    • Emanuel did contact the governor's office about the appointment and left Blagojevich with the impression that he was pushing Valerie Jarrett, a close Obama friend, so he wouldn't have to compete with her in the White House for Obama's attention, said a person close to Blagojevich. The person was not authorized to talk about the governor's discussions regarding the vacancy and requested anonymity.

      It was not clear whether Blagojevich inferred Emanuel's motive for advocating Jarrett, or whether Emanuel discussed the appointment with Blagojevich directly or with John Harris, the governor's then-chief of staff who also is charged in the case, according to the source.

    • I’ve obtained documents sent to a reader in response to his FOIA request regarding the creation of Barack Obama’s Change.gov website. It gives you the rest of the story. You’ll recall last month that I blogged several questions about the propriety of allowing the perpetual Obama campaign to use a .gov domain name for what appeared to be a fund-raising front. Readers and industry observers noted that the decision appeared to violate General Services Administration rules governing government domains.
    • Opponents argue that the amendment cannot be applied retroactively, but proponents say the amendment is clear on that issue.

      "Proposition 8's brevity is matched by its clarity," one of the briefs read. "There are no conditional clauses, exceptions, exemptions, or exclusions: 'Only marriage between a man and a woman is valid or recognized in California.'

    • Geraldine Ferraro gave a thumbs down to Caroline Kennedy's bid for the Senate yesterday – even as the Camelot daughter won her biggest endorsement for the job, The Post has learned.

      Ferraro, the first woman nominee for vice president, sent a letter to Gov. Paterson urging him to instead appoint one of New York's six sitting female Congress members to replace Hillary Rodham Clinton in the Senate.

      At the same time, Brooklyn Democratic Party head Vito Lopez, who leads the biggest county party in the city, issued the first formal endorsement for Kennedy.

    • Caroline Kennedy is finally sharing some of her political opinions with the people she's campaigning to represent — casting herself in the liberal tradition of uncle Ted Kennedy, bucking Barack Obama by supporting same-sex marriage and disavowing Hillary Clinton's 2002 vote for the Iraq invasion.

      A Kennedy spokesman drafted seven written answers to the eight questions submitted by Politico to the 51-year-old attorney, author and electoral novice.

      Some of Kennedy's responses were brief and vague — and she flatly refused to answer a pressing political query we posed: Will she support the Democratic nominee for New York mayor in 2009?

    Kenneth W. Starr, the former U.S. Solicitor General and Pepperdine School of Law Dean who led the inquiry into President Bill Clinton’s affair with Monica L. Lewinsky, will argue the case in favor of upholding a ban on gay marriage before the California Supreme Court

    So, who would you rather have supporting your cause before the California Supreme Court, Dean Kenneth Starr or California Attorney General Jerry Brown? -especially when the cause is the legality of gay marriage.

    Brown who had not practiced law for over a decade before he won an election as California Attorney General has postulated a weird legal theory (in his brief before the court) as to why the California Supreme Court should overturn the vote of the California people restoring the traditional definition of marriage (one man one one woman).

    Nonetheless, the attorney general’s brief surprised some legal scholars.

    Santa Clara University law professor Gerald Uelmen, an expert on the state high court, said Brown’s argument “turns constitutional law on its head.” Uelmen said he was unaware of any case law that supported Brown’s theory.

    He added that he expected the state Supreme Court to reject the argument. “I think it is much too radical for this court,” he said.

    Goodwin Liu, associate dean and professor of law at UC Berkeley’s Boalt Hall School of Law, said it was “extraordinary for the chief law enforcement officer of the state to decline to enforce a law — even on the grounds that it is unconstitutional.”

    “The chief law enforcement officer of the state is charged with enforcing laws, even laws with which he disagrees,” Liu said.

    “Whether or not it will carry the day,” he added, “I have no idea.”

    Under Brown’s legal theory, Flap doubts the California Constitution could ever be amended.

    The issue before the court “presents a conflict between the constitutional power of the voters to amend the Constitution, on the one hand, and the Constitution’s Declaration of Rights, on the other,” Brown wrote.

    The issue “is whether rights secured under the state Constitution’s safeguard of liberty as an ‘inalienable’ right may intentionally be withdrawn from a class of persons by an initiative amendment.”

    Voters are allowed to amend other parts of the Constitution by majority vote, but to use the ballot box to take away an “inalienable” right would establish a “tyranny of the majority,” which the Constitution was designed, in part, to prevent, he wrote.

    Just call anyting an “inalienable” right and you can withdraw the people’s right to change the Constitution.

    How stupid is this?

    If the California Supreme Court rules in favor of this preposterous theory and overturns California Proposition 8 all of the members of the court will either be recalled or thrown ot of office at the next confirmation election.

