personalities – Looking at a list of 26 current affairs personalities, when asked which three are their favorites, almost one-quarter say ABC News’ Diane Sawyer (23%), while one in five each say CNN’s Anderson Cooper (19%) and NBC’s Brian Williams (19%). Rounding out the top five favorite current affairs personalities is Bill O’Reilly (15%) and Barbara Walters (15%). These are some of the results of The Harris Poll of 2,016 adults surveyed online between January 16 and 23, 2012 by Harris Interactive.
Looking at the flip side, which three of the 26 news personalities are America’s least favorite, almost half say Rush Limbaugh (46%). Three in ten say Bill O’Reilly (31%) and almost one-quarter say their least favorite is Nancy Grace (23%). Rounding out the top ten least favorite news personalities are Sean Hannity (14%), Katie Couric (10%), Piers Morgan (10%), Barbara Walters (10%), Chris Matthews (10%), Rachel Maddow (7%) and Wolf Blitzer (7%).

- The State of the Twitterverse 2012 – Brian Solis – The first time I wrote about Twitter was March 2007. My, how time and Tweets fly. With 500 million registered users and 33 billion Tweets flying across the Twitterverse every day, Twitter has become a fabric of our digital culture. Twitter is now ingrained in our digital DNA and is reflected in our lifestyle and how we connect and communicate with one another.
While many struggle to understand its utility or its significance in the greater world of media, it is the most efficient global information network in existence today. News no longer breaks, it Tweets. People have demonstrated the speed and efficacy of social networking by connecting to one another based on interests (interest graph) rather then limiting connections to relationships (social graph). Twitter represents a promising intersection of new media, relationships, traditional media and information to form one highly human network.

- EPA Needs More Time to Reconsider Boiler MACT Rules – American workers and the industries that employ them face an ill-thought out and incomplete set of Boiler MACT regulations costing $14 billion to implement. Given current economic realities, these regulations place at risk the jobs of your constituents and 200,000 working Americans across the country. With the economic climate as it is now, we cannot afford to lose too many more American manufacturing jobs.
The EPA asked for proper time to reconsider the Boiler MACT rules, and even attempted to stay the rules to have more time to clarify them. The forest products industry, for example, is compiling additional data at the EPA’s request, but may not have time to complete needed testing. The courts have made it clear that only Congress can give the EPA the time they have asked for and need to provide clarity. As a result, this legal uncertainty is a cloud over American businesses, which must be able to plan for the future in these uncertain economic times. Our communities deserve environmental rules that have been fully considered, and will hold up scientifically in the long term

- “Cutting the Bureaucratic Gridlock” by Senator Tony Strickland – While I was visiting Teixeira Farms to discuss agricultural issues, the owners told me that one state agency said they needed to recycle all their water, while another state agency said they couldn’t recycle any of their water. The owners of the farm told me they were happy to do whatever was needed, but they couldn’t recycle all their water and none of their water at the same time.
Sadly, this isn’t the first time something like this has happened. Constituents and small business owners in my district often call my office, telling me that one state agency has given them the run-around about an issue and referred them to yet another state agency. Round and round they go, from agency to agency, until they finally give up.
Cleary, California’s vast bureaucracy is not working. There has to be a way to make government more efficient and maximize your precious tax dollars that come to Sacramento.This is why I’ve authored Senate Bill 953. SB 953 would create the Bureaucracy Realignment and Closure Commission (BRAC). SB 953 is modeled and named after the successful Base Realignment and Closure (BRAC) program, which was established by the federal government after the end of the Cold War. The Federal BRAC program successfully identified and closed obsolete military bases, saving an estimated $20 billion annually.

- Co-founder Mark Meckler resigns from Tea Party Patriots – Mark Meckler, the co-founder of the Tea Party Patriots, has resigned from his role with the grassroots group over internal disputes about the leadership of the organization, The Daily Caller has learned.
In an email obtained by TheDC, Meckler told the state coordinators of Tea Party Patriots on Thursday night that he “fought long and hard” to maintain the group “as an organization that is run from the bottom up, with the intent of serving the grassroots.”
“Unfortunately, it is my belief that I have lost this fight,” Meckler said. “I probably fought the internal fight longer than I should have, but I wanted to give absolutely every possible effort to preserving what I believe was the unique nature of the TPP organization.”
Since the organization’s founding, Meckler has shared the role of national coordinator with co-founder Jenny Beth Martin. But Meckler wrote in the email that he had lost “influence in the leadership of the organization, and it has been that way for quite some time.”
Meckler said the board granted Martin “almost complete power over the day-to-day operations” in November 2011 after a “protracted fight in which I was complaining about the direction, operation (top-down) and finances of the organization.”

- Los Angeles Times launches new membership program – The Los Angeles Times will begin charging readers for access to its online news, joining a growing roster of major news organizations looking for a way to offset declines in revenue.
Starting March 5, online readers will be asked to buy a digital subscription at an initial rate of 99 cents for four weeks. Readers who do not subscribe will be able to read 15 stories in a 30-day period for free.
Separately, The Times announced plans to launch a new weekly lifestyle section called Saturday for its print subscribers.
Other news outlets that have begun charging for online journalism include the New York Times, the Wall Street Journal and the Dallas Morning News. Gannett, the nation’s largest newspaper company, this week announced plans to launch a similar program at 80 publications, saying it could boost earnings by $100 million in 2013.

- U.S. does not believe Iran is trying to build nuclear bomb – As U.S. and Israeli officials talk publicly about the prospect of a military strike against Iran’s nuclear program, one fact is often overlooked: U.S. intelligence agencies don’t believe Iran is actively trying to build an atomic bomb.
A highly classified U.S. intelligence assessment circulated to policymakers early last year largely affirms that view, originally made in 2007. Both reports, known as national intelligence estimates, conclude that Tehran halted efforts to develop and build a nuclear warhead in 2003.
The most recent report, which represents the consensus of 16 U.S. intelligence agencies, indicates that Iran is pursuing research that could put it in a position to build a weapon, but that it has not sought to do so.
Although Iran continues to enrich uranium at low levels, U.S. officials say they have not seen evidence that has caused them to significantly revise that judgment. Senior U.S. officials say Israel does not dispute the basic intelligence or analysis.
- Could California swing the Republican nomination? – If no clear front-runner in the delegate count emerges by the end of April, Texas and California will move to the center of the political universe. These two gigantic, expensive states could then hold the keys to the nomination and determine whether we are headed for a brokered convention.
What would a hotly contested California Republican primary campaign, unseen in decades, look like? Certainly it would be very expensive, and waged almost entirely on television. The state is too big to quickly organize on a district level (ask anyone who has run for statewide office in California), making broadcast media critical. A quick bus tour, some fly-arounds and earned media stops would make up the rest. An insurgent candidate could also conceivably attempt to organize the small number of Republicans who live in heavily Democratic congressional districts in Los Angeles to score a few delegates.
California’s primary is “closed,” meaning only registered Republicans may participate. This results in a more conservative electorate than in “open” primary states where voters of other affiliations may vote in the Republican primary.
Although California votes late enough to be winner-take-all, it isn’t. Under rules adopted in 2000 and first put into effect in 2004, the California Republican Party will allocate delegates proportionally by congressional district. In 2008, John McCain won in 48 of 53 districts, with Mitt Romney winning in the remaining five.

