    FOX News: Charges Against Guantanamo Bay Detainees Dismissed.

    Military judges dismissed charges Monday against a Guantanamo detainee who chauffeured Usama bin Laden and another who allegedly killed a U.S. soldier in Afghanistan, marking a stunning setback to Washington’s attempts to try detainees in military court.In back-to-back arraignments for Canadian Omar Khadr and Salim Ahmed Hamdan, of Yemen, the U.S. military’s cases against the alleged Al Qaeda figures dissolved because, the two judges said, the government had failed to establish jurisdiction.

    They were the only two of the roughly 380 prisoners at Guantanamo charged with crimes, and the rulings stand to complicate efforts by the United States to try other suspected Al Qaeda and Taliban figures in military courts.

    Hamdan’s military judge, Navy Capt. Keith Allred, said the detainee is “not subject to this commission” under legislation passed by Congress and signed by President George W. Bush last year. Hamdan is accused of chauffeuring bin Laden’s and being the Al Qaeda chief’s bodyguard.

    The new Military Commissions Act, written to establish military trials after the U.S. Supreme Court last year rejected the previous system, is full of problems, defense attorneys argued. …

    A Pentagon spokesman said the issue was little more than semantics.

    Navy Cmdr. Jeffrey Gordon told The Associated Press said the entire Guantanamo system was set up to deal with people who act as “unlawful enemy combatants,” operating outside any internationally recognized military, without uniforms, military ranks or other things that make them party to the Geneva Conventions.

    “It is our belief that the concept was implicit that all the Guantanamo detainees who were designated as ‘enemy combatants’ … were in fact unlawful,” Gordon said.

    Sullivan said that reclassifying detainees as “unlawful,” will require a time-consuming overhaul of the whole system. But Gregory McNeal, a law professor at Pennsylvania State University, said nothing prevents the Defense Department from reconvening hearings for detainees headed to trial and declaring them to be “unlawful” combatants.

    And to think that all of the Democrat Presidential candidates and Senator McCain on the GOP side wish to close GITMO and move these terrorists to the United States.

    This would be an ILLEGAL IMMIGRATION.

    Al Qaeda Watch: Adam Gadahn – Legitimate Demands?

    Adam Gadahn who is suspected of attending an al-Qaida training camp and working as a translator for the terror group. The 28-year-old Californian, who joined al-Qaida and appeared in propaganda videos for the terrorist organization, was indicted Wednesday, Oct. 11, 2006, on federal charges of treason and providing material support to terrorists, a U.S. Justice Department official said.

    ABC News: New Tape, Old Threats From American al Qaeda

    The former California teenage surfer turned al Qaeda propaganda chief, Adam Gadahn, repeated his threats to kill Americans on a new tape posted on the Internet Tuesday afternoon.

    Wearing a white turban, beard and glasses, Gadahn issued what he called a set of six “legitimate demands,” saying, “We don’t negotiate with baby killers and war criminals like you, Bush.”

    Gadahn, under federal indictment for treason, is the first American to be charged with that crime in half a century.

    Hell will freeze over before these demands are legitimized. Good chances are that Gadahn will be dead by then – in widescreen.

    British minister dumps ‘War on Terror’ in New York speech

    The Development Secretary, Hilary Benn, will cast his lot with critics of the Bush Administration tonight when he questions the validity of the phrase “War on Terror” during a speech in New York tonight.

    His address will place the Government firmly on the side of the Democrats in what is presently a fraught debate in Washington over the use of the expression, which was coined by the Bush Administration in the days after the September 11 attacks and taken up by Tony Blair as Britain joined the wars that followed in Iraq and Afghanistan.

    Mr Benn will argue that the term — which takes the form of “the global war on terror” or “GWOT” in US policy documents — gives an unwarranted legitimacy to the struggles of small fringe groups which really do not have much in common.

    He will also say that war is only part of the solution to combating terrorism and Britain and America should do more to use the “soft power” of values, ideas and reform to bring about lasting change in the failed and angry states where terrorist groups prosper.

    What does Minister Mr. Bean, mean by “unwarranted legitiamcy to the struggles of small fringe groups?” So, Global Jihad Terrorist organizations like Al Qaeda are small “FRINGE” groups?

Putting some daylight between Britain and the Bush Administration’s foreign policy is thought be a key priority after Mr Blair steps down this summer.

    This is the week the House has set to encourage the enemey in Iraq. The Los Angeles Times, ever precise, predicts between 30 and 60 Republicans will vote for the Democrats’ white flag resolution.

    As with the pledge about the NRSC, I won’t be supporting any Republicans indifferent to the effect of these resolutions on our enemy and our own troops.

    The Victory Caucus opened today, and watching the House debate should make for a vigorous debate among its members. If you believe in winning the war, sign up at the Caucus.