    The Yes on 8 campaign filed a brief telling the court that because the new law holds that only marriages between a man and a woman are recognized or valid in California, the state can no longer recognize the existing same-sex unions.

    “Proposition 8’s brevity is matched by its clarity. There are no conditional clauses, exceptions, exemptions or exclusions,” reads the brief co-written by Kenneth Starr, dean of Pepperdine University’s law school and the former independent counsel who investigated President Bill Clinton.

    • Kenneth W. Starr, the former U.S. Solicitor General who led the inquiry into President Bill Clinton’s affair with Monica L. Lewinsky, will argue the case in favor of upholding a ban on gay marriage before the California Supreme Court.

      Starr was today named lead counsel for the official proponents of Proposition 8. This afternoon, the group filed court briefs defending the legality of the proposition, which was approved by 52% of California voters last month throwing into question thousands of marriages performed during the five months the practice was legal in the state.

      The briefs are in response to a spate of legal challenges filed by gay rights advocates, including the cities of San Francisco and Los Angeles.

    • California Attorney General Jerry Brown has changed his position with respect to the state's new same-sex marriage ban and is now urging the state Supreme Court to void Proposition 8.

      Brown filed a brief Friday saying the measure, which amended the California Constitution to limit marriage to a man and a woman, is itself unconstitutional because it deprives gay couples of a fundamental right.

      After California voters passed Proposition 8 on Nov. 4, Brown initially said he would fight to uphold the ballot initiative in his role as attorney general, even though he personally voted against it.

    • WHEN THE alleged brazen attempts by Illinois Gov. Rod Blagojevich (D) to auction off a U.S. Senate seat were revealed last week, the leadership of the state legislature made noises about the need for a special election. Press conferences were held. Bills to make such a vote possible were promised. And then — silence. It had dawned on the Democrats who control the legislature and their fellow Democrats in Washington that they might actually lose a Senate election. So much for letting the people speak.

    Shocker: Rham Emanuel Had Direct Talks With Hot Rod Blagojevich Pushing Valerie Jarret for Obama’s Senate Seat

    No, not really.

    President-elect Barack Obama’s incoming chief of staff Rahm Emanuel had a deeper involvement in pressing for a U.S. Senate seat appointment than previously reported, the Sun-Times has learned. Emanuel had direct discussions about the seat with Gov. Blagojevich, who is is accused of trying to auction it to the highest bidder.

    Emanuel talked with the governor in the days following the Nov. 4 election and pressed early on for the appointment of Valerie Jarrett to the post, sources with knowledge of the conversations told the Sun-Times. There was no indication from sources that Emanuel brokered a deal, however.

    American voters will learn more when Patrick Fitzgerald receives a Blagojevich indictment and the wiretap tapes flow to Blago’s attorney and thus the world.

    Rham Emanuel is starting to glow (i.e. becoming radioactive).

    OOPS Caroline Kennedy POLL FAULTED screams the New York press.

    Caroline Kennedy, who’s making her case to succeed Sen. Hillary Rodham Clinton, didn’t vote in several elections – including the 2005 mayoral primary and the 2002 general election, The Post has learned.

    City Board of Elections records show the former first daughter also didn’t cast a ballot in the 1997 mayoral primary race and several other primaries since she registered at her current address as a Democrat in 1988, a Post review showed.

    Such civic committment. Isn’t this what Caroline is touting as her qualifications for office?

    George W. Bush PUNTS $17.4 Billion to Automakers

    In a sign that the Iraqi journalist REALLY did hit President George W. Bush in the head the other day, the Bush Administration announced this morning a loan package for United States automakers.

    The Bush administration came to the rescue of the troubled U.S. auto industry Friday, offering $17.4 billion in loans in exchange for concessions from carmakers and their workers.

    “Allowing the auto companies to collapse is not a responsible course of action,” President Bush said. He said that a bankruptcy was unlikely to work for the auto industry at this time and would deal “an unacceptably painful blow to hardworking Americans” across the economy.

    The firms must use these funds to become financially viable, or lose the taxpayer money. The official said if the firms have not attained viability by March 31, 2009, the loan will be called and all funds returned to the Treasury.

    President George W. Bush spoke early Friday about his administration’s plan to avoid collapse of the U.S. auto industry.

    Bush made a statement at 9 a.m. EST at the White House.

    This bridge loan package for the automakers is the classic PUNT to the incoming Obama Administration. Bush was simply afraid of the forced bankruptcy of a major American industry on his watch.

    Political courage from a Republican President that said: “I’ve abandoned free-market principles to save the free-market system….”

    Flap will be glad to see Bush return to Texas.

    What a disaster.

    And, now, it is announced that Secretary Paulson will be going back to Congress to ask to replace the TARP money that has been transferred to the automakers.
