Think Progress: Franken: Air America Not Filing For Bankruptcy Today
Inside Radio reports:
Despite reports the liberal talk network would file for bankruptcy protection by week’s end — that apparently isn’t happening. Franken tells listeners “we’re not in Chapter 11″ and pokes at conservative talk hosts and websites for getting it wrong with quips like “who’s gloating now Bill O’Reilly?†We still believe it’s a tough economic situation at the libnet — and several staffers have been laid-off.
On Wednesday, ThinkProgress reported “Air America Radio will announce a major restructuring on Friday, which is expected to include a bankruptcy filing.†We made a judgment that our sources were knowledgeable and reliable. We regret the error.
Brian Maloney has the story within the story on how Think Progress may have been duped in order to talk down the asking price for an Air America sale.
Somehow Flap does not think this is the end of Air America financial troubles.

Air America Watch: Air America to Declare Bankruptcy?
Think Progress (Via Allah) is reporting that Air America Radio will file for bankruptcy protection on Friday.
Air America Radio will announce a major restructuring on Friday, which is expected to include a bankruptcy filing, three independent sources have told ThinkProgress.
Air America could remain on the air under the deal, but significant personnel changes are already in the works. Sources say five Air America employees were laid off yesterday and were told there would be no severance without capital infusion or bankruptcy. Also, Air America has ended its relationship with host Jerry Springer.
No mention on the Air America site.
This is a surprise?

What our own sources are telling the Radio Equalizer is that two potential buyers have recently been looking to scoop up Air America’s assets. But internal board squabbling has created a disunited front, with some members looking to hand the network back to eccentric co- founder (and Huffington Post contributor) Sheldon Drobny, while the rest shop for buyers.Jon Sinton, a former Air America and Clear Channel Radio executive, is said to be leading the effort to seek a purchaser.
Drobny, meanwhile, has been scrambling to figure out a way to retake the network and intends to rehire former COO Carl Ginsburg if he is successful…
…If Air America isn’t able to continue its programming, it opens the door for new feminist talk radio network GreenStone Media to take over some, or perhaps many, of its stations. Calls to Air America executives weren’t returned, but star talk-show host Al Franken confirms that, once again, the troubled network is facing a serious cash crunch.”I don’t know if that’s true or not,” Franken tells Radar when asked about the bankruptcy report. “We do know that there have been cash-flow problems. I haven’t been paid in a while. Like, there’s no cash flowing to me.”

Air America Scandel: Friday Update
The Weekly Standard in their August 29th edition, has Nothing to See Here.
The Air America scandal continues to metastasize. The national board of directors for Boys and Girls Clubs of America is considering a formal staff recommendation that the organization expel its Bronx, New York, affiliate, the Gloria Wise Boys and Girls Club, for apparent involvement in–and concealment of–a scheme by which nearly $900,000 was improperly diverted to the liberal radio network from bank accounts intended to fund social service programs for disadvantaged children and the elderly. “It’s a very, very serious matter,” Boys and Girls Clubs spokesman Evan McElroy told the Atlanta Journal-Constitution last week.
And he’s not the only one who thinks so. At least two law enforcement agencies, the New York City Department of Investigation and the New York State attorney general’s office, have confirmed an active interest in the matter. And, tangentially at least, the courts are already involved, as well. Bloggers Michelle Malkin and Brian Maloney, who’ve together done more than anyone else to advance the story, now report that Air America is being sued by an unpaid creditor who alleges, among other things, that the network’s current parent company, Piquant LLC, is merely a sham reincorporation of the “predecessor” outfit that filched the Boys and Girls Club money.
Meanwhile, Byron Calame, “public editor” of the New York Times, has quietly filed a post to his “web journal” acknowledging that his colleagues “showed up late” to the Air America story and thus “poorly served” their readers.
Only after “weeks of articles by other newspapers” did the Times finally get around to noticing the scandal in its own backyard. And this oversight was especially regrettable, Calame allowed, in light of the “flurry of articles” the paper had run during the happy-face PR blitz surrounding Air America’s debut in the spring of 2004. It’s inconsistencies like these, he pointed out, that typically give rise to “a perception of liberal bias” at the Times, and before you know it, certain of the paper’s right-wingier subscribers are writing in to complain.
Calame does have some good news to report, however. In this particular case, at least, any perception of liberal bias at the Times is one “for which I haven’t found any evidence after checking with editors at the paper.”
In the meantime, Air America Radio host, Randi Rhodes is flying (perhaps in her charted jet) to Crawford to be with Cindy Sheehan.
And Evan Montvel Cohen, the former chairman of Ari America is still missing.