    AP: Senate committee repudiates Bush on Iraq

    In a calculated snub of President Bush, the Democratic-controlled Senate Foreign Relations Committee dismissed plans for a troop buildup in Iraq on Wednesday as “not in the national interest” of the United States.

    AP: Dems wary of Iraq reconstruction cost

    Emboldened by a successful first vote against President Bush’s Iraq war policy, Senate Democrats said Thursday they were wary of the administration’s anticipated $1.2 billion request for reconstruction there.

    Sen. Joseph Biden (news, bio, voting record), chairman of the Senate Foreign Relations Committee, said he wants assurances from the administration that the money would not fuel corruption or the insurgency in Iraq.

    A key piece of Bush’s new strategy is increasing reconstruction efforts, with the U.S. pledging another $1.2 billion and the Iraqi government designating $10 billion. As part of the plan, Bush is dispatching 21,500 additional troops to Iraq to bolster security so reconstruction efforts are not stalled.

    “I hope we will hear today some concrete details on why these funds will achieve better results than we’ve been able to achieve before,” Biden said.

    Senator Biden, in all due respect is a MORON.

    The Democrats are putting partisan politics above the welfare of their country.

    Helicopter gunships attacked suspected al-Qaida fighters in the south Tuesday after U.S. forces staged airstrikes in the first offensive in the African country since 18 American soldiers were killed there in 1993, witnesses said.

    Witnesses said 31 civilians, including two newlyweds, died in the assault by two helicopters near Afmadow, a town in an area of forested hills close to the Kenyan border 220 miles southwest of Somalia’s capital, Mogadishu. The report could not be independently verified.

    A Somali Defense Ministry official described the helicopters as American, but the local witnesses told The Associated Press they could not make out identification markings on the craft. Washington officials had no comment.

    On Monday, at least one U.S. AC-130 gunship attacked Islamic extremists in Hayi, 30 miles from Afmadow, and on a remote island 155 miles away believed to be an al-Qaida training camp at the southern tip of Somalia next to Kenya. Somali officials said they had reports of many deaths. The Pentagon confirmed the strike, but declined to comment on any details.

    The Pentagon is now acknowledging the special operation:

    The Somalia assault, however, was conducted by U.S. Special Operations Command and has been shrouded in secrecy. The military typically declines to reveal much about such missions by special operations forces, including the AC-130 gunships used in the Somalia attack, and Delta Force counterterrorism ground troops.

    Reuters: Mogadishu falls to Somali government troops

    Triumphant Somali government forces marched into Mogadishu on Thursday after Islamist rivals abandoned the war-scarred city they held for six months before an Ethiopian-backed advance.

    The flight of the Islamists was a dramatic turn-around in the volatile Horn of Africa nation after they took Mogadishu in June and spread across the south imposing sharia rule.

    Terrified of yet more violence in a city that has become a byword for chaos, some Mogadishu residents greeted the arriving government troops, while others hid.

    “People are cheering as they wave flowers to the troops,” said resident Abdikadar Abdulle, adding scores of government military vehicles had passed the Somalia National University west of the city center.

    Parts of Mogadishu shook with the sound of gunfire and there were outbreaks of looting after leaders of the Somalia Islamic Courts Council (SICC) fled its base early in the morning. Some fighters ditched their uniforms to avoid reprisals.

    “We have been defeated. I have removed my uniform. Most of my comrades have also changed into civilian clothes,” one former SICC fighter told Reuters. “Most of our leaders have fled.”

    So, the Islamists have CUT and RUN as the Global War on Terror continues.

    AP: Government troops enter Somalia capital

    Somali government troops rolled into Mogadishu unopposed on Thursday, the prime minister said, hours after an Islamic movement that tried to establish a government based on the Quran abandoned the capital.

    The Islamic militia promised to take a last stand in southern Mogadishu.

    “We are in Mogadishu,” Prime Minister Mohamed Ali Gedi said after meeting with local clan leaders to discuss the handover of the city. “We are coordinating our forces to take control of Mogadishu.”

    Well, that did not take long to rout the Islamists. The Ethiopians obviously are not fecking around with the spread of Islamic terrorism across their borders.

    Is this a lesson for the world?

    For the people of Somalia – yes.

    For Islamic appeasers – sadly no!

    WSJ: What’s Going On in Somalia?