- “Dogs Against Romney”? Democrats Say Unleash the Hound! – Tomorrow outside the Westminster dog show at Madison Square Garden at noon the group “Dogs Against Romney” will protest “to ensure pet lovers are aware that Mitt Romney is mean to dogs,” according to the group’s press release.
While it may seem silly to some, Democrats are have every intention of making sure – if Romney wins the GOP nomination – that every voting American knows about the story of Romney putting his family dog Seamus in a kennel on top of his roof and driving from Boston to Canada, with said canine Seamus making his displeasure known in a rather scatological way. “I have a yellow Lab named Winston,” Fox News’ Chris Wallace said to Romney. “I would no sooner put him in a kennel on the roof of my car than I would one of my children. Question: What were you thinking?” “This is a completely airtight kennel, mounted on the roof of our car,” Romney replied. “He climbed up there regularly, enjoyed himself. He was in a kennel at home a great deal of the time as well. We loved the dog. It was where he was comfortable.” “When Seamus crapped all over the car I’m fairly certain he wasn’t expressing pleasure,” one top Democrat told ABC News.
“31 million dog-owners vote,” said another.
- Media Matters memo called for hiring private investigators ‘to look into the personal lives’ of Fox employees – A little after 1 p.m. on Sept. 29, 2009, Karl Frisch emailed a memo to his bosses, Media Matters for America founder David Brock and president Eric Burns. In the first few lines, Frisch explained why Media Matters should launch a “Fox Fund” whose mission would be to attack the Fox News Channel.
“Simply put,” Frisch wrote, “the progressive movement is in need of an enemy. George W. Bush is gone. We really don’t have John McCain to kick around any more. Filling the lack of leadership on the right, Fox News has emerged as the central enemy and antagonist of the Obama administration, our Congressional majorities and the progressive movement as a whole.”
“We must take Fox News head-on in a well funded, presidential-style campaign to discredit and embarrass the network, making it illegitimate in the eyes of news consumers.”
What Frisch proceeded to suggest, however, went well beyond what legitimate presidential campaigns attempt. “We should hire private investigators to look into the personal lives of Fox News anchors, hosts, reporters, prominent contributors, senior network and corporate staff,” he wrote.
After that, Frisch argued, should come the legal assault: “We should look into contracting with a major law firm to study any available legal actions that can be taken against Fox News, from a class action law suit to defamation claims for those wronged by the network. I imagine this would be difficult but the right law firm is bound to find some legal ground for us to take action against the network.”

- Laura Richardson’s ethics woes mount – Democratic Rep. Laura Richardson instructed taxpayer-funded House aides to work on political redistricting last year, sources familiar with the situation told POLITICO.
Such activities could amount to a violation of prohibitions against lawmakers pressuring aides to do political work, as well as rules against using official resources, including staff, for campaign purposes.
The redistricting work, which has not previously been disclosed, allegedly occurred after it became clear Richardson was under investigation over another set of allegations that she forced House aides to perform political and personal tasks in violation of House rules. Richardson did not respond to repeated requests for comment.
Sources told POLITICO that Richardson’s congressional aides collected information about communities outside her district, organized a workshop to train constituents in advance of a public meeting of California’s independent redistricting commission, and wrote talking points for those constituents to deliver during the public-comments portion of the meeting at Long Beach City Hall in April 2011.
The redistricting work was done at Richardson’s direction — rather than on a voluntary basis — these sources said.
A spokesman for the Ethics Committee declined to comment on the Richardson case, but several sources indicated that investigators have expanded the probe and are now looking into the redistricting angle.

- Iranians’ Internet access blocked temporarily: experts – Most computer users in Iran were blocked from accessing email, social networking and other services in recent days, U.S.-based Internet experts said on Monday, raising fears the government is extending the reach of its surveillance on ordinary citizens.
Internet service providers presumed to be acting at the Iranian government’s behest began blocking the most common form of secure connections on Friday, according to the outside experts and Iranian bloggers. Traffic rebounded to normal levels on Monday.
The cutoff apparently affected all encrypted international websites outside of Iran that depend on the Secure Sockets Layer protocol, which display addresses beginning with https, according to Earl Zmijewski of Renesys, a U.S. company that tracks Internet traffic worldwide.
- California lawmaker writes ‘Public Employees Bill of Rights’ – Assemblyman Roger Dickinson, D-Sacramento,(right) has introduced legislation that would give unionized state workers more workplace discipline protections and first dibs on state government work.
SEIU Local 1000 and the Union of American Physicians and Dentists support AB 1655, the “Public Employees Bill of Rights Act.” Here’s what it would do:
• Gives unionized state employees priority over outside contractors and excluded state workers to fill permanent, overtime and on-call positions.
• Sets a one-year statute of limitations for employers to take an adverse action against a state employee. (The current law allows disciplinary actions up to three years after the discovery of fraud, embezzlement or records falsification.)
• Establishes a peer review committee to provide workplace operations input.
• Guarantees that the state won’t impose “unreasonable quotas” on employees.
• Bans extra work created by vacancies, furloughs of layoffs without “fair compensation.”
• Gives priority to workplace safety and health grievances.
• Explicitly bans workplace discrimination.
• Strengthens whistleblower protections.
• Requires employers exercise “preventive and corrective” actions before administering harsher employee discipline.
• Settles grievances in favor of the employee if the employer misses contractual deadlines for response.
• Defines protections and performance and merit evaluation processes for professionally licensed employees.

- Steinberg seeks state review of Sacramento Co. dental program – Senate President Pro Tem Darrell Steinberg is calling for a state review of a Sacramento County pilot program that provides state-funded dental coverage for low-income children.
A Center for Health Reporting article published in The Bee over the weekend detailed the shortcomings of the managed care program, including long wait times and comparatively low rates of dental care among the more than 110,000 Sacramento County children covered by the program.
In a letter to California Department of Health Care Services Director Toby Douglas, Steinberg called for immediate action to address what he called a “crisis in prevention and treatment services.”
“Despite that state funding, disturbing specific patient cases as well as the department’s own data cited in the article make it abundantly clear that prevention and treatment services are woefully inadequate for those children most in need,” the Sacramento Democrat wrote in the letter.
In addition to the investigation, Steinberg asked the administration to step up its monitoring of dental plans under contract with the program and withhold payments or cancel contracts with plans that fail to provide proper access to care or meet other performance standards.