My investigative blog partner, Brian Maloney, watched the surreal appearance of Air America co-founder Sheldon Drobny on C-SPAN this weekend. Our thanks to the caller from Dallas who broke the silence about the Air American financial scandals on the program. Drobny was visibly uncomfortable. As he should be.
Drobny, a deep-pocketed, self-described venture capitalist from Chicago, is a strange duck who deserves much more media scrutiny than he’s getting. In October 2003, NRO’s Byron York explored his moonbat writings for a fringe website called Make Them Accountable here. York noted Drobny’s Lyndon LaRouche connections and wrote:
In the 1990s, conservatives came under heavy criticism for relying on funding from the foundation run by Richard Mellon Scaife. Liberal commentators routinely portrayed Scaife as a right-wing zillionaire who harbored dark visions about the evil nature of his political adversaries. Now, it is a zillionaire on the left-the guiding force behind liberalism’s premier outreach effort-who harbors dark visions about the evil nature of his political adversaries. And that is the face of liberal talk radio.
Since then, however, neither the New York Times nor any other major MSM outlet has had anything more to say about the checkered past of Drobny and his wife, Anita, their apparent shell game habits, or their latest efforts to drum up new cash for the Air America money pit through the dubious “Nova M” business plan, which we first exposed here.
It is amazing to Flap that there have been no leaks from either the FBI or New York authorities as to the progress of their investigation.
Certainly, this charge of fraudulant conveyance and theft of federal funds should have piqued the interest of some prosecutor.
At the very least, the Congress should be requesting hearings on this whole Air America Scandel.
And what does Al Franken have to say?
And these are some of the kids hurt by this scam.
Bleeding-heart liberals, beware. Like pied pipers in progressive clothing, Drobny and his wife may be coming to a town near you to entice you into Air America’s sea of red ink.
Don’t say you weren’t warned.

Brian Maloney and I take a close look at the financial plans of Sheldon and Anita Drobny, the deep-pocketed, far left Illinois Democrat couple who dreamed up Air America and have been involved in its many strange and dubious business reorganizations. The key questions that curious radio industry veterans, financial observers, skeptical investors, and business reporters should be asking Air America:
What is Nova M? And why now?
There may be an easy explanation for Nova M. It will be the replacement company for Air America Radio after Piquant LLC files for bankruptcy.
Of course, the poor kids at Gloria Wise will never be repaid and the federal government will now after exposure of this scandel search out, indict and convict Evan Cohen and the rest of his cohorts for various federal crimes. Then, the New York authorities will file their charges.
Nova M will be the purchaser of the bankrupt assets of Air America Radio.
A shell game, you betcha.

If the Times wants us to believe that it objectively reports the news, especially that which occurs in its own back yard, then we expect to see some in-depth coverage of the apparent fraud involving Piquant Media, Progress Media, Air America, and Gloria Wise, and not just a bloodless regurgitation of facts already well known to anyone with an Internet connection.
Barney whipped out his Sherlock Holmes hat and magnifying glass, conducted a thorough investigation, and found that the Times is not a liberal newspaper! Yup, here are his exact words: “There’s another reason to get to the bottom of the scandal. It’s the perception problem — a perception of liberal bias for which I haven’t found any evidence after checking with editors at the paper.”
Reassuring, isn’t it? Liberal bias at the Times does not exist. It is a “perception” problem “inspired by conservative bloggers.” It is all in your imagination. The Great Oz has spoken! Besides, Calame has proof. He called the editors who ignored the Air America story, and they denied that liberal bias was the reason. So the Times is not liberal. Time to go back to the divan.

Mediacrity is justifiably stunned that he cannot uncover any evidence of bias. But I also find it stunning that he admits his search for bias consists of asking the editors. They will never admit their bias because they don’t see it. And neither does Calame.

I don’t want to belabor the point that Brian has already hammered home with great efficiency, but this Nova M maneuver is the most Enron-esque move we’ve seen from the Drobnys and their Air America partners, yet. Switch the name “Drobny” with “Fastow” and you’ve got something straight out of Conspiracy of Fools. Will Al Franken condemn this shell game maneuvering?

Air America Scandel: Inside Air America, An Investigative Blog Report

It’s not just the Gloria Wise Boys & Girls that’s knocking on Air America Radio’s door looking for lost money. According to court records obtained by Radio Equalizer/MichelleMalkin.com, another major creditor has been demanding that Air America pay up. The liberal radio network has refused to do so, despite a court order and scathing words from a New York judge overseeing the case. Now, the creditor–Multicultural Radio Broadcasting Inc.–has filed a new complaint, accusing Air America and Piquant LLC (Air America’s current owners) of engaging in a “sham transaction” and “fraudulent conveyance” of assets in order to avoid paying its debts. The initial battle between Multicultural Radio and Air America was widely covered last year.
Now, here’s the rest of the story the MSM has yet to report.
On June 23, 2004, New York Supreme Court Judge Marylin Diamond filed this order. The matter concerning the two parties’ time brokerage agreement was not settled in Air America’s favor.
Five months later, on Nov. 24, 2004, Judge Diamond filed a default judgment ordering Air America to pay Multicultural Radio the sum of $255,518.86 in damages.

