    California Proposition 8 Supporters File Federal Suit Challenging California Campaign Finance Laws

    Today supporters of California Proposition 8 that restored the traditional definition of marriage (one man and one woman) to the California constitution filed a federal lawsuit which challenges the constitutionality of California’s campaign finance laws.

    Acting on behalf of hundreds of supporters of Proposition 8 who have experienced various acts of harassment including death threats at the hands of opponents, the ProtectMarriage.com – Yes on 8 committee today filed a challenge in US federal court to the constitutionality of California’s campaign finance laws that compel disclosure of personal information of Prop 8 donors.

    “There has been a systematic attempt to intimidate, threaten and harass donors to the Proposition 8 campaign,” said Ron Prentice, Chairman of ProtectMarriage.com. “This harassment is made possible because of California’s unconstitutional campaign finance disclosure rules as applied to ballot measure committees where even donors of as little as $100 must have their names, home addresses and employers listed on public documents. These disclosure rules violate the US constitution in numerous ways. We are standing up for our contributors to ensure that the harassment stops.”

    This suit will test the rights of an individual’s freedom of speech versus the compelling state interest in assuring disclosure of campaign contributions to avoid corruption of the political process. the suit alleges the California Political Reform Act is unconstituional for a number of reasons:

    • The right of contributors to exercise their First Amendment rights free from threats, harassment and reprisals outweighs the state’s interest in compelled disclosure;
    • The Act’s requirements that committees report all contributors of $100 or more is unconstitutionally overbroad in violation of the First Amendment because it is not narrowly tailored to serve a compelling government interest.
    • The Act’s requirement for ballot measure committees to file any reports after the election is unconstitutional under the First Amendment because it is not narrowly tailored to serve a compelling government interest.
    • The Act is unconstitutional under the First Amendment because it does not contain a mechanism for purging all reports related to a ballot measure after the election has occurred.

    If anything the $100 contribution level for disclosure appears to be inordintely low for this day and age. But, will the federal appellate courts tinker with a California Legislature’s limit or throw out the entire process in an internet era which makes “chilling” free speech easier?

    Ultimately, the United States Supreme Court will weigh into these issues.

    New York Governor David Paterson Pulling Away From Caroline Kennedy as Hillary Clinton’s Replacement Senator?

    The language from Paterson does not heart Caroline Kennedy but a number of other candidates are receiving serious consideration.

    Now that the date has been set for Hillary Clinton’s secretary of state confirmation hearing (next Tuesday), the pressure is on for Gov. David Paterson to finally make a decision on who he will tap to replace her in the US Senate.

    But since he’s not even done vetting candidates yet, it’s unlikely his choice will come anytime soon.

    Speaking today on WOR-AM’s “The Joan Hamburg Show,” Paterson addressed the argument being made in favor of Caroline Kennedy by people like Deputy Mayor Kevin Sheekey, who say her relationship to President-elect Obama is the ultimate trump card.

    “Caroline Kennedy obviously does have a tremendous relationship with the president and that’s certainly a plus,” Paterson said. “She does not have much political, I mean legislative, experience which is a minus…She has pluses and minuses.”

    Flap bets Paterson backs away from Caroline Kennedy and appoints New York Democrat Attorney General Andrew Cuomo which then clears the field for a Paterson re-election effort for Governor in 2010.

    It is time to clear out the GOP deadwood in the United States Senate and pave the way for a new generation of Republican Party leadership in the chamber.

    The prospects actually look good for some decent candidates.

    I am hearing rumors coming out of Ohio that Senator Voinovich is seriously considering making an announcement next week that he won’t be running for re-election. According to my sources, Rob Portman would likely be the Republican to replace him. This also opens up the GOP gubernatorial nomination for former Republican Congressman John Kasich.

    Now, with a some excellent Republican candidates in California, the GOP is already looking up.

    How about Nevada?

    Chuck DeVore Preempts Arnold Schwarzenegger By Announcing California GOP Endorsements

    California GOP Assemblyman and U.S. Senate candidate Chuck Devore’s Web Ad: Barbara Boxer and her tax and spend colleagues in Washington just spent $620 million dollars on a brand new Capitol Hill Visitors center that was $360 million over budget and three years late.

    If California Governor Arnold Schwarzenegger wishes to run for Barbara Boxer’s California U.S. Senate seat he will have to get a move on it. Yesterday, Assemblyman Chuck DeVore announced a plethora of Republican elected backers, including 26 of the the current 29 GOP members of the California Assembly.

    • On Chicago's WGN-AM radio today, Illinois Secretary of State Jesse White — who did not sign the certification for Roland Burris to be named to the U.S. Senate — said his signature was "not required" for the U.S. Senate to seat Burris, and he agreed with the suggestion that the U.S. Senate was making him a "fall guy."

      "They could have seated him without my signature," White said. "My signature's mainly ceremonial rather than being a point of law."

      A deal is in the works and Burris will be seated very shortly.

    • Administrators of Team Sarah have uncovered evidence on a left-wing online thread that some Internet trolls sought to discredit the organization by posing as conservative racists on Team Sarah's forums.

      Team Sarah, an online community supportive of Gov. Sarah Palin, claims over 60,000 members and is affiliated with the Susan B. Anthony List, a PAC that supports pro-life women for public office.

      Apparently, about 90 left-wing participants on a thread at somethingawful.com pretended to be conservatives who loved Sarah Palin before writing racist or otherwise deranged rants against Barack Obama on the Team Sarah forums. Said one interloper on the somethingawful.com thread: "What I hope is that the fake posters eventually number the actual posters so it would be impossible to tell who is real and who is fake."

    • Harry Reid vowed Tuesday that he’ll lead the Senate until 2015 and beyond, taunting Republicans who’d like to unseat him and dashing the hopes of Democrats who’d like to succeed him.

      The Nevada Democrat, who is up for reelection in 2010, said he’s actually looking forward to being considered a “vulnerable” incumbent then.

      “You know, to be honest with you, I hope I am,” he said. “That way, [the Republicans are] going to spend lots of resources on me and leave states we’re looking at. They won’t have as many resources — and we have a lot of targets.”

    • Sixteen years after Bill Clinton tried to end restrictions on gays in the military, the US armed forces under Barack Obama may be forced to give homosexuals the same welcome as non-gays.

      Under president Clinton, the policy that once saw homosexuals discharged from US military service evolved to "Don't Ask, Don't Tell," allowing gays to remain in the military so long as they did not reveal their sexual orientation.

      Obama has pledged to overhaul current law.

      The homosexual lobby is pushing this story while the Obama Transition staff said it would be at least a year before they make this issue a prioroity. The Gays want their piece of Obama and are not letting go.

    • Gov. Arnold Schwarzenegger, sparring with legislators over the state's impending fiscal meltdown, has postponed his annual state-of-the-state address until Jan. 15, perhaps hoping that by then he can describe California's condition as anything but undeniably bleak.

      But down the road in San Francisco there is no such shortage of official assessments. There, Mayor Gavin Newsom has produced a marathon, or maybe we should call it a webathon, state-of-the-city address.

      Newsom recorded 11 detailed installments on the state of his city and posted them online on the city's Internet site and on YouTube, then invited viewers to comment. The mayor's segments total more than seven hours. I know. I watched them all.