- Rick Santorum, Mitt Romney Tied Nationally As Romney Struggles with Base, New Polls Show – Despite a victory in the Maine caucuses on Saturday, Mitt Romney has more to worry about after two new polls released Monday show him fighting to keep his lead among Republicans nationally and struggling to win favor from the conservative base.
A new Pew Research Center poll found Santorum and Romney neck-and-neck, with Santorum winning 30 percent of the support among Republican registered voters to Romney’s 28 percent — a difference that falls well within the poll’s five percentage point margin of error. Separately, Gallup’s latest tracking survey of the Republican race found Romney with 32 percent support and Santorum right on his heels with 30 percent.
Of concern for Romney, the Pew poll shows him struggling among the conservative groups that make up the Republican base. Among self-identified conservatives, Santorum leads Romney by an 11 percent margin, 36 percent to 25 percent. Among Tea Party supporters, Santorum leads 42 percent to 23 percent.
Romney’s support among Tea Party supporters is essentially unchanged from last month, when he received 26 percent support from Tea Party supporters to 24 percent each for Santorum and Newt Gingrich. But Santorum’s lead among the group may be a sign that they have begun to see him as the alternative to Romney.

- The American Spectator : Can Mitt Close the Deal? – Cold, bleak February has turned into a happy time for us. It’s given us a short break from the constant barrage of debates, speeches and “crucial” primaries in the Republican presidential nomination contest. February has given us, and the candidates, a bit of time to think. Let’s make the most of it.
The nomination is still up for grabs. Mitt Romney has the clearest path to it but Newt Gingrich, Rick Santorum, and Ron Paul are all promising to take it all the way to the convention. To those who natter about how cool a “brokered” convention would be, I say don’t wish for something because you might get it. (Among other frightful questions, who can be the brokers? It’ll be a food fight that benefits only the media.) The Republican Party is too weak and fractured to come out of such an event united and strong enough to win in November.
So let’s assume that Romney is the nominee. The arithmetic is pretty simple. Mitt Romney plus an energized Republican base can beat Obama in November. Romney without an energized base will lose. But the Republican base is conservative, and Romney hasn’t closed the deal with conservatives. Can he?
Let’s face it: Romney isn’t one of us. At CPAC last Friday he said he governed Massachusetts as a “severely conservative” Republican in the tone of voice my late maternal grandmother used to say she was severely constipated. We know his record as state candidate and governor, and national candidate since 2007. We need not rehearse it here. Suffice it to say that it defines him as a transactional conservative. He will apply conservative principles as a business owner might apply production scenarios and estimated profit margins to negotiating a deal. They aren’t part of his core, but will be useful tools for him in campaigning and, if he wins, governing. - National Review calls on Gingrich to bow out of presidential race – The National Review is calling on Newt Gingrich to drop out of the Republican presidential race, arguing the former House Speaker should clear the way for Rick Santorum to seize the mantle as the Anti-Romney choice for conservatives.
“It is not clear whether Gingrich remains in the race because he still believes he could become president next year or because he wants to avenge his wounded pride: an ambiguity that suggests the problem with him as a leader. When he led Santorum in the polls, he urged the Pennsylvanian to leave the race. On his own arguments the proper course for him now is to endorse Santorum and exit,” the editors of the influential conservative online magazine wrote in an op-ed posted Monday.
- Santorum moves ahead in Michigan – Rick Santorum’s taken a large lead in Michigan’s upcoming Republican primary. He’s at 39% to 24% for Mitt Romney, 12% for Ron Paul, and 11% for Newt Gingrich.
Santorum’s rise is attributable to two major factors: his own personal popularity (a stellar 67/23 favorability) and GOP voters increasingly souring on Gingrich. Santorum’s becoming something closer and closer to a consensus conservative candidate as Gingrich bleeds support.
Santorum’s winning an outright majority of the Tea Party vote with 53% to 22% for Romney and 10% for Gingrich. He comes close to one with Evangelicals as well at 48% to 20% for Romney and 12% for Gingrich. And he cracks the 50% line with voters identifying as ‘very conservative’ at 51% to 20% for Romney and 10% for Gingrich.