Six months after that order was filed, Multicultural Radio still had not been paid. On May 24, 2005, the company filed another complaint with the New York State Supreme Court–this time with legal guns blazing. Named as defendants were past officers and directors of Air America Radio, as well as current officers, directors and investors of Piquant LLC, including:

Jon Sinton
Terry Kelly
Mary Kelly
Anita Drobny
Sheldon Drobny
Thomas Embrescia
Mike Papantonio

Rob GlaserNote that this revelation included in the complaint was made in May 2005–two months before the story hit the blogosphere and Air America publicly acknowledged its “moral obligation” to pay back Gloria Wise.
The complaint next documents Air America’s p.r. strategy of smearing Multicultural Radio president Arthur Liu.
According to Multicultural Radio, dissenters from the “classic shell game” scheme were met with threats.
And the deal proceeded.
In addition to its obligations to Multicultural Radio, the complaint alleges that Air America owed more than $2 million in accounts payable and had no means to repay its obligations. Multicultural Radio further alleges that Cohen and Sorensen made a deal with Piquant promising never to sue, retaining an ownership interest in Piquant, and all agreeing to “indemnify and hold harmless” one another “with respect to claims for any breach or default or failure to perform any undertakings pursuant to their agreement.

Now you know why the current owners of Air America seem so disinterested in holding Cohen accountable for the Gloria Wise mess.Now you know why Air America and its defenders are using smear tactics to disparage critics and bloggers and journalists asking hard questions about its past and current finances.
But what’s next for Air America as it travels down its trail paved with debts?

Air America Scandel: Where is Evan Montvel-Cohen?
Michelle Malkin asks were is Evan Montvel-Cohen and why is Air America and Al Franken not pursuing him in this piece, AIR ENRON: AL FRANKEN NEEDS HELP.
The subject of my latest column: Where in the world is Evan Montvel-Cohen? The former chairman of Air America Radio and disgraced development director of the Bronx-based Gloria Wise Boys & Girls Club has been unavailable to the MSM. New York investigators will not comment on whether they have been able to interview him. And current Air America management and on-air talent seem not to care–even as they attempt to pin the blame on their latest financial woes on the man Al Franken is calling a “crook.”
It seems that the radio personalities at Air America are more concerned with corporate jets to take them to Crawford, Texas than repaying the hundreds of thousands of dollars to Gloria Wise Boys and Girls Club. Radioblogger has this story in this piece, Al’s Priorities. and Internal Dissent?
One hopes the FBI and the New York state authorities have a better explanation of Evan Montvel-Cohen’s whereabouts because the Air America folks seem to care less.
But, Franken, Air America is repaying the money, right? When?
Will there be an indictment soon? Is there already one under seal?

Air America Radio Scandel: NY Times Gets it WRONG; AP LATE
Michelle Malkin has AIR ENRON: MSM ERRS AND LAGS.
According to Emily Gest, a spokeswoman for the New York City Dept. of Investigation, the “transcript” of Al Franken’s remarks cited by the New York Times in this article apparently does not exist. “There is no official transcript,” Gest informed me. “You should expect to see a correction in the Times.” As I noted last night, the Franken quote reported by the Times differs from what Franken said here. I’ve sent e-mails to the Times asking them to explain the discrepancy. Stay tuned.
Don’t hold your breath Michelle waiting for them to respond. Flap had the error too in this piece, Air America Radio Scandel: New York Times ….FINALLY.
It seems the MSM would rather cover the spectacle of Crackpot Cindy Sheehan in Crawford, Texas rather than a down-right theft of public money by a left-wing radio station, Air America.
Well, Flap supposes better late then never with the ASSociated press and their piece, Investigators probe community center loan to Air America Radio.

The Radio Equalizer has A Close Call.
Just how bad are workplace conditions for Air America staffers?
Perhaps far worse than we’d previously thought.
It’s bad enough the company is generating fresh bad publicity almost daily, over the diverted $875,000 in taxpayer funds intended for a Bronx-based community service organization.
Now, to make matters worse, an internal memo obtained by the Radio Equalizer indicates Air America Radio employees faced late paychecks just over a week ago.
They were apparently stunned to receive a last-minute notice sent at 5:09pm Thursday, July 28th, indicating direct deposits would not be made Friday, as expected.
Written by company Vice President/Finance Sinohe Terrero (this article confims Terrero’s corporate role), it inferred the payroll processing company was to blame:
We have been advised by ADP that Direct Deposit will probably not post until Monday. We apologize for any inconvenience this may cost (sic). If you have any questions please feel free to call me.

Perhaps Al Franken and some of the highly paid hosts should defer some of their salaries so Air America can make its payroll for its staff.

This isn’t necessarily a sign of a company in financial trouble, but considering the staff has already had to work without paychecks for several weeks back in 2004, and Lizz Winstead has recently sued Air America.
Winstead claims that she’s owed $200,000 of her $250,00 annual salary, plus $83,333 in severance pay, $14,423.08 in unused vacation time and $5,960.55 that she says the network pocketed from her on-air ads for the Vermont Teddy Bear Company.
Again, I don’t know that this is indicative of the financial status of Air America, but if I were a liberal talk show host there’s no way I could work there. Not when Ed Schultz and Stephanie Miller seem to be doing all right for themselves without being on the payroll of the network.