    A guide to the latest terror-war front

    Though 98% Muslim and long without a functioning government, southern Somalia has not, so far, ripened into the fully fledged terrorist threat that many have feared it would. This week, however, as Ethiopia engaged Islamist Somali militiamen, Somalia became the site of a nascent regional war. The primary combatants are Somalia’s secular Transitional Federal Government (TFG), which is internationally recognized and politically supported by the U.S., and the Islamist “Islamic Courts Union” that holds sway on the ground. They are backed militarily by two fierce rivals, Ethiopia and Eritrea, respectively. The military balance appears indeterminate. Ethiopia has deployed 15,000 to 20,000 troops in Somalia. Eritrea has provided arms to the Islamic Courts militias and sent only about 2,000 troops to support them; but the Islamic Courts hold more territory than the TFG and have greater indigenous assets and popular support. Even if Somalia does not become a terrorist redoubt, it could become a potent fount of regional geopolitical instability and perhaps the next “field of jihad” unless diplomatic attention is rallied to rescue the situation.

    The Ethiopian invasion of Somalia proceeds apace, and from all reports, it proceeds at a much faster clip than anyone — including me — expected. Western journalism is struggling, and failing, to keep up.

    We know about the rapidity of the Ethiopian advance thanks to the news reports that filter out of the darkness of the Horn: the NYT’s stringer reports that the front line is now near the town of Wanlaweyn, well over halfway from the campaign’s starting-point of Baidoa (itself halfway from the Ethiopian frontier to the sea) to the prize, the Somali capitol of Mogadishu. (For reference, a map of Somalia is here; rather improbably, Wanlaweyn itself has a Meetup page.) Beyond this, details are sparse: journalism fails where journalists fear to tread, and so we are reduced to reading propaganda releases from the opposing sides — see, for example, and in an indication of the rather different values in this part of the world, Ethiopian Prime Minister Meles Zenawi bragging about the fatality rates amongst Islamist casualties — and the reports of the few Westerners on the ground. In Somalia’s case, the latter are mostly European aid workers and the odd United Nations official. Naturally, their reportage focuses upon things that affect them, and the wishes of the men with guns closest to them. Thus media from Islamist-controlled Mogadishu cites as its only two sources the Islamists — and the International Committee of the Red Cross. And so we see in the Washington Post unsourced passages telling us: “Aid workers said … thousands of civilians battered by drought, floods and now by rockets and mortars continued to flee villages in droves.” Worse: “United Nations officials warned of a dire humanitarian crisis inside Somalia, while fears remained high that Ethiopia’s campaign could have disastrous consequences across the Horn of Africa.”

    Attacking at dawn, Ethiopian and Somali government troops on Wednesday drove Islamic fighters out of the last major town on the road to Mogadishu, the Islamist-held capital.

    Former warlord Mohammed Dheere, who controlled the town of Jowhar before it was captured by the Council of Islamic Courts in June, led the Somali government troops, said resident Abshir Ali Gabre.

    “We will attack Mogadishu tomorrow, from two directions,” Dheere told the crowd, although his statement appeared to overstep his authority. Dheere does not speak for the government or the Ethiopians.

    Government spokesman Abdirahman Dinari confirmed the capture of Jowhar and said his troops were heading toward Balad, an agricultural village about 18 miles from Mogadishu. Smaller than Jowhar, it is the last town before the capital.

    Thousands of Ethiopian and Somali government troops were seen in tanks heading toward Balad, said Nadifo Ali Tifow, a resident in Qalimow, a village 25 miles from Balad.

    Fighting could still be heard at a military camp south of Jowhar and in the village of Lego. An Islamic official said his troops were simply entering a new phase in their battle.

    “Our snakes of defense were let loose, now they are ready to bite the enemy everywhere in Somalia,” said Sheik Mohamoud Ibrahim Suley. He did not elaborate, but some Islamic leaders have threatened a guerrilla war including suicide bombings in Addis Ababa, Ethiopia’s capital.

    Sandy Berger Watch: Inspector General – Berger Hid National Archive Classified Documents Under a Construction Trailer

    AP: Report Says Berger Hid Archive Documents

    President Clinton’s national security adviser removed classified documents from the National Archives, hid them under a construction trailer and later tried to find the trash collector to retrieve them, the agency’s internal watchdog said Wednesday.

    The report was issued more than a year after Sandy Berger pleaded guilty and received a criminal sentence for removing the documents.

    Berger took the documents in the fall of 2003 while working to prepare himself and Clinton administration witnesses for testimony to the Sept. 11 commission. Berger was authorized as the Clinton administration’s representative to make sure the commission got the correct classified materials.

    Berger’s lawyer, Lanny Breuer, said in a statement that the contents of all the documents exist today and were made available to the commission.

    But Rep. Tom Davis, R-Va., outgoing chairman of the House Government Reform Committee, said he’s not convinced that the Archives can account for all the documents taken by Berger. Davis said working papers of National Security Council staff members are not inventoried by the Archives.

    “There is absolutely no way to determine if Berger swiped any of these original documents. Consequently, there is no way to ever know if the 9/11 Commission received all required materials,” Davis said.

    This former National Security Advisor for President Clinton should be barred from ever dealing with classified documents again. Three years was NOT long enough of a ban.