- Obama super PAC decision: President blesses fundraising for Priorities USA Action – President Barack Obama — in an act of hypocrisy or necessity, depending on the beholder — has reversed course and is now blessing the efforts of a sputtering super PAC, Priorities USA Action, organized to fight GOP dark-money attacks.
On Monday morning, Obama reviled the “negative” tone of the super PACs, a dominant fundraising source in the wake of the Supreme Court’s Citizens United decision. But by the evening, word leaked to POLITICO that Obama had offered his support for Priorities USA Action, which thus far has raised a fraction of what GOP-backed groups have raked in.
Obama’s top campaign staff and even some Cabinet members will appear at super PAC events. The president himself will not address super PAC donors, although there’s nothing to legally prohibit the president, first lady Michelle Obama and Vice President Joe Biden from expressing their support for the group — as GOP presidential front-runner Mitt Romney has done for the super PAC that backs him.
“We decided to do this because we can’t afford for the work you’re doing in your communities, and the grass-roots donations you give to support it, to be destroyed by hundreds of millions of dollars in negative ads,” campaign manager Jim Messina told supporters in an email Monday night.
The timing of the announcement seemed rushed, several Democrats told POLITICO. It was made in a 10 p.m. call to Obama’s top bundlers, known as the National Finance Committee. Several party fundraisers raised the possibility that the campaign wanted to offset bad publicity generated by a Monday New York Times story, which reported that the campaign had returned $200,000 to the family of a wealthy Mexican fugitive seeking a pardon for drug and other criminal convictions.
- Obama campaign to support super PAC fundraising – In a change of position, Barack Obama’s reelection campaign will begin using administration and campaign aides to fundraise for Priorities USA Action, a super PAC backing the president.
Obama has been an outspoken critic of current campaign financing laws, in particular a Supreme Court ruling that allowed the creation of super PACs. Until now he has kept his distance from Priorities USA Action.
But in the wake of the group’s anemic fundraising, made public last week, the campaign decided to change its position, and announced the new stance to members of its national finance committee Monday evening.
Two Obama campaign aides confirmed that senior campaign and administration officials who participate at fundraising events for the president’s campaign will also appear at events for Priorities USA Action, the PAC supporting Obama.
“This decision was not made overnight,” one campaign official said. “ The money raised and spent by Republican super PACs is very telling. We will not unilaterally disarm.”
The president, first lady Michelle Obama, Vice President Joe Biden and Dr. Jill Biden will not appear at super PAC events, the aides said.
In an e-mail to supporters, Obama campaign manager Jim Messina said the decision was a reaction to massive fundraising posted by super PACs supporting GOP presidential candidates.
- Judge Michael Hawkins Is No “Moderate” – Lyle Denniston’s SCOTUSblog preview of tomorrow’s Ninth Circuit ruling in the Prop 8 case includes the assertion that one of the panel members, Clinton appointee Michael D. Hawkins, “is considered to be a moderate.” Hawkins has described himself that way—“I think of myself as being entirely moderate in all things”—but even he has hastened to add the disclaimer, “but others might say otherwise.” Indeed, they might.
As I reported when the panel members were initially made public, a source I trust told me that of the nearly 50 active and senior judges then on the Ninth Circuit, there were only five or six other judges who were as aggressively and reflexively leftist as Hawkins and his fellow panel member, the ultraliberal Stephen Reinhardt.
- Prop. 8: Final ruling due – The Ninth Circuit Court will issue a ruling tomorrow — apparently, in a single opinion — to decide the challenge to California’s ban on same-sex marriage, approved by the state’s voters more than three years ago. In a brief announcement Monday, the Circuit Court said it would issue an opinion at 1 p.m. Tuesday Washington time (10 a.m. in San Francisco) dealing both with the constitutionality of the measure (“Proposition 8″) and with the issue of whether the trial judge should have disqualified himself from the case.
The three-judge panel actually has three issues before it: whether the backers of Proposition 8 had a legal right to appeal the District Court ruling striking down Proposition 8 (the “standing” issue), whether — if “standing” to appeal did exist — the ballot measure is unconstitutional, and whether now-retired District Judge Vaughn R. Walker should have recused and thus whether his ruling should now be vacated by the Circuit Court.
Although the wording of the announcement Monday was not entirely clear and made no promises about the scope of the ruling, it could be interpreted as indicating that the panel will find that the measure’s proponents did have the right to appeal, and thus the panel would be free to move on to rule on the merits and on the disqualification issue. Given the makeup of the panel and the past records of the three judges, the chances would appear to be quite strong that Proposition 8 would be struck down.
- Michelle Malkin » Fisker Auto Announces Layoffs; Requests Expedited Access to Full Dept. of Energy Loan Guarantee – Fisker Automotive, which was granted a $529 million US Dept. of Energy loan guarantee and then announced they would assemble the first line of cars in Finland, has announced layoffs at a Delaware plant that has yet to produce a single car:
The company says 26 Fisker employees have been let go from the Delaware factory where renowned automotive engineer Henrik Fisker promised to one day begin producing affordable electric sedans. A Delaware newspaper also reported that subcontractors working on the car venture have been let go.
“It’s temporary,” said Roger Ormisher, a company spokesman. “We’re being prudent and sensible as a company.”
Because the initial phase sounds like it’s been such an unqualified success, the company is asking for terms of the federal loan to be altered so the company can have faster access to their line of time-released taxpayer-backed credit:

- Religious conservatives play culture war defense – Between the media’s uproar after a cancer-research charity temporarily suspended grants to the nation’s leading abortion provider, and the Obama administration’s recent decision to force Catholic schools to pay for 100 percent of their employees’ contraception, the last two weeks have helped clarify the shape of the culture war in America today.
The battleground is this: The Secular Left is on the offensive, while the oft-demonized Religious Right is mostly playing defense, trying to preserve the liberty of religious adherents to conduct their lives according to their own consciences.
“The right’s recent jihad against Planned Parenthood is about as loathsome as anything I’ve ever seen come out of them,” seethed Mother Jones writer Kevin Drum after Susan G. Komen for the Cure, a leading breast-cancer charity, briefly decided to not give new grants to Planned Parenthood for the coming year.
Drum was writing about conservatives’ opposition to taxpayer subsidies for Planned Parenthood, and, in this case, a charity under pressure from pro-lifers temporarily suspending funding for the abortion provider. It’s a peculiar “jihad” whose main weapon is refusing to give away your money to the enemy.

- Prop 8 Merits Ruling Tomorrow – The Ninth Circuit has announced that it expects to issue tomorrow—by 10 a.m. Pacific time, 1 p.m. Eastern—its ruling on the merits of the Prop 8 appeal. - High-speed rail tapped state funds for unusual lobbying contract – In an extremely unusual use of taxpayer money, the leaders behind California’s $99 billion high-speed train quietly hired a lobbyist to sway the Legislature — the same politicians who appointed them to build the project in the first place.
Documents filed this week show the California High-Speed Rail Authority last year paid $161,103 to one of the country’s biggest public relations firms to lobby the state’s politicians as they consider spending $2.7 billion to launch the polarizing bullet train project.
Rail officials paid the lobbyists by issuing debt that will total about $300,000 with interest. It must be paid back through California’s impoverished general fund budget.
High-speed rail officials defended the spending as a “vital need” when their staff was too small. But both Democratic and Republican lawmakers and even die-hard bullet train backers decried the lobbying as a wasteful and unethical use of taxpayer funds, saying it essentially amounts to the state spending money to lobby itself.
“That is appalling to me. I’ve never heard of such a thing,” said Quentin Kopp, who helped launch the rail authority and was its longtime chairman before retiring in March. He said he never approved the expenses and that the state should go to court to keep the money. “That’s nonsense, absolutely nonsense. It’s embarrassing.” - Obama administration rejects California’s Medi-Cal copays – Federal health officials rejected California’s bid to charge Medi-Cal copayments for everything from drugs to hospital visits, dealing a new blow to the state budget but relief to low-income patients and their providers.
Gov. Jerry Brown and lawmakers relied on mandatory Medi-Cal copayments to save $511 million in last year’s state budget and presumed that the state would continue saving in future years.
The governor’s latest budget, which estimates a $9.2 billion deficit, acknowledges the lost savings in 2011-12. But it is relying on $296 million to help balance next year’s budget, according to Department of Finance spokesman H.D. Palmer.

- Romney up in Colorado, close race in Minnesota – Last night’s results in Nevada were bad news for Newt Gingrich and PPP’s first day of polling in Colorado and Minnesota indicates things may only get worse for him in the coming days.In Colorado Mitt Romney looks primed for another big Western win to match his one in Nevada. Minnesota looks like a toss up with any of the four candidates having some shot at winning. Santorum holds a small edge there with 29% to 27% for Romney, 22% for Gingrich, and 19% for Paul.
What both states have in common is that Gingrich has fallen precipitously since our last polls in them. In Colorado Gingrich was in first place with a 19 point lead in early December. His support has declined 19 points since then and his net favorability has dropped 33 points from +41 (64/23) to only +8 (49/41). Gingrich has had a similarly large decline in Minnesota, but there it’s much more abrupt. We polled the state only two weeks ago but in that time he’s dropped 14 points from 36% to 22%, and his favorability has 26 points from +34 (59/25) to +8 (47/39). That after glow from South Carolina has worn off real fast.

- Romney tops 50% in final Nevada tally – Mitt Romney won Saturday’s Nevada caucuses with his highest portion of a state’s vote yet, just over 50%, according to certified results released Monday by the Nevada Republican Party.Former House Speaker Newt Gingrich finished in second place with just over 21% of the vote. Rep. Ron Paul of Texas placed third at 18.7%, and former Sen. Rick Santorum of Pennsylvania earned 9.9%.
Romney, the former Massachusetts governor who also won the state’s GOP caucuses in 2008, received more than twice the votes of his closest opponent.

Aaron Suggs had been designated a non-serious, nonviolent felon when he was released from state prison Dec. 8 after serving a sentence for drug possession. That designation resulted in his supervision, upon release, being assigned to the Sacramento County Probation Department rather than state parole agents under a program adopted by the state last year to cut its costs.
State prisons spokesman Luis Patino said last year’s change in state law shifting responsibilities for some felons to counties did not affect how long Suggs spent in prison. County officials also denied that the shifting of post-prison supervision had an effect on Suggs’ ability to commit the crime, although Suggs spent five days in county jail for not immediately reporting to his county probation officer after his release from prison.
Suggs was arrested Monday after he allegedly sexually assaulted a woman in a house near the Capitol and stole some of her possessions.

- The Bain Capital Bonfire – About the best that can be said about the Republican attacks on Mitt Romney’s record at Bain Capital is that President Obama is going to do the same thing eventually, so GOP primary voters might as well know what’s coming. Yet that hardly absolves Newt Gingrich, Rick Perry and others for their crude and damaging caricatures of modern business and capitalism.
Bain’s business model is little more than “rich people figuring out clever legal ways to loot a company,” says Mr. Gingrich, whose previous insights into free enterprise include years of defending the taxpayer-fed business of corn ethanol.
A super PAC supporting the former House Speaker plans to spend $3.4 million in TV ads in South Carolina portraying Mr. Romney as Gordon Gekko without the social conscience. The financing for these ads will come from a billionaire who made his money in the casino business, which Mr. Gingrich apparently considers morally superior to investing in companies in the hope of making a profit.
Mr. Perry, who has no problem using taxpayer financing to back his political allies in Texas, chimes in that “I have no doubt that Mitt Romney was worried about pink slips, whether he was going to have enough of them to hand out. Because his company Bain Capital, with all the jobs that they killed, I’m sure he was worried he’d run out of pink slips.”

- As Romney Advances, Private Equity Becomes Part of the Debate – A working paper released in September shows that private equity-owned companies shed slightly more jobs than similar companies, though the difference was quite small. In total, they shed about 1 percent more jobs.
The study — by Steven J. Davis of the University of Chicago; John C. Haltiwanger of the University of Maryland; Josh Lerner of Harvard, and Ron S. Jarmin and Javier Miranda of the Census Bureau — looked at about 3,200 buyouts conducted between 1980 and 2005.
It found that companies bought by private equity firms let go a larger proportion of workers than similar firms, shrinking their work forces about 6 percent more over a five-year window. But companies bought by private equity firms also tend to open more new branches, offices and factories and hire more new staff members, partly offsetting the job losses.
Some economists also argue that private equity takeovers make good economic sense in the long term, even if they result in more layoffs in the short term, by making companies more efficient.

Forstmann that was, along with Mr. Romney’s Bain Capital and Henry R. Kravis’s Kohlberg Kravis & Roberts, among the leading private equity firms during the 1980s and 1990s.
Forstmann Little earned billions of dollars in profits from its investments in companies including General Instrument and Gulfstream Aerospace. But the firm shut down most of its operations a decade ago after suffering losses from ill-timed bets on high-flying telecommunications companies at the height of that industry’s bubble.
Mr. Gingrich’s involvement with the firm could complicate his attacks on Mr. Romney.
Still, to be fair, Mr. Forstman bristled at some of the more aggressive tactics of his rivals, and once described them as “barbarians at the gate.” That phrase was used as the title of a bestselling book that detailed Mr. Forstmann’s buyout battle with Mr. Kravis for RJR Nabisco, a contest K.K.R. eventually won.

While the unemployment rate has been falling in part due to people leaving the labor force, a large portion of this month’s number appears to come from people finding jobs.
The unemployment rate is calculated based on people who are without jobs, who are available to work and who have actively sought work in the prior four weeks. The “actively looking for work” definition is fairly broad, including people who contacted an employer, employment agency, job center or friends; sent out resumes or filled out applications; or answered or placed ads, among other things. The rate is calculated by dividing that number by the total number of people in the labor force.
In December, the household survey showed the number of people employed rose by 176,000, as the population increased by 143,000 over the month. So even though the labor force — the number of people working or looking for work — fell by 50,000, job growth is outpacing the increase in the population.

- Brown Seeks 7% California Spending Boost- Bloomberg – Brown Seeks 7% California Spending Boost
- Brown Seeks 7% California Spending Boost – Governor Jerry Brown proposed $92.6 billion in spending for the year starting in July, an increase of about 7 percent, which will count on voters approving $7 billion of higher taxes in November.
The spending plan foresees a deficit of $9.2 billion through the next 18 months. Almost half of that is in the current fiscal year, he said. He called for $4.2 billion in cuts, mostly to welfare and programs for the poor. If the tax increase isn’t passed, Brown’s plan would cut another $4.8 billion in support for public schools and community colleges.
California is Standard & Poor’s lowest-rated state, at A-, six levels below AAA. Moody’s Investment Service grades it A1, four steps below the top rating, tied with Illinois (STOIL1) for the worst credit rating among states.

This quiet reality, which is spreading nationwide, is claiming a wide range of casualties, including family physicians, cardiologists and oncologists.
Industry watchers say the trend is worrisome. Half of all doctors in the nation operate a private practice. So if a cash crunch forces the death of an independent practice, it robs a community of a vital health care resource.
“A lot of independent practices are starting to see serious financial issues,” said Marc Lion, CEO of Lion & Company CPAs, LLC, which advises independent doctor practices about their finances.
Doctors list shrinking insurance reimbursements, changing regulations, rising business and drug costs among the factors preventing them from keeping their practices afloat. But some experts counter that doctors’ lack of business acumen is also to blame.
- Employers close door on smokers – More job-seekers are facing an added requirement: no smoking — at work or anytime.
As bans on smoking sweep the USA, an increasing number of employers — primarily hospitals — are also imposing bans on smokers. They won’t hire applicants whose urine tests positive for nicotine use, whether cigarettes, smokeless tobacco or even patches.
Such tobacco-free hiring policies, designed to promote health and reduce insurance premiums, took effect this month at the Baylor Health Care System in Texas and will apply at the Hollywood Casino in Toledo, Ohio, when it opens this year.
- New Pentagon strategy stresses Asia, cyber, drones – President Barack Obama unveiled a defense strategy on Thursday that would expand the U.S. military presence in Asia but shrink the overall size of the force as the Pentagon seeks to reduce spending by nearly half a trillion dollars after a decade of war.
The strategy, if carried out, would significantly reshape the world’s largest military from the one that executed President George W. Bush’s “war on terrorism” in Iraq and Afghanistan.
Cyberwarfare and unmanned drones would continue to grow in priority, as would countering attempts by China and Iran to block U.S. power projection capabilities in areas like the South China Sea and the Strait of Hormuz.
But the size of the U.S. Army and Marines Corps would shrink. So too might the U.S. nuclear arsenal and the U.S. military footprint in Europe.
- Obama: the US can no longer fight the world’s battles – The mighty American military machine that has for so long secured the country’s status as the world’s only superpower will have to be drastically reduced, Barack Obama warned yesterday as he set out a radical but more modest new set of priorities for the Pentagon over the next decade.
After the wars in Iraq and Afghanistan that defined the first decade of the 21st century, Mr Obama’s blueprint for the military’s future acknowledged that America will no longer have the resources to conduct two such major operations simultaneously.
Instead, the US military will lose up to half a million troops and will focus on countering terrorism and meeting the new challenges of an emergent Asia dominated by China. America, the President said, was “turning the page on a decade of war” and now faced “a moment of transition”. The country’s armed forces would in future be leaner but, Mr Obama pointedly warned both friends and foes, sufficient to preserve US military superiority over any rival – “agile, flexible and ready for the full range of contingencies and threats”.
- Mitt Romney’s the nominee: The Republican primary race is over. – Is there anyone not annoyed by Mitt Romney’s narrow win in the Iowa caucus? Conservatives are disappointed because they recognize that the former Massachusetts governor, who used to be pro-choice and was for Obamacare before it was called that, is only pretending to be one of them. Seventy-five percent of Iowa’s Republican voters wanted someone further to the right. But because their votes were divided among too many weak and weird candidates, the only moderate running in their state came out on top.
Liberals are bummed because Romney is the strongest potential challenger to President Obama. This shows up clearly in head-to-head polls, which put Romney tied with or slightly ahead of Obama, while other Republican contenders trail by 10 points or more. It was hard for Obama campaign officials to suppress their glee last month when Newt Gingrich, the only even remotely plausible alternative to Romney, briefly ran at the head of the pack. But even they knew this was a momentary aberration. Short of Republicans committing collective suicide by picking someone else, Democrats would like to see Romney win the nomination after a protracted, costly struggle that would deplete his financial resources, sully his image, and drag him further to the right. Today, that scenario looks less likely.
- Richard Cordray & the Use and Abuse of Executive Power – Some think me a zealous advocate of executive power, and often I am when it comes to national security issues. But I think President Obama has exceeded his powers by making a recess appointment for Richard Cordray (whom I respect and have no problems with as a nominee) to head the new Consumer Financial Protection Bureau. Any private party can challenge this nomination by refusing to obey any regulation issued by the agency as the act of an unconstitutional officer. As a result, this may be the first time that Richard Epstein and I get to represent someone in court together!

- Grappling With Ron Paul’s Racist Newsletters – Did you know about the racist newsletters published in the late 1980s and early 1990s under Ron Paul’s name? As the Texas Congressman surges in the GOP primary, the story of the newsletters is garnering headlines, as it did during his 1996 House campaign and his 2008 presidential run. He’s always insisted that he didn’t write the egregiously offensive material, and long ago repudiated it (though not as soon as he should have). Is this an old story voters will look beyond, like Newt Gingrich’s affairs? Or a new story for the vast majority of voters and the plurality of journalists who are less familiar with Paul than the other GOP frontrunners? Is it coming up now “for political reasons”? Or because it’s a legitimate subject of inquiry despite having been aired before in the media?
It seems to me that the story’s reemergence was inevitable and necessary to fully inform primary voters about their choices. This level of scrutiny is rightly what comes with contending for the presidency.
- Mayor Calls For Budget Cuts To Offset Millions In Occupy LA Costs – The City of Los Angeles reportedly faces millions of dollars in expenses brought about by the Occupy LA movement.
City agencies have been ordered to calculate what was spent on the Occupy LA protests.
Repairs to City Hall’s lawn where the Occupy group set up camp on Oct. 1 will require an estimated $400,000. The police action to clear out the encampment on Nov. 30 cost more than $700,000.
Additional expenses are attributed to hauling away debris from the camp, and cleaning up graffiti that defaced City Hall marble walls and trees.
- Romney refines comments about deporting Obama’s uncle – Mitt Romney was more nuanced Thursday when questioned about radio show comments he made regarding deporting President Barack Obama’s uncle.
According to The Hill, the former Massachusetts governor was asked by radio host Howie Carr if Onyango Obama, who is allegedly in violation of his immigration status and was arrested for drunk driving this summer, should be deported.
In the Wednesday interview, Romney said the law must be followed.
“Well, if the laws of the United States say he should be deported, and I presume they do, then of course we should follow those laws,” he said.
Asked to clarify those comments in a press conference Thursday, Romney said his stance was not affected by the man’s relationship to the president.
- Bush I: Read my lips, Romney’s the best choice – Former President George H.W. Bush, while stopping short of a formal endorsement, declared that Mitt Romney was the “best choice” for Republicans in 2012.
The Houston Chronicle reports:
“I think Romney is the best choice for us,” former President Bush told the Houston Chronicle this week. “I like Perry, but he doesn’t seem to be going anywhere; he’s not surging forward.”
Bush said he had known Romney for many years and also knew his father, George Romney, a former Republican governor of Michigan who ran for president in 1968.
Bush said he supported Romney because of his “stability, experience, principles.
He’s a fine person,” he said. “I just think he’s mature and reasonable – not a bomb-thrower.”
- Huffington Post Miami accused of over-aggregating – When Huffington Post Miami launched late last month, Arianna Huffington promised to “dig deeper in an effort to tell the stories of all the people who make up this unique city.”
And how many Miami-based HuffPo journalists are doing that? Two, according to Bill Cooke. He reports that Miami Herald staffers are complaining that the HuffPo duo are rewriting their newspaper stories for Huffington Post Miami.
Miami Herald managing editor Rick Hirsch declined to discuss this with Cooke. “I’ll say what I have to say directly to the Huffington Post. There are some things we’ll be discussing soon.”
- McConnell offers a way out of the payroll tax cut thicket – As I predicted, the perennial adult in Washington, Senate Minority Leader Mitch McConnell (R-Ky.), has stepped forward with a way out of the payroll tax box into which the House Republicans have climbed. He sent out this statement:
“The House and Senate have both passed bipartisan bills to require the President to quickly make a decision on whether to support thousands of U.S. manufacturing jobs through the Keystone XL pipeline, and to extend unemployment insurance, the temporary payroll tax cut and seniors’ access to medical care. There is no reason why Congress and the President cannot accomplish all of these things before the end of the year. House Republicans sensibly want greater certainty about the duration of these provisions, while Senate Democrats want more time to negotiate the terms. These goals are not mutually exclusive. We can and should do both. Working Americans have suffered enough from the President’s failed economic policies and shouldn’t face the uncertainty of a New Year’s Day tax hike. Leader Reid should appoint conferees on the long-term bill and the House should pass an extension that locks in the thousands of Keystone XL pipeline jobs, prevents any disruption in the payroll tax holiday or other expiring provisions, and allows Congress to work on a solution for the longer extensions.”
- Ron Paul’s story changes on racial comments – Rep. Ron Paul has tried since 2001 to disavow racist and incendiary language published in Texas newsletters that bore his name, denying he wrote them and even walking out of an interview on CNN Wednesday. But he vouched for the accuracy of the writings and admitted writing at least some of the passages when first asked about them in an interview in 1996.
Some issues of the newsletters included racist, anti-Israel or anti-gay comments, including a 1992 newsletter in which he said 95% of black men in Washington “are semi-criminal or entirely criminal.”
Paul told TheDallas Morning News in 1996 that the contents of his newsletters were accurate but needed to be taken in context. Wednesday, he told CNN he didn’t write the newsletters and didn’t know what was in them. - Video: Ron Paul in 1995: Say, have you read my newsletters? – Mitt Romney can breathe a sigh of relief, because Andrew Kaczynksi has shifted his attention to Ron Paul this week. Andrew dug up a 1995 interview with C-SPAN, a year before running for Congress after a decade out of office. Paul tells C-SPAN that he was ready after the long hiatus to return to Washington, but that’s not the big catch in this clip. Starting at 1:45, Ron Paul explains that his private sector efforts are keeping him too busy — and starts plugging his newsletters:
- What Ron Paul Thinks of America – Ron Paul’s supporters are sure of one thing: Their candidate has always been consistent—a point Dr. Paul himself has been making with increasing frequency. It’s a thought that comes up with a certain inevitability now in those roundtables on the Republican field. One cable commentator genially instructed us last Friday, “You have to give Paul credit for sticking to his beliefs.”

- Flipper: Romney changes stance on Iraq invasion – Romney’s statement on MSNBC is not only a change from what he said on Fox a few days ago. It’s also a change from his position during his first run for the Republican presidential nomination in 2007-2008. In a January 2008 GOP debate in Florida, Romney was asked, “Was the war in Iraq a good idea worth the cost in blood and treasure we have spent?” Romney answered: “It was the right decision to go into Iraq. I supported it at the time; I support it now.”
- Paul abandons interview concerning controversial newsletters – Rep. Ron Paul (R-Texas) took off his microphone and left a contentious interview on Wednesday when a CNN reporter asked repeatedly about racist articles published in his newsletter in the 1980s and 1990s.
“It’s been going on 20 years that I’ve been pestered about this and CNN does it every time,” Paul said, clearly adjitated by the line of questioning. “When are you going to wear yourself out?”
The Texas congressman said that the articles – which did not carry a byline – were written by his publishing staff and that he did not know about them at the time.
“I didn’t write them, I didn’t read them at the time, and I disavow them. That is the answer,” Paul said.
When CNN reporter Gloria Berger defended her questioning as legitimate – noting that some of the articles were “pretty incendiary” – Paul began to remove his microphone.
The newsletters, mainly a forum for essay’s on Paul’s brand of libertarianism, once referred to Martin Luther King Jr. as “the world-class philanderer who beat up his paramours” and who “seduced underage girls and boys.”
In another article, the author writes that “given the inefficiencies of what DC laughingly calls the criminal justice system, I think we can safely assume that 95 percent of the black males in that city are semi-criminal or entirely criminal.”
- Mitt Romney Says ‘Yes’ To Deporting President Obama’s Uncle – Presidential candidate Mitt Romney told a Boston talk radio host on Wednesday that he supports the deportation of President Obama’s Kenyan-born uncle who was arrested this fall on drunken driving charges in Massachusetts.
When asked by Boston radio personality Howie Carr whether the president’s relative, Onyango Obama, should be deported, Romney said, “the answer is ‘yes.’”
“Well, if the laws of the United States say he should be deported, and I presume they do, then of course we should follow those laws,” Romney said. “And the answer is ‘yes.’”
When Carr brought up Onyango Obama case, Romney first sought clarification: “Who is Uncle Omar, Howie?” the former Massachusetts governor asked the radio host.
Carr explained that the uncle, nicknamed “Omar,” was recently arrested in Framingham, Mass.
“Now he’s claiming he’s got a Social Security number and drivers’ license and no one knows how he got them,” Carr told Romney, “but they’re apparently legit even though he’s in the country illegally.” (Onyango Obama had reportedly defied a 1992 deportation order.) - Oh My! Gingrich Challenges Romney to Debate – In an interview with NBC News, Newt Gingrich responded to Mitt Romney’s comments that he can’t take the heat of negative ads.
Said Gingrich: “I’ll tell you what. If he wants to test the heat, I’ll meet him anywhere in Iowa next week, one-on-one, 90 minutes no moderator, just a timekeeper. He wants to try out the kitchen? I’ll debate him anywhere. We’ll bring his ads, and he can defend [them].”
- Ron Paul Storms Out Of CNN Interview – Ron Paul walked out of an interview with CNN’s Gloria Borger, following a heated exchange over the controversy regarding racist newsletters sent in his name during the 1990s. Borger asked the Congressman if he had ever read the newsletters. “Did you ever object when you read them?”
“Why don’t you go back and look at what i said yesterday on CNN and what I’ve said for 20 something years. 22 years ago? I didn’t write them, I disavow them, That’s it.”
“But you made money off them,”
“I was still practicing medicine,” Paul responded. “That’s probably why I wasn’t a very good publisher, I had to make a living.”
- Tom Del Beccaro, Chairman of the California Republican Party Response to ProPublica Report – “The ProPublica report vindicates my repeated contention that the redistricting process was hijacked. That report, however, is just the tip of the iceberg. The corruption of the process went far beyond what was disclosed in that report. No fair minded person can now say the process or the result was fair. I am calling for an immediate and thorough investigation, by Congressional and State authorities, to get to the bottom of this obviously corrupted process. Beyond that, the Congressional and Senate lines as drawn by the Commission should not be used in any way for the upcoming elections.”
- How Democrats Fooled California’s Redistricting Commission – This spring, a group of California Democrats gathered at a modern, airy office building just a few blocks from the U.S. Capitol. The meeting was House members only — no aides allowed — and the mission was seemingly impossible.
In previous years, the party had used its perennial control of California’s state Legislature to draw district maps that protected Democratic incumbents. But in 2010, California voters put redistricting in the hands of a citizens’ commission where decisions would be guided by public testimony and open debate.
- Democrats skew redistricting effort to their benefit, investigation finds – California’s congressional Democrats ran a secret effort earlier this year to manipulate the work of the independent citizen’s panel that drew the state’s new political districts, foiling the intent of reformers who sought to remove the redistricting process from the control of party bosses.
Democrats met behind closed doors at the party’s Washington, D.C. headquarters, hired consultants, drew their ideal districts and presented maps to the panel through proxies who never disclosed their party ties or “public interest” groups created specifically for the purpose. In many cases, the panel responded by doing just what the Democrats wanted.
The New York-based nonprofit investigative foundation ProPublica released findings Wednesday from a months-long reconstruction of the Democrats’ stealth redistricting strategy, relying on internal memos, emails, interviews and map analysis.
The success of the strategy has Democrats projecting they may pick up as many as seven congressional seats in 2012 under new district boundaries adopted last summer, far more than had been expected originally.
“Every member of the Northern California Democratic Caucus has a ticket back to D.C.,” crowed one internal memo. “This is a huge accomplishment that should be celebrated by advocates throughout the region.”

- BREAKING: Cain ‘Reassessing’ Candidacy – In a conference call this morning, Herman Cain told his senior staff that he is “reassessing” whether to remain in the race. He will make his final decision “over the next several days.”
UPDATE: National Review was on the call. It lasted 5 minutes.
“Obviously, you’re all aware of this recent firestorm that hit the news yesterday,” Cain began, his voice somber. “First thing I want to do is say to you what I have said publicly: I deny those charges, unequivocally. Secondly, I have known this lady for a number of years. And thirdly, I have been attempting to help her financially because she was out of work and destitute, desperate. So thinking that she was a friend, and I have helped many friends, I now know that she wasn’t the friend that I thought she was. But it was a just a friendship relationship.”
- Why Mitt Romney needs Herman Cain – The latest allegation swirling around businessman Herman Cain — that he conducted a 13-year long extramarital affair with a woman named Ginger White — could well amount to a political death blow for his already-reeling presidential campaign. - Federal suit challenges California’s new congressional districts – Rebuffed by the California Supreme Court, a former Republican congressman and four others filed suit this week in federal court to overturn the state’s newly drawn congressional maps.
The lawsuit by Mariposa Republican George Radanovich, who left Congress in January, marks the latest of numerous attacks by GOP interests against districts drawn for the first time by an independent citizens commission.
Radanovich’s federal suit contends that the panel violated federal voting-rights law and the U.S. Constitution by seeking to protect three African American incumbents in the drawing of three Los Angeles congressional districts.
- What if the individual mandate was unconstitutional? – An alarming article in Politico.com looks at what could happen if the Supreme Court determines that the Affordable Care Act’s individual mandate provision is unconstitutional—something that the current conservative leaning of the Court seems to indicate is somewhat more likely than not.
Assuming that such a possible decision by the Court follows that of the Eleventh Circuit Court of Appeals in ruling that the mandate is unconstitutional but the remainder of the ACA may stand, the Politico.com article anticipates some potentially disastrous consequences.
The provisions of the ACA—some of them already in force—include guaranteed issue, elimination of annual and lifetime limits, and a ban on basing premiums on health status, essentially decoupling coverage and premiums from insurance risk. Without the requirement for almost everyone to have coverage, there will be nothing to ensure that the risk pool contains a large percentage of individuals in good health as well as those with medical problems, and nothing to stop anyone from waiting until they’re sick or injured to demand coverage.

- Chris Christie: President Obama’s just a ‘bystander’ – Gov. Chris Christie on Monday tore into President Barack Obama in the aftermath of the supercommittee’s failure to reach an agreement on debt reduction last week, asking the president, “What the hell are we paying you for?”
Calling Obama “a bystander in the Oval Office,” the outspoken New Jersey governor said the White House spent the weekend tossing out a whole lot of “spin” about the supercommittee’s inability to come to an agreement before the Nov. 23 deadline.
“I was angry this weekend, listening to the spin coming out of the administration, about the failure of the supercommittee, and that the president knew it was doomed for failure, so he didn’t get involved. Well then what the hell are we paying you for?” Christie said during a press conference in Camden, N.J. “It’s doomed for failure so I’m not getting involved? Well, what have you been doing, exactly?”
- Obama Abandons the Working Class – The timing may be a little embarrassing, appearing as it does on the eve of Mr. Obama’s visit to Scranton. Still, the authors are probably correct. For all of Joe Biden’s nostalgia about the blue-collar virtues of his home town (where he hasn’t lived since the early days of the Eisenhower administration), the coal mines shut down years ago and many in the white working class have been drifting to the Republican Party.
The authors therefore suggest that Mr. Obama’s best demographic bet for 2012 lies in holding white college graduates. They are also up front about the vulnerability. Mostly they phrase it politely—”the perceived inability of the Obama administration’s policies to spark real recovery”; “serious doubts about Democratic stewardship of the economy”; or “disenchantment on the economy.”
That shouldn’t be a hard sell in places like Scranton, where the 9.7% unemployment rate is the worst in the state. When the Obama stimulus came, Lackawanna County spent nearly half of the $39 million it received on education, which means teachers.
